Case: This is an appeal assailing the August 17, 2015 decision of CA, which found
Rico Niebres guilty beyond reasonable doubt of the crime of Qualified rape (Art.
266-A) of the RPC.
FACTS:
Version of the Prosecution
October 2010: The appellant Niebres, together with his wife (AAA’s sister)
and 6 children, went to the house of his parents-in-law in La Victoria,
Bula, Camarines Sur to participate in a traditional Palay harvesting.
Afterwards, Niebles had a drink with his father-in-law and brother-in-law.
On the following day, the carnal act occurred.
AAA was said to have a mild mental retardation even prior to the
incident. Consequently, she had bleeding in her vagina. It was also found
that the appellant raped her several weeks before the said incident.
March 25, 2011: The doctors of Naga Health Care Diagnostic Center
examined AAA. After conducting ultrasound examination, it was found
out that she was five (5) to six (6) months pregnant.
February 7, 2012: Dr. Edessa Padre Laguidao (Psychiatrist) revealed that
AAA was suffering from mental retardation with an intelligence quotient
(I.Q.) equivalent to nine (9)- year old child.
Version of the defense
October 2010: Niebres admitted that he and his family went to the
house of his parents-in-law in La Victoria
He attested that after harvesting Palay, he left La Victoria in the
afternoon and never came back. Moreover, he averred that the only
time AAA slept in their house in Panoypoyan was when he was in
Batangas from March to August 2010.
Niebres insisted that the filing of the case was actuated by ill motive,
considering that his parents-in-law were angry at him when he
demanded his share in the proceeds of the cow, which was purportedly
sold to cover up the wedding expenses.
June 28, 2013: Niebres was guilty of the crime of Simple Rape in relation
to Section 5 (b) of RA 7610, and sentenced him to suffer the penalty of
reclusion perpetua and to indemnify AAA the amounts of P50k as moral
damages and P50k as exemplary damages.
It was held that prosecution was able to present testimonial and
documentary to support AAA’s claim
Niebres’s unsubstantiated defenses of alibi and denial failed to create
reasonable doubt in light of the positive and categorical and testimony
and identification of AAA.
The RTC did not appreciate the qualifying circumstance of relationship
by affinity between the appellant and AAA, even if it was proven, given
the same was not alleged in the information
Ruling of the CA
ISSUE + HELD:
W/N Niebres’s conviction for the crime of Rape should be upheld – YES
a. The court held the proper conviction for Niebres for the crime
of Qualified Rape to Simple Rape
b. Niebres was charged of the crime of Qualified Rape as defined
and penalized under Article 266-A of the RPC1 with penalties
under 266-B of the RPC2
1 1. By a man who shall have carnal knowledge of a woman under any of the following
circumstances:
a. Through force, threat or intimidation;
b. When the offended party is deprived of reason or is otherwise unconscious;
c. By means of fraudulent machination or grave abuse of authority;
d. When the offended party is under twelve (12) years of age or is demented, even though
none of the circumstances mentioned above be present. (Emphases and underscoring supplied)

The death penalty shall also be imposed if the crime of rape is committed with any of the
following aggravating/qualifying circumstances:

10. When the offender knew of the mental disability, emotional disorder and/or physical
handicap of the offended party at the time of the commission of the crime.
c. For the successful prosecution of the crime of Rape by sexual
intercourse under Article 266-A (1) of the RPC, it is necessary
that the elements thereof are proven beyond reasonable
doubt, to wit: (a) the offender had carnal knowledge of a
woman; and (b) he accomplished this act through force, threat
or intimidation, when the victim was deprived of reason or
otherwise unconscious, by means of fraudulent machination
or grave abuse of authority, or when the victim is under 12
years of age or is demented.
d. Case law states that sexual intercourse with a woman who is a
mental retardate, with a mental age below 12 years old,
constitutes statutory rape.
e. People v. Deniega: f a mentally-retarded or intellectually-
disabled person whose mental age is less than 12 years is
raped, the rape is considered committed under paragraph 1
(d) and not paragraph 1 (b), Article 266-A of the RPC.
a. The person's capacity to decide whether to give consent
or to express resistance to an adult activity is
determined not by his or her chronological age but by
his or her mental age. Therefore, in determining
whether a person is "twelve (12) years of age" under
Article 266-A(l)(d), the interpretation should be in
accordance with either the chronological age of the
child if he or she is not suffering from intellectual
disability, or the mental age if intellectual disability is
established.
f. In this case, the prosecution competently established the
elements of the crime of Rape, as it was shown that: (a) AAA
was suffering from mild mental retardation, which has an I.Q.
equivalent to a nine (9)-year old child; (b) Niebres successfully
had carnal knowledge of AAA sometime in October 2010; and
(c) Niebres was able to accomplish the said act because AAA,
being a mental retardate, was deprived of reason at the time
of the incident.
The Court modifies the amount of exemplary damages. Niebres to pay AAA P75k
as exemplary damages. The P75k as civil indemnity and P75k as moral damages ar
affirmed. The court applies interest at the legal rate of six percent (6%) per
annum from the date of finality of this Decision until fully paid.
