Description of the Information Required

The aggregate of remuneration grants or financial support paid to the under mentioned
winners of the DAAD (Deutscher Akademischer Austausch Dienst) award in the period since
1989.

1. This request is considered to be perfectly clear. In the event however that you require
further information in order to identify and locate the information requested, please

2. We respectfully draw your attention to a previous request made by us on behalf of our


client on 23rd July 2013 (ref no: 120131082) and the response dated 29th July 2013
which invoked the derogation in respect of purposes of “journalism, art or literature”.
We note that the BBC does not offer an internal review procedure and we are
considering whether our client should make an appeal to the Information
Commissioner. We have repeated the request because we wish to have more detailed
reasons for refusing the request. The decisions of the Supreme Court/Court of
Appeal in Sugar have been frequently cited by the Information Commissioner in
supporting the BBC’s position. However, Sugar and most of these decisions seem to
refer to journalistic purposes for which, we submit, different considerations often
apply. The earlier case of (ref: FS50070465 – 17.03.2008) concerning Mr Young’s
salary band, resulted in an appeal which was upheld by the Information
Commissioner. We note in that decision the Commissioner held at paragraph 30 that
the information held by the BBC was essentially a matter of financial management
central to the operational heart of the BBC’s policies, strategies and allocation of
resources; and that holding this information furthered the dominant purpose of the
BBC’s operations rather than one of the purposes in Schedule1. We therefore still
consider that this request relates to accounting matters which are outside the purposes
of journalism, art or literature specified in Part VI of Schedule 1 to the Freedom of
Information Act 2000.
