ORDER Whereas, the Commission has announced the schedule for holding the General Election to the House of the People, 2019 vide Press Note no. ECI/PN/2019, dated 10/03/2019 and provisions of Model Code of Conduct for political parties and candidates have come into force from that very date; and Whereas. para 2 of part I ‘General Conduct’ of “Model Code of Conduct, for the guidance of Political Parties and Candidates” provides:- “Criticism of other political parties, when made, shall be confined to their policies and programme, past record and work. Parties and Candidates shall refrain from criticism of all aspects of private life, not connected with the public activities of the leaders or workers of other parties. Azam Khan for his indecent and repugnant comments against Smt. Jaya Prada, candidate of BJP from 07-Rampur PC, in concerned Police Station; and Whereas, the Commission has observed that the impugned statement made by Sh. Azam Khan is not only indecent but also derogatory and totally uncalled for; and Whereas, Sh. Azam Khan was banned for campaigning in the State of Uttar Pradesh by the Commission for his misconduct and provocative speech during the General Elections to the Lok Sabha, 2014 and was also censured by the Commission, vide its Order, dated 16.04.2014; and Whereas, the Commission has observed that Sh. Azam Khan has not changed his way of campaigning and he is still indulging in using very objectionable language in election campaigning; and Whereas, the Commission, based on the available evidence and material facts, is convinced that the statements made by Sh. Azam Khan are in violation of the aforesaid Provisions of the Model Code of Conduct and Commission’s advisory, dated 28" November, 2013;and Now, therefore, the Commission, without prejudice to any Order/Notice issued or to be issued in the matter relating to MCC violations to him, hereby, strongly condemns the impugned statements made by him during election campaign held at Rampur and reprimands Sh. Azam Khan for the above said misconduct. The Commission, under Article 324 of the Constitution of India and all other powers enabling in this behalf, bars him from holding any public meetings, Public processions, public rallies, road shows and interviews, public utterances in media (electronic, print, social media) ete. in connection with ongoing elections for 72 hours from 10:00 am on 16" April, 2019 (Tuesday).
