ORDER

This pertains to the findings on General Labor Standards (GLS) and Occupational Safety
and Health Standards (OSHS) deficiencies as a result of the Routine Inspection conducted by this
Office on October 23, 2018 at the above-named establishment, pursuant to Article 128 of the
Labor Code of the Philippines, as amended.

Result of the Routine Inspection showed that the subject establishment has the following
deficiencies:

On GENERAL LABOR STANDARDS:


1. The establishment is employing less than 10 workers and 2 workers of which are
receiving salary less than 333.00
2. Failed to present proof of coverage on SSS, Philhealth, Pag-ibig of workers
3. No overtime pay
On OCCUPATIONAL SAFETY AND HEALTH STANDARDS:
1. No Safety Officer with Basic Occupational Safety and Health (BOSH) Training

Based on the computation of this Office, two (2) employees was found to be entitled to
receive the total amount of NINETY THOUSAND EIGHT HUNDRED SIXTY NINE 62/100
PESOS (₱90,869.62).

The Notice of Result (NR) containing the findings of this office was furnished in the above-
named establishment on October 23, 2018 containing the following directive: Any questions on
the above findings shall be submitted to this Office within five (5) days and correction thereof
shall be done within ten (10) days for GLS deficiencies and within the maximum period of three
(3) months for OSHS deficiencies from receipt of this Notice. This notice shall be posted
conspicuously in the premises of the workplace. Unauthorized removal of this Notice by any
person shall be dealt with law. Further, making any false statement, report or record file or kept
pursuant to the provisions of the Labor Code is considered unlawful and therefore punishable
with fine or imprisonment under Art.288 of the same code.

Mandatory conferences were scheduled on March 21, 2019 and March 28, 2019.

On March 27, 2018, Both parties appeared and were apprised by the findings of the LLCO.
Both parties entered into a compromise agreement in settlement of the computed amount of
salary differential and overtime pay.

Worker, JANET C. REBUTAZO and management, D’SPOT PHARMACY voluntarily


agreed in a settlement amount of FORTY-FIVE THOUSAND FOUR HUNDRED THIRTY FOUR
AND 81/100 PESOS (P 45,434.81), subject to the conditions that the management promises
to continue employment of the herein mentioned affected worker/employee, to adjust her/his
salary to the prevailing minimum wage effectively immediately, and to give affected employee all
other mandatory benefits by law.

Worker, LEEDA ROSE M. BORDON. and management, D’SPOT PHARMACY voluntarily


agreed in a settlement amount of FORTY-FIVE THOUSAND FOUR HUNDRED THIRTY FOUR
AND 81/100 PESOS (P 45,434.81), subject to the conditions that the management promises
to continue employment of the herein mentioned affected worker/employee, to adjust her/his
salary to the prevailing minimum wage effectively immediately, and to give affected employee all
other mandatory benefits by law.

WHEREFORE, premised considered, this case is hereby deemed considered SETTLED


AND CLOSED.
