SYNOPSIS

“Roles and Responsibilities of a Contract Administrator - an Overview”

In the construction industry, the contract administrator is the individual responsible for administering the standard or bespoken construction contracts.

The contract administrator role can be undertaken by several possible professionals such as architect, engineer, quantity surveyor, project manager, a client
representative or employer's agent and other professional players. The contract administrator is responsible for administering the terms of the building contract
between the parties. He will act as the agent of the employer in some circumstances but at the same time will be required to make impartial decisions in
others. The obvious contradiction of this ‘dual’ role can give rise to difficult issues. Therefore, it is important for the contract administrator to understand his
role and responsibilities as to enable him to administer a construction contract in the best and fairest way possible.

Pursuant to that, this talk is aimed to provide an overview on the role and responsibilities and what are the best practices that can be adopted by a contract
administrator. Furthermore, it is intended that the participants will be able to better understand and appreciate the contract administrator duties and
obligation under a construction contract.

SPEAKER

- Sr Jaspal Singh Nachatar Singh, B. Sc. HBP (Hons) Quantity Surveying (USM), M. Sc. Project Management (USM), Registered Quantity Surveyor (BQSM),
(RISM), Adjudicator (KLRCA)

Sr Jaspal Singh a/l Nachatar Singh is currently attached with the Public Works Department Malaysia (PWD) as Senior Quantity Surveyor. He graduated with a
B.Sc. (Hons) Housing, Building & Planning (HBP) (Quantity Surveying) from University Science Malaysia. Jaspal acquired further qualifications in Masters of
Science in Project Management from the same university. In terms of professional qualifications, he is a Registered Quantity Surveyors with Board Of Quantity
Surveyor (BQSM) as well as a Member of Royal Institute Of Surveyor Malaysia (RISM). He later pursued his Professional Certificate in Adjudication and is listed on
the Kuala Lumpur Regional Centre for Arbitration’s Panel of Adjudicators. He is currently pursuing his Bachelor of Jurisprudence (External) (External Law
Degree) from University of Malaya on part time basis.

Jaspal has 13 years of experience as a quantity surveyor both in the private and government sector. He has experience working with quantity surveying
consultant firm, main contractor and sub-contractor. In the government sector, he has gain experience in various different government agencies such as PWD
Penang, National Landscape Department (KPKT), Drainage and Irrigation Department Of Malaysia (JPS) and is currently attach to Policy and Corporate
Management Branch, PWD Malaysia.

Jaspal is also a regular speaker at courses organized by various government and private sector such as JPS Malaysia, Attorney General Chambers Malaysia
(Arbitration Unit), Persatuan Kontraktor Melayu Pulau Pinang, CIDB Penang, Jabatan Perkhidmatan Pembentungan and etc.

His interest is on matters pertaining to construction contracts management and construction law.

Yang Arif Dato’ Lim Chong Fong is a Penangite born in 1962. He studied at the Wellesley Primary School and the Penang Free School. He is a Pengakap Raja. He
graduated with a Bachelor degree in Building from the National University of Singapore and a Bachelor degree in Laws from the University of London.

He is also a Chartered Arbitrator, Chartered Builder, Chartered Quantity Surveyor and Barrister at Law. He has worked as QS in the construction industry and
practiced as construction lawyer and arbitrator from 1985 to 2013. He was ranked as a leading lawyer in construction dispute resolution by Chambers & Partners,
Asialaw Profiles and The International Who’s Who of Construction Lawyers. He was also Deputy Chairman of the Chartered Institute of Arbitrators, Malaysia
Branch and empanelled in the KLRCA panel of arbitrators since 1999.

He has in 2003 undertaken research on security of construction payment as a Fulbright scholar at the William S. Richardson School of Law in Hawaii, USA and
subsequently appointed by the Construction Industry Development Board Malaysia to formulate the draft Construction Industry Payment and Adjudication bill. In
2010, he graduated with a Master of Laws degree from the University of Malaya through the submission of his dissertation entitled “Construction Industry
Payment - Strategies for Reform”.

He was Honorary Advisor (Contracts) of the Master Builders Association Malaysia and was appointed by the Minister of Works in 2013 as a member of the expert
panel to review the Malaysian construction industry practices following the construction accident at the Penang Second Bridge Project.

He was also Chairman of the Construction Law Sub Committee of the Bar Council Malaysia that lobbied for the creation of the specialist construction courts in
the Kuala Lumpur and Shah Alam High Courts.

He has been appointed as a Judicial Commissioner of the High Court of Malaya on 15 January 2014 and confirmed as a Judge of the High Court of Malaya on 30
January 2017. He is presently serving at the Penang High Court after having served at the Shah Alam High Court. In May 2017, he was awarded the Lifetime
Achievement Award by the Royal Institution of Surveyors Malaysia.
