Facts:

Emilia E. De Legare, was the owner of a parcel of land, together with a residential

Lourdes 0ragon. @he spouses agreed to purchase the property for *$#,+++.++ on condition
that the sum of *1,+++, the unpaid balance of Emilia4s indebtedness to @omas 3. Soriano
secured by a mortgage thereon, would be deducted from the price, and that 2ule would
assume said mortgage.
0fter the terms were agreed upon, -ohn caused to transfer Emilia5s @itle to his name
by virtue of the purported Deed of Sale. 0fter which, he executed a Deed of Sale in favor of
Sps. 2ule and 0ragon, which cancelled the transferred title to -ohn and re6registered to their
names with the annotation for the deed of mortgage in favour of Soriano. @hereupon, the
spouses delivered the agreed amount minus the mortgage due to Soriano.
Npon discovery that Emilia5s house and lot had been sold to Sps. 2ule and 0ragon,
she filed for the cancellation of new titles based on her adopted son5s fraudulent acts. @he trial
court ordered the cancellation of the new titles and ma)ing valid the title of Emilia de Legare.
!0 affirmed said 7udgment by the lower court.
Issue:
L8" Sps. 2ule and 0ragon are innocent purchasers in good faith and for value of the
properties contested.
Ruling:
9es, Sps. 2ule and 0ragon are innocent purchasers for value of the house and lot
here disputed and they are here ad7udged the lawful owners thereof.
0 purchaser in good faith is one who buys property of another, without notice that
some other person has a right to, or interest in, such property and pays a full and fair price for
the same, at the time of such purchase, or before he has notice of the claim or interest of
some other persons in the property. :ood faith consists in an honest intention to abstain from
ta)ing any unconscientious advantage of another.
'n the instant case, nothing in -ohn Legare4s person or behaviour suggested anything
suspicious to cause further in;uiry from Sps. 2ule and 0ragon. -ohn was the adopted son of
