336. ACTS OF LASCIVIOUSNESS.
ELEMENTS
(1) Offender commits any act of
lasciviousness or lewdness
(2) Act of lasciviousness is committed
against a person of either sec
(3) Done under any of the following
circumstances
a. When the offended party is
deprived of reason or otherwise
unconscious
b. By means of fraudulent
machination or grave abuse of
authority
c. Offended party <12 / demented
LEWD
 Obscene, lustful, indecent, lecherous
 Signifies the form of immorality which has
relation to moral impurity
 That which is carried out in a wanton
manner
NOTE:
 Motive of lascivious acts not important
because the essence of lewdness is the
very act itself
 Moral compulsion amounting to
intimidation is sufficient
 Desistance in the commission of
attempted rape may constitute acts of
lasciviousness
 No attempted or frustrated crime of acts
of lasciviousness
o From the moment the offender
performs all the elements
necessary for the existence of
the felony, he actually attains his
purpose and, from that moment,
all the essential elements of the
offense have been
accomplished
o No matter how far the offender
may have gone towards the
realization of his purpose, if his
participation amounts to
performing all the acts of
execution, the felony is
necessarily produced as a
consequence thereof

SEDUCTION
 Enticing a woman to unlawful sexual
intercourse by promise of marriage
or other means of persuasion without
use of force
337. QUALIFIED SEDUCTION
TWO CLASSES OF QUALIFIED SEDUCTION
(1) Virgin, (12,18) y/o, by certain persons,
such as, a person in authority, priest,
teacher, etc
(2) Seduction of a sister by her brother, or
descendant by her ascendant,
regardless of her age or reputation
ELEMENTS OF QUALIFIED SEDUCTION OF A VIRGIN
(1) Virgin (presumed if unmarried and of
good reputation)
(2) (12, 18) years old
(3) Offender has sexual intercourse with her
(4) Abuse of authority, confidence or
relationship on the part of the offender
WHO WOULD BE OFFENDERS?
 Abuse of authority
o Person in public authority
o Guardian
o Teacher
o Person who, in any capacity,
entrusted with the
education or custody of the
woman seduced
 Abuse of confidence
o Priest
o House servant
o Domestic
 Abuse of relationship
o Brother who seduced sister
o Ascendant who seduced
descendant
NOTE:
 Deceit is not an element of qualified
seduction
 The fact that the girl gave consent to the
sexual intercourse is no defense
 Seduction of sister/descendant
o Virginity not required
 o Relationship must be by
consanguinity
o Relationship need not be
legitimate
338. SIMPLE SEDUCTION
ELEMENTS
(1) (12, 18) years old
(2) Of god reputation/single/widow
(3) Sexual intercourse
(4) By means of deceit
NOTE:
 Virginity of offended party not required
 Deceit generally takes the form of unfulfilled
promise of marriage
 Promise of marriage by a married man is not
deceit
 Promise of marriage after sexual intercourse
does not constitute deceit
PURPOSE OF THE LAW
 Not to punish illicit intercourse, but to
punish the seducer who by means of a
promise of marriage, destroys the
chastity of an unmarried female of
previous chase character, and who thus
draws her aside from the path of virtue
and rectitude and then fails and refuses
to fulfill his promise, a character
despicable in the eyes of every decent,
honorable man.
339. ACTS OF LASCIVIOUSNESS WITH THE CONSENT
OF THE OFFENDED PARTY. Penalty = arresto mayor
ELEMENTS:
(1) Offender commits acts of lasciviousness
or lewdness
(2) Acts are committed upon a woman who
is virgin/single/widow of good reputation,
(12,18), or a sister or descendant
regardless of her reputation or age
(3) Offender accomplishes the acts by
abuse of authority, confidence,
relationshio, or deceit
NOTE:
 Male cannot be the offended party in
this crime
340. CORRUPTION OF MINORS
 Habituality or abuse of authority or
confidence, not necessary
 Not necessary that the unchaste acts
have been done
 Must be of good reputation
341. WHITE SLAVE TRADE.
ACTS PENALIZED:
(1) Engaging in the business of prostitution
(2) Profiting by prostitution
(3) Enlisting the services of women for the
purpose of prostitution
NOTE:
 Habituality not an elemetn
