10 Performance Bond 5% of Contract Value in the form of a Demand


Draft payable in Mumbai or equivalent value of
Bank Guarantee (PBG) as per format provided by the
Employer from a bank acceptable to the
Employer shall be valid up to the end of Defect
Notification Period(DLP).
However Alfara'a agreed to submit the PBG of 5% till
Virtual completion and subsequent extension (two
days before expiry of original PBG) till the
DLP.
11 Defect Notification Period The Defects Notification Period shall be Twelve
(12) Calendar Months commencing from the
issuance of the Handing over.

12 Liquidated damage Liquidity damage at the rate of 0.5% of Contract
Value shall be charged per week of delay subjected
to the maximum limit of 5% of the contract Value.
13 Mobilization Advance 10% of Contract Value against Bank Guarantee
in the format approved by Employer from a bank
acceptable to Employer valid up to completion of
works. The BG will be returned to the Contractor
only after full recovery of Mobilisation amount
14 Recovery of Mobilization Recovery of Mobilization Advance shall
Advance commence on work done reaching of 20% of
Contract Value till the work done value reaches
80% of contract value on pro-rata basis
(@12.50%) from each RA Bill.
15 Payment Terms Within 21 days of the certification of the bill
provided it should be submitted in a format/
guidelines as acceptable/prescribed to/by the
Em to er / Engineer.
16 Schedule of Payment As attached.

17 Currency of Contract Indian Rupees


18 Minimum Bill Value Net Rs.100.00 Lacs after all deductions.
19 Retention Money At the rate of 5% of the Certified Gross value of
work done for each running bill will be deducted.
The Retention money shall not bear any interest.
Alternatively Contractor can submit upfront Bank
Guarantee equivalent to 5% of Contract Value,
valid up to Defect Notification Period
20 Return of Retention Money 50% will be released after Virtual Completion and
remaining 50% after Defect Notification period

21 Material Advance Io Bill Value of the Material delivered to site,


properly stored and protected Applicable on Steel
Fe500, Light Weight Blocks & Gypsum Plaster. This
will be paid in corresponding R.A. Bill
22 Client Supplied Material In case of Client supplied material, recovery will
be based on percentage of work done of prorate
basis. However contractor to send the indent along with
the requirement of schedule. In case of failure to
maintain this progress as per schedule, the total cost of
the material supplied will be debited to the contractor at
the rate of basic price.
23 Variation There is no variation allowed. However maximum
consumption of Steel considere'f the Project is

25 Price Escalation Any variation in Basic Rates on Steel, Cement,
Light Weight Blocks & Gypsum Plaster purchased
by contractor with prior approval of Employer/
Engineer will be adjusted both upward and
downward. Cement variation is not applicable for
bought out items like RMC, Blocks etc. Variations
for other materials are not payable.
26 Limit of Validity of Rates All the rates quoted will holds good till the
completion of the project irrespective of the any
variation in quantities or extension of time period.

27 Extra Items of Works Actual cost Plus 15% as Profit and Over Heads.

28 Taxes & Duties The Quoted rate include all applicable Duties,
Royalties and taxes (i.e, VAT & etc.) but excluding
Service tax
But increase / decrease in any applicable taxes
proposed by the State or Central Government,
subsequent to the date of the LOI and during the
execution of the contract, the same shall be
reimbursed / recovered
29 Water Supply Contractor has to make arrangements at his own
cost
30 Power Supply Provided at one point and all other distribution
shall be borne by the contractor & Actual
consumption shall be paid by the contractor. In
case of sufficient power is not available Contractor has
to make his own arrangement.
31 Safety and Security Contractor Scope

32 Jurisdiction of Contract Mumbai and only courts in Mumbai

33 Means of Contractual Delivery by hand (against receipt) and / or by


Correspondence electronic mail through the official mail ids of the
Employer / Contractor / Engineer.
