I, NANCY T. YU, of legal age, Filipino, and a resident of 10 Loro St., Villilia
Village, Talipapa Novaliches, Quezon City, after having been duly sworn to in
accordance with law, depose and state:
1. That on October 3, 2018, I have entered into a Deed of Absolute Sale which was
acknowledged on the same date before Notary Public of Quezon City and entered in
his Notarial Register as Doc. __, No. __, Page __, Book __, Series of 2018. A copy of
the said Deed is hereto attached as ANNEX “A” and made an integral
part of this Affidavit;
2. That in the said Deed of Absolute Sale, I was the VENDEE of a certain parcel of land
covered by Transfer Certificate of Title No. 004-2017001913,
more particularly described as follows:
“a parcel of land (Lot 6, Blk. 1 of the consln. & subdn. Plan pcs-13-001014, being a
portion of the consoln. of lots 41-c-2-ss-1, 41-c-2-ss-2 to 41-c-2-ss-5 (lrc) psd-102377,
lrc rec. no. 1037, situated in brgy. commonwealth, payatas, san mateo [before] [now]
q.city, m-manila xx xx containing an area of one hundred twenty seven [127] sq. meters.
xxxx.”
3. That after I have fully paid the purchase price, vendors Jowell Cirineo and Jackeline
Cirineo, unreasonably refused to surrender their Owner’s Duplicate of Copy to the
above-described property;
4. That the vendors in the said Deed of Absolute Sale agreed that upon its execution, said
Deed shall be annotated in the Title with
the Office of the Register of Deeds of Quezon City;
5. However, since the said Deed of Conditional Sale per se could not be annotated on the
Title with the Office of the Register of Deeds, I am therefore executing
this Affidavit for the purpose of attesting to the truthfulness of the foregoing
allegations and in support of my request for the annotation of an adverse claim over
the parcel of land covered by the Transfer Certificate of Title No. 004-2017001913;
6. That more importantly, the vendors, up to now, continuously and maliciously refused to
return the purchase price that I paid for the subject property;
7. That there is a great possibility that the subject property will be sold to another and that
the title on the same will be transferred in the name of another buyer.
