Form: Demand for Rent

Purpose: This is a letter made by a lessor to a lessee demanding


the payment of the agreed amount of rent for
particularly described premises. The text in red and
sections underlined in red indicate terms and
language that will be unique to the particular
circumstance (e.g. the name of a company).

Notes: A demand made by a lessor is important for purposes


of ejecting (via a court proceeding) the lessee in case
of deliberate non-payment of rent.

Article 1673 of the new Civil Code of the Phils


provides that : “The lessor may judicially eject the
lessee for any of the following causes:
x x x (2) lack of payment of the price (rent)
stipulated. x x x”

Mere failure to pay rents, or a breach of contract to


pay rents, does not render the possession of the lessee
per se unlawful. It is not the failure of the lessee to
pay rents as agreed upon in a contract of lease but the
failure to pay rents after a demand therefore that
entitles the lessor to bring an action for unlawful
detainer against the lessee.

Notice is hereby given that [name of the enterprise] did not receive payment of
your rent amounting to [indicate amount of rent] that was due on [indicate supposed date
of payment] pursuant to our Contract of Lease dated [indicate date of Contract of Lease].

The terms of our Contract of Lease clearly stated that an overdue rent will accrue
a charge of [indicate amount of charge]. We shall be expecting the prompt payment of
your overdue rent plus the amount of charge within [indicate number of days] days from
receipt of this notice, otherwise, the [name of the enterprise] may be forced to commence
legal action against you.

Please do not hesitate to communicate with [ name of the enterprise ] should there
be any inquiry you would like to clarify.
