Dear Mr. Thomas,
Based on the review undertaken by my office, it appears that all the member positions of the
governing body ("board") of Drainage District #5 are vacant. It does not appear that any candidate has
filed with King County Elections for any of the board positions since the statutory framework governing
election of drainage district board members went into effect in 1986. See RCW chapter 85.38. My
office has found no evidence of any election for board positions have been held in the last 10 years.
‘Our conclusion may be based on incomplete information. Therefore, please respond at your
earliest convenience but no later than April 15, 2019, identifying those persons, including their contact
information of address and telephone number, who are asserting and/or representing that they are a
member of the board for Drainage District 5 now and in the last 5 years. Please also provide their board
position number and when they were elected or filed for candidacy in accordance with RCW 85.38.100

The information provided by the board and the individual members as to their status as
statutorily authorized members of the board for Drainage District 5, will be used to determine if any or
all of the board positions are vacant under RCW chapter 85.38; and whether, in furtherance of RCW
chapter 85.38, the King County Council needs to appoint a person to serve in such vacant positions until
a person is elected at the next drainage district general election,
Failure to respond to this letter by the date above will be construed to mean the board positions
are vacant and | will proceed with a process to ensure these vacant positions are filled in accordance
with RCW chapter 85.38.

We are and have in the past advertised to fill any vacancy for commissioner positions
In Drain District 5. When we request our budget for the year with KC Accessors office,
‘we provide current commissioners and their information.
‘The reason we were not listed with the department of Elections in King County is we
never have enough candidates that live in our District to hold an election, as these
positions are unpaid.
We hope this answers your questions. We welcome anyone qualified for a
commissioner position seat who lives in Drain District. Please note Drain District 6 and
9, have the sare trouble as we do recruiting commissioners,
Drain District § would be pleased to sit down and discuss Drain District Policy and any
other questions regarding the cost of an Election, for us small districts, with small
budgets. We are always aware of costs passed on to all who live in our district. Please
