RELEASE DEED

THIS DEED OF RELEASE is made and executed on this …. day of March, Two
Thousand Eighteen (…..03.2019) at Bangalore by and between:

Aged about 47 years,

Hereinafter referred to as the “RELEASOR” (which term unless repugnant to the


context shall mean and include his heirs, administrators, legal representatives,
executors and assigns, etc.,) of the ONE PART, IN FAVOUR OF: -

Hereinafter referred to as collectively as “RELEASEE” (which term unless
repugnant to the context shall mean and include their respective heirs, administrators,
legal representatives, executors and assigns, etc.,) of the OTHER PART;

WITNESSETH AS FOLLOWS :-

WHEREAS, the property bearing Sy. No. 74, measuring 2 acres 20 guntas of land
originally being the Basaveswara Devara Inamthi Land and the one Siddalingaiah,
Rudrappa were the Archakas and performing the poojas of Basaveswara Temple at
Cheemasandra village, Bidarahalli Hobli, Bangalore East taluk, the said persons filed
an application for grant of Inamthi Land. In pursuant to the application filed by the
above said persons before Assistant Commissioner, Bangalore North sub-Division.
Bangalore under section 77A and 45 of Karnataka Land Reforms Acts 1961, the
Assistant Commissioner initiated the proceeding in LRF7(A) 125 В 0/1999-2000 and
passed an order in their favor on 10.10.2008. Consequently, all the revenue records
got transferred in their names. The said property is morefully described herein and
hereinafter called as Schedule A Property.

WHEREAS after the said grant order passed by the Assistant Commissioner,
Bangalore North. Sub-Division, Bangalore the said persons perfected the right, title
and interest on the schedule property and they were in possession and enjoyment of
the same. Pursuant to the same said Siddalignaiah and Basamma, Manjuntha,
Chetan Kumar, Parvathamma Chethan Kumar, Sri.Guruprasad, Smt.Suma
jointly sold the schedule A property to the Releasor herein for a valuable
consideration purchased out of his self earnings, under a registered sale deed dated
24.10.2008, Vide Document No. 1964/2008-09, Book-I, Stored in CD N0.BDHDI8,
Registered in the Office of the Sub-Registrar, Bidarahalli, Bangalore. By virtue of said
sale deed the Releasor became of the absolute owner of the schedule A property and
Schedule A property is his self acquired property. Subsequent to purchase of the
schedule A property by the Releasor, the Khatha also got transferred to his name.

WHEREAS the RELEASEE herein had filed Original Suit bearing No.1168 of 2009
against the said sellers and others seeking partition of several properties including
Schedule A property, and the RELEASOR was also arrayed as Defendant No.16, and
during the pendency of the said suit, the Releasor herein in order to settle the said

Original Suit out of the court, offered to relinquish his right, title, interest, claim, share
with respect to a portion of the property arising out of Schedule A Property, which are
more fully described herein below and hereinafter called as Schedule B property,
absolutely in favor of the Releasee, and the Releasee has accepted the said offer.

WHEREAS in consideration of the same, the Releasee herein have agreed to execute
a confirmation deed confirming the said sale deed dated 24.10.2008 vide Document
No.1964/2008-09, Book-I, Stored in CD N0.BDHDI8 executed by Siddalignaiah,
Basamma, Manjuntha, Chetan Kumar, Parvathamma Chethan Kumar, Sri.Guruprasad
and Smt.Suma.

NOW THIS DEED OF RELEASE WITNESSETH

1. The RELEASOR hereby grant, convey, transfer, assign and assure his right,
title, interest, claim, share, over the SCHEDULE ‘B’ PROPERTY UNTO
and TO THE USE of the said RELEASEE herein, which is free from all kinds
of encumbrances, who shall HOLD, POSSESS USE AND ENJOY all the
right, title and interest, claims, of the RELEASOR and all other rights,
payments privileges and amenities without any interruption, interference or
disturbance from the RELEASOR or any persons claiming through or under
them or any of them claiming any right or title thereto and TO HAVE AND
TO HOLD AND ENJOY his undivided right, title, interest, claim, share, over
the Schedule ‘B’ Property and every part thereof TO AND UNTO the
RELEASEE absolutely forever.

2. The RELEASOR have this day handed over the vacant and clear possession of
the Schedule ‘B’ Property to the RELEASEE and also handed over the relevant
documents in respect of the title to the Schedule ‘B’ Property in
originals/Certified copies to the use of the RELEASEE.

THE RELEASOR DO HEREBY COVENANT WITH THE RELEASEE AS


FOLLOWS:

1. The RELEASOR is having right, title and interest to relinquish his rights,
share, title and interest in the Schedule ‘B’ Property to the RELEASEE and
except him no other persons have or had any kind of right, title, interest, claim,
share, demand, etc., over the Schedule ‘B’ Property.

2. That the RELEASEE shall here afterwards and at all times peacefully and
quietly hold, own, possess and enjoy the Schedule ‘B’ Property as absolute
owner without any let or hindrance from or by the RELEASOR or any persons
whomsoever.

3. That the Schedule ‘B’ Property is free from lien, charge, minor claims,
maintenance claims, family rights, mortgages, etc., and in future if any disputes
comes or litigations arises over the Schedule ‘B’ Property to set right the same
at the RELEASOR’s own cost and risk.

4. That to save harmless and to indemnify the RELEASEE from and against all or
any losses, damages, costs, charges, etc., which the RELEASEE may incur,
sustain or legally compelled to pay in consequence of any claim put forward by
any person or persons over the Schedule ‘B’ Property or in the event of breach
of covenants herein by the RELEASOR or for the reason of any arrears of taxes
or encumbrances etc.,

5. That upon the request and cost of the RELEASEE, to do, execute and perform
all lawful acts, deeds and things that are necessary to transfer the clear-perfect
title of the Schedule ‘B’ Property more perfectly in favour of the RELEASEE.

6. The RELEASOR has not entered into any agreement or arrangement for
sale/transfer of the Schedule ‘B’ Property to any one or any party thereof with
anyone else except Releasee.

7. The RELEASOR further assures the RELEASEE that he has not done anything
affecting the title of the RELEASOR in any manner whatsoever. The
RELEASOR has delivered the actual vacant possession and all the original
documents of the Schedule ‘B’ Property to the RELEASEE on this day.

8. That the RELEASOR have no objection that the RELEASEE shall pay the
future taxes to the concerned office and also transfer the Katha and other
records in their favor and also they can enjoy the Schedule ‘B’ Property as they
likes by way of sale, gift, mortgage etc.

9. The RELEASEE shall not have any objections for the RELEASOR to intimate
the settlement arrived by the parties herein and get the said Original Suit
No.1168 of 2009 dismissed in respect of Schedule A Property of this deed, in
favor of the Lessor [Defendant No.16] herein as settled out of court, subject to
the terms of this Deed. And further notwithstanding the out come of the said
OS No.1168 of 2009, both the parties herein shall not have any claims of
whatsoever against each other at any time.
