JUDICIAL AFFIDAVIT

I, CARDO DALISAY, Filipino, of legal age, married and with residence

and postal address at #34 Balimbing St., General Santos City, after having been
sworn in accordance with law, depose and say that:

Preliminary Statement:

The person examining me is Atty. Princess Rosshien L. Hortal with address

at 2/F GSC Investment Action Center Bldg., General Santos City. The examination
is held at the same address. I am answering her questions fully conscious that I do
so under oath and may face criminal liability for false testimony and perjury.

Questions and Answers:

1. Please state your name and other personal circumstances for the record.
A: I am Cardo Dalisay, of legal age, married to Aleana Dalisay and with
residence and postal address at #34 Balimbing St., General Santos City,
and currently employed as Principal I in Walang Pasok Elementary
School.

2. Are you the same CARDO DALISAY, the petitioner in this case?
A: Yes, sir. I am CARDO DALISAY, the petitioner in this case.

3. As a petitioner, under what circumstances have you acquired the facts

by which now you are testifying?
A: Through my personal knowledge of the facts, Ma’am.

4. What is the subject of your petition?

A: The petition is about the re-issuance of the TCT No. 1 in the name of
Cardo Dalisay.

5. Why did you file the instant petition?

A: My owner’s copy of TCT No.1 was lost.

6. You said your original TCT No.1 was lost, how did you lose it?
A: While on board a bus from Koronadal City to General Santos City, last
August 10, 2018, I fell asleep until the bus arrived at the terminal. I hurriedly
got up because I was the only passenger left and so I forgot to bring with the
envelope which contains the owner’s copy of TCT No.1.

7. After losing the original copy of TCT No.1, what did you do
afterwards?
A: I executed an Affidavit of Loss last August 15, 2018 and the same was
annotated on Registry of Deeds of General Santos City on the same date.
 8. I am now showing you a copy of Affidavit of Loss. Is this the same
Affidavit of Loss you are referring to?
A: Yes, Ma’am. That is the same Affidavit of Loss.

A copy of the Affidavit of Loss is hereto and made an integral part hereof
and marked as Exhibit “A”.

9. I am also showing to you a Certified Copy of TCT No. 1 with Entry

No. 12345 on page 4 of Registry of Deeds of General Santos City copy
of TCT No. 1. Is this the same a Certified Copy of TCT No. 1 with
Entry No. 12345 on page 4 of Registry of Deeds of General Santos
City?
A. Yes, Ma’am that is the same Certified Copy of TCT No. 1 with Entry No.
12345 on page 4 of Registry of Deeds of General Santos City.

A copy of the Certified Copy of TCT No. 1 with Entry No. 12345 on
page 4 of Registry of Deeds of General Santos City is hereto attached
and made an integral part hereof and marked as Exhibit “B”.

10.Do you affirm and confirm the truthfulness and veracity of all the
statements you stated in this judicial affidavit?
A. Yes, Ma’am.

AFFIDAVIT OF ATTESTATION

I, PRINCESS ROSSHIEN L. HORTAL, of legal age, Filipino, married and

holding office at 2/F GSC Investment Action Center Bldg., General Santos City,
Philippines, after having been duly sworn to in accordance with law, do hereby
depose and state:

1. That I was the lawyer who conducted/supervised the Affiant CARDO

DALISAY in the execution of his judicial affidavit;

2. That the execution of said Judicial Affidavit was done in my office at 2/F
GSC Investment Action Center Bldg., General Santos City, Philippines on the 29th
day of September 2019;

3. That I faithfully recorded the questions and the corresponding answers that
she gave;

4. That neither did I coach him nor were there any other person doing the
same regarding his answers to the questions;

5. That I execute the foregoing affidavit to attest to the veracity of the

foregoing facts and for whatever legal purpose this may serve.
