UNILODGE STAFFORD HOUSE RESIDENCE AGREEMENT

(ACADEMIC YEAR)
OFFER
We wish to offer you accommodation in a UniLodge Stafford House on the terms set out in this agreement.
This agreement should be read in conjunction with the Student Hall Handbook, the Student Conduct Statute
and the Privacy Notice which are accessible at
https://www.victoria.ac.nz/about/governance/strategy/policies. Please read all documents carefully.
If you wish to accept this offer, please:
(a) sign, and arrange for a guarantor to sign, this agreement;
(b) post or email the signed agreement to us; and
(c) pay the Deposit in accordance with clause 2.1,
by the Offer Expiry Date, which is Friday 19th October 2018.
This agreement will be binding when we acknowledge receipt of the signed agreement and the Deposit.
TERMS USED
In this agreement, italicised terms are defined in the Key Terms below, in the text, or in clause 2.1. When
we refer to we/our/us or the University, we mean UniLodge Stafford House and/or the Victoria University
of Wellington, and when we refer to you/your, we mean the Resident.
KEY TERMS

Hall: UniLodge Stafford House, 40 The Terrace, WELLINGTON 6011

The following Room Types are available within the Hall: single room in either a 2 or 3 bedroom in a
multi-share apartment
Your Room Type will be confirmed by us under clause 5.1.
Term: 37 weeks Start Date: 24 February End Date: 10 November 2019

GENERAL TERMS
1 Our obligations
1.1 We will:

(a) provide you with accommodation in the Hall for the Term in a Room Type of our choice; and

(b) aim to create an environment within the Hall that fosters personal development and
encourages a sense of community and association with fellow students.
2 Your obligations
2.1 You will:

(a) pay us the Deposit by the Offer Expiry Date and otherwise as required by the Student Hall
Handbook;
(b) pay us the Accommodation Fee in the Instalments by the Instalment Dates, and otherwise as
required by the Student Hall Handbook;
(c) read and comply with the Student Hall Handbook, the Student Conduct Statute and all
University Statutes and Policies, as updated by us from time to time, and comply with all Laws;
(d) keep the Facilities clean and tidy, and pay for any cleaning, damage, repair and maintenance
for which you or your guests are responsible; and
(e) at the end of the Term or (if earlier) when you leave the Hall, leave the Room in the condition it
was in at the Start Date (fair wear and tear excepted), and return all room keys, access cards,
and chattels provided to you.
(f) consent to UniLodge using or retaining any image of you in UniLodge marketing materials.
2.2 If, due to damage of any kind, any cleaning, repair or maintenance (including replacement) is
required to the Facilities and responsibility cannot be attributed to individual residents, you agree
that you will be liable for a pro-rata share of the cost of such cleaning, damage or maintenance, as
determined by us.
3 Student Hall Handbook
3.1 We may reissue and update the Student Hall Handbook from time to time. The Student Hall
Handbook may include any rules, requirements and policies that (in our discretion) are desirable for
the proper management of the Hall, including rules, requirements and policies relating to:
(a) the manner and method of payment of the Deposit (including the Administration Fee, CSP Fee
and Bond) and the Accommodation Fee;
(b) non-payment (or late-payment) of any amounts owing under this agreement, including
associated fees and debt collection processes;
(c) daily life within the Hall, including catering, guests, noise, cleaning, laundry, events and
academic assistance;
(d) use of and access to exclusive and common Facilities, including rules preventing certain
activities taking place within the Hall and prohibiting certain items within the Hall;
(e) internet access, including rules prohibiting access to specific sites or types of sites;
(f) alcohol, smoking (including vaping) and drugs (whether legal or illegal), including partial or
total prohibitions on such substances; and
(g) health and safety, and fire safety, including participation in evacuation or other drills.
4 Payments
4.1 If you do not pay any amount owing under this agreement by the due date, the following applies:
(a) You agree to pay any further amounts required under the Student Hall Handbook and our
reasonable costs in recovering the amount owing.
(b) We may send you a written reminder notice. If the amount owing is not paid within 14 days of
the date we send the reminder notice, we may cancel this agreement by written notice, in
which case you must leave the Hall by the date we require and you will remain liable for all

amounts owing under this agreement for the Term (subject to refund of the Bond under clause
4.2), and for any prior breach of this agreement.
4.2 We will, within six weeks after the end of the Term or the date you leave the Hall (whichever is later),
refund the Bond less any amounts for which you are liable under this agreement, including for any
repair or cleaning and any amount under clause 2.2.
4.3 If the Guarantor is not a resident in New Zealand, the Instalment Dates are amended so that the
Accommodation is payable per trimester.
4.4 Deposit

(a) When you return the Hall Residence Agreement, you are required to make a one-off deposit
payment of NZD $660 as set out in the agreement.

(b) The $660 comprises a non-refundable Administration fee of $120, a non-refundable


Community Spirit Programme fee of $120, and bond $420.

4.5 Accommodation Fee

The accommodation fee is NZD $270 per week and includes electricity, gas, telephone line
rental, a 20GB weekly Broadband internet allowance and access to a UniLodge Stafford
House emergency kit.

Accommodation fees are paid according to the payment instalments by the scheduled dates
detailed below:

(a) International students

Accommodation is payable per trimester and in advance.

(b) New Zealand Resident students

Accommodation is payable in four instalments and in advance.

4.6 Internet

(a) Initial connection to the UniLodge Stafford House broadband network $30.00

(b) This fee is for activating the resident’s internet and is paid once per annum.

4.7 Internet Connection

I wish to receive an Internet connection to my bedroom based on the rates and conditions as
stated below, and as otherwise required by the UniLodge Stafford House Handbook:

(a) Rate per resident:

Initial internet connection fee $30.00

Use to a maximum of 20GB per week (midnight Sunday to midnight Sunday) $ 0.00

(b) Internet ‘top-ups’ once over the usage limit of 20GB can be purchased in increments of 1GB
at a cost of $5.00. The minimum top-up is 1GB.

(c) Any extra internet fees including ‘top-ups’ will be charged to my bedroom Extras account and
I agree to pay this account by the 10th of the following month.

(d) I also agree to pay any remaining internet fees at the time of my departure and accept that
my bond may be used to clear my account if I fail to do so at departure;

(e) Accordingly, I authorise UniLodge Stafford House to charge my bedroom Extras account with
the initial internet access fee and any ‘top-up’ fees;

(f) UniLodge Stafford House management reserves the right to terminate my Internet
connection if it becomes apparent the connection is being shared with others including other
residents;

(g) I am aware, understand and accept total responsibility for all of my actions and behaviour
using the intranet and internet service provided by UniLodge Stafford House;

(h) In particular, I agree not to use the Intranet or Internet service to download or trade in
anything that is deemed illegal by the New Zealand government.

(i) I agree not use the UniLodge Stafford House Internet service to download movies, television,
music or games illegally and I understand copyright infringement is not an acceptable use of
this service.

(j) Ticking this box indicates my acceptance of all conditions in order to receive an
internet connection

4.8 Extras

(a) Extras are an individualised monthly account to each resident at the Hall. $ Variable

(b) This account includes charges such as the initial internet connection fee, extra internet
downloaded by the resident, printing or photocopying, lost keys/swipes.

(c) Payment must be made by 4:30pm on the 10th of the month following invoicing.

4.9 Payment Method

All payments accepted by New Zealand debit card, internet banking or international bank transfer.

We do not hold credit card information; we do not accept bank notes, coins or cheques.

5 Room Type and Relocation


5.1 We will notify you of the apartment and room type upon your arrival.
5.2 We may, at any time, ask you to move to another room within the Hall. If we do so, you must move
to that room on the date requested.
5.3 We may, at any time, ask you to move to a room of another Room Type, University Hall of Residence
or other type of accommodation (New Room). If we do so, we will advise you in writing of:
(a) the date on or by which we require you to move (Relocation Date); and
(b) the New Room we require you to move to.
If we give notice under this clause, you must move to the New Room on or before the Relocation
Date, unless you elect to cancel under clause 5.4. If the New Room is in a different University Hall of
Residence, from the Relocation Date, the Hall under this agreement will be deemed adjusted
accordingly, and the Student Hall Handbook referred to in this agreement will be that of the new
Hall. You acknowledge that we may require you to relocate to another type of accommodation (that
may not be a University Hall of Residence) if we (in our discretion) deem your or another resident’s
wellbeing, health and/or safety to be at risk.
5.4 If, after receiving notice under clause 5.3, you decide that you do not wish to move to the New Room,
you may cancel this agreement by giving us written notice before the Relocation Date. If you do so,
you will not be liable for the Accommodation Fee from the Relocation Date (provided you leave the
Hall by that date), and we will refund you the Bond (subject to clause 4.2).
6 Conduct
6.1 You acknowledge and agree that:
(a) the Student Conduct Statute applies to your conduct, including at the Hall;

(b) any breach of conduct required by this agreement or the Student Hall Handbook is a breach of
the Student Conduct Statute;
(c) we may (at our discretion) update the Student Hall Handbook, Student Conduct Statute,
Privacy Statement and/or any other University policy, statute or statement at any time and you
will be bound by the version that is in force at the relevant time.
6.2 If, at any time, your conduct breaches the Student Conduct Statute, we may impose any disciplinary
action or penalty available under the Student Conduct Statute.
6.3 If we permanently exclude you from the Hall under the Student Conduct Statute, you must leave the
Hall by the date we require and you will remain liable for all amounts owing under this agreement for
the Term (subject to refund of the Bond under clause 4.2), and for any prior breach of this
agreement. This agreement will be cancelled from the date on which we require you to leave the
Hall.
7 Cancellation by Resident
7.1 If you give us written notice that you wish to cancel this agreement, the following will apply:
(a) if we receive notice on or before 18 January 2019, we will refund to you any CSP Fee and Bond
paid. You will remain liable for the Administration Fee; or
(b) if we receive notice after 18 January 2019, you will remain liable for the Administration Fee,
CSP Fee and Bond (subject to any refund under clause 4.2), and for the Accommodation Fee for
the entire Term and for any prior breach of this agreement. You must vacate the Hall by the
date given in your notice.
7.2 If clause 7.1(b) applies, we may offer your Room to another student of our choice. If we do so, you
will remain liable for the Administration Fee, Activities Fee and Bond (subject to any refund under
clause 4.2), and for the Accommodation Fee up to the day the new student takes up accommodation.
You must also pay us an administration fee of $540.00 to reflect the costs of securing a new resident.
You acknowledge that this option is at our discretion, and that we may replace residents in the order
in which they leave the Hall. As such, occupation of your Room by another student does not
necessarily mean that a replacement resident has been found.
8 Unforeseen circumstances
8.1 If circumstances beyond our reasonable control make it impractical or impossible for us to meet our
obligations to you under this agreement, we will use reasonable endeavours to provide alternative
temporary accommodation and/or services to you.
9 Payments
10 Privacy
10.1 You agree that we may use or disclose information we hold about you in accordance with the Privacy
Statement, and may disclose information to the Guarantor.
11 Definitions
11.1 In this agreement, italicised terms are defined in the Key Terms, in the text, or below:
Application means the application for accommodation submitted by the Resident prior to this
agreement.
Facilities means the Hall and all rooms, fixtures, fittings and chattels within the Hall.
Laws means all laws including statutes, by-laws, regulations and other legal requirements.

Privacy Statement means the University Privacy Statement as updated by us from time to time.
Resident means the resident who is a party to this agreement.
Room means the room allocated to you under this agreement (subject to clause 5), including
associated fixtures, fittings and chattels.
Room Type means the type or category of rooms available within the Hall as set out in the Student
Hall Handbook including, by way of example only, Single.
Student Conduct Statute means the Student Conduct Statue 2015 or any successor statute, as
updated by us from time to time, and includes the student disciplinary procedures established under
the Student Conduct Statute.
Student Hall Handbook means the student hall handbook published by the University in respect of
the Hall, as amended by us from time to time under clause 3.1.
University Statutes and Policies means all statutes and policies published and amended by the
University from time to time.
12 General
12.1 Where this agreement requires written notice, notices to:
(a) the Hall must be provided by email to the address specified in the Student Hall Handbook, or in
person to the current Property Manager for the Hall; and
(b) the Resident must be provided by email address specified in the Application, or in person to
the Resident.
12.2 Notices by email to:
(a) the Resident are deemed received when the email has been sent, and
(b) the hall are deemed received when receipt is acknowledged by the hall.
12.3 This agreement is personal to the Resident and the Resident’s rights under the agreement cannot be
assigned, transferred, licensed or sublet in any way.
12.4 The Resident acknowledges that, pursuant to section 5B of the Residential Tenancies Act 1986, that
Act does not apply to this agreement.
12.5 If any provision of this agreement is unenforceable under any Law, that will not affect the
enforceability of any other provision of this agreement.

13 Liability

13.1 We will not be liable for:

(a) any loss of or damage (of any kind) to your property; or

(b) any form of indirect loss or consequential loss you may suffer,

arising out of, or in connection with, your occupation of the Hall or under this agreement. You
acknowledge that this means we would not, for example, be liable if your property is lost or stolen,
or damaged or destroyed. You should therefore consider obtaining appropriate insurance for any
property that you have at the Hall.

Guarantee

14 In consideration of us providing accommodation to the Resident under this agreement, the


Guarantor:
(a) guarantees payment of all amounts owing by the Resident under this agreement, and the
Resident’s performance of all terms of this agreement; and
(b) indemnifies us against any loss we might suffer due to any non-payment or other breach of
this agreement by the Resident.

15 We may treat the Guarantor as the Resident in respect of any non-payment or other breach of this
agreement by the Resident, and are not required to take proceedings against the Resident before
taking proceedings against the Guarantor.
