Chapter 1

The Problem and Its Background

Introduction

In the Philippines, the use of motorcycles is one of the most common

means of transportation. It is estimated that there are more than 7 million

licensed motorcycles in the country, and is extremely popular among “ordinary,

working Filipinos” (Salaverria, 2014). The motorcycle has become an important

alternative mode of transportation, given the daily traffic gridlock and because

of that, crimes relating riding in tandem perpetrators became more highlighted

in the city.

The rate of crimes carried out by motorcycle riding criminals appears to

be on the rise in the public, but this case is not a relatively new phenomenon in

the country. Thus, motorcycle is commonly used as one of the instruments in

the commission of various crimes since the perpetrator could easily escape from

the scene of the crime and left their victims helpless.

The identities of the motorcycle riding criminals could not be easily

ascertained since they are wearing full-faced helmets with tinted face shields

rendering the person to be unidentified. Full-face helmets or those with dark

tinted visors are being used to conceal the identities of those committing a crime.

It is interesting to note how legislators and local government units are dealing

with the problem.

Zamboanga City Rep. Celso Lobregat filed House Bill 4438 seeking

authority for LGUs to temporarily suspend the use of protective head gear to

combat the rising criminality within their areas. The Sangguniang

Panlungsod of Tagbilaran, Bohol has passed an ordinance banning motorists

from wearing identity concealers such as bonnets, hoods, garments or helmets.

Further, there are national, regional and local law policy to support this

said problem. First we have, Senate 1128 “An Act Penalizing and Preventing The

Use of Motorcycles Or Scooters In the Commission Of Crimes Through Use of

Bigger Plate Numbers And Identification Marks, Regulation of Back Riders And

For Other Purposes. Second, Ordinance No. 0011-2007 entitled “An Ordinance

Regulating the Wearing of Half Face Helmet with Uncovered Face and One (1)

Back Rider Policy for All Motorcycle Riders, Prescribing The Use of Unmodified

Lights, Horns And Mufflers, And Requiring The Proper Placement Of Plate

Numbers For All Motor Vehicles Plying Within The Territorial Limits Of the City

Of Legazpi For Security Purposes, Providing Penalties Thereof, And For Other

Purposes. Third, City Ordinance #14-2017-1251, entitled “An Ordinance

prohibiting the wearing or use of bonnet, ski-mask, headdress or any garment

that will conceal the identities of the drivers and/ or their back riders of

motorcycles, single motorcycles for hire and tricycles travelling within the

territorial jurisdiction of Mandaue City and fourth, the Pagadian City Ordinance

No. 048 entitled “ An ordinance requiring all drivers and riders or passengers of

motorcycles to wear the duly approved protected half face helmet with uncovered

face while driving and imposing penalty for violation thereof.

It is only recently that police have seen how many died from riding-in-

tandem attacks. This crime is done by two people aboard a motorcycle – a rider

at the back who shoots the target, and another in front ready to speed away once

the trigger has been pulled. Motorcycle-riding in tandem killed a total of 125

people in less than a month. It was recalled that the PNP started collating data

about what it calls as attacks of Motorcycle-Riding Suspects (MRS) on October

10 when it was taken out of the war on drugs (PNP, 2017).

These are a very small minority but they're still very dangerous. The fact

that they are on motorcycles and wear helmets means that can easily commit

the crime with little risk to them. Also because of that, it makes it harder for the

law enforcement to catch them, they can do the crime time and time again.

Because of its efficiency, more criminals might use this method in killing. This

paper aims to help to lessen the riding in tandem crime that happening in our

city in this time.

Problem Definition
Scoping Process

Nowadays, however, there is an emerging “new use” of the versatility of

motorcycles. Lawless elements such as criminal syndicates and guns for hire are

now utilizing motorcycles as instruments or modus operandi for their criminal

acts, ranging from robberies, murders, to kidnappings, terrorism and extreme

violence (Aning, 2012; Alvarez, 2012).

According to Dante Jimenez, head of the Anti-crime group Volunteers

Against Crime and Corruption (VACC), there are many possible factors that

would explain the continuous and rampant incidences of crime involving

motorcycle-riding criminals. The mobility of motorcycles is greatly advantageous

to the criminals since it facilitates easy access to target victims and provides

expeditious escape from the crime scene. These criminals can conduct the crime

in just a very short period of time, in close proximity, and with the most number

of victims, without any apprehensions or predicaments since they could easily

get away from the area as fast as they could. Among the stakeholders that involve

in verifying the problem are; Traffic Enforcers, Land Transportation Office,

Philippine National Police and Iligan City Highway Patrol Group.

There are also other local ordinances that had similar issue in this present

study like the Pagadian City Ordinance No. 048 entitled “An ordinance requiring

all drivers and riders or passengers of motorcycles to wear the duly approved

protected half face helmet with uncovered face while driving and imposing

penalty for violation thereof. This ordinance is suitable in preventing riding in

tandem crimes because the riders can be easily identifying if they are involving

in crimes or not. Another, local ordinances that had similar issue in this present

study like the City Ordinance #14-2017-1251, entitled “An Ordinance

prohibiting the wearing or use of bonnet, ski-mask, headdress or any garment

that will conceal the identities of the drivers and/ or their back riders of

motorcycles, single motorcycles for hire and tricycles travelling within the

territorial jurisdiction of Mandaue City. This ordinance is also helpful in

preventing riding in tandem crimes because moreover, the required “gear” for

riders, particularly the helmet, gives criminals a very legit way to cover their

identities. Potential targets have very difficult time detecting and defending

against these criminals because of these factors. It is imperative that we, the

potential victims of these riders-in-tandem, must be aware, study, and prepare

against this crime phenomenon. It is only though understanding of their modus

operandi can we prevent or at least mitigate the threats that they pose.

Statement of the Problem

This study investigates the underlying factors on the continuous and

rampant incidences of crime involving motorcycle-riding criminals in Iligan City.

Specifically, this seeks to answer the following questions:

1. What is the current situation of public safety interventions in Iligan City?

2. What is the Extensive Motorcycle riding in tandem Masterplan of Iligan

City?

3. Who are the various stakeholders in the policy alternatives of motorcycle

riding in tandem in Iligan City?

4. What policy measures can be proposed for the findings of the study?

Objectives of the Study

Generally, the study aims to come up with policy statements with regards

to Motorcycle riding in tandem in Iligan City. Specifically, the study aims to:

1. Present the current situation of motorcycle riders Iligan City.

2. Assess the existing Extensive Motorcycle riding in tandem Master Plan of

Iligan City.

3. Identify the various stakeholders in the policy alternatives of motorcycle

riding in tandem in Iligan City;

4. Recommended policy options for an Extensive motorcycle riding in tandem

alternatives in Iligan City.

Methodology of the Study

This study uses the following methodologies:

1. Stakeholders Analysis- the stakeholders will be identified as follows:

1. The Traffic Enforcers of Iligan City; Land Transportation Office of Iligan

City; the Philippine National Police of Iligan City and Iligan City Highway

Patrol Group. Then the extent of their participation in terms of roles and

responsibilities will be established.

2. Focus Group Discussion (FGD) – People from similar backgrounds or

experiences will be gathered together to discuss a specific topic on

motorcycle riding in tandem. The group will be guided by a group facilitator

who will introduce topics for discussion and help the group to participate

in a lively and natural discussion among themselves. The strength of FGD

relies on allowing the participants to agree or disagree with each other so

that it provides an insight into how a group thinks about motorcycle riding

in tandem and the variation that exists in terms of beliefs, experiences,

and practices relative to that.

3. SWOT Analysis – A Strength-Weaknesses-Opportunities-Threats analysis

allows the researcher to gather insights from the different stakeholders of

the motorcycle riding in tandem. Each step of the analysis will be

highlighted in order to get the ideas of the stakeholders about the topic.

This is use in order to gather information on the need for motorcycle riders

in Iligan City.

4. Interview Analysis- The interviews gathered from different stakeholders

will be analyze in order to provide data on the said topic. It will become

one of the inputs to the Extensive Motorcycle riding in tandem Alternatives

Masterplan of Iligan City.

5. Policy Analysis Matrix - This approach will be use to evaluate the policy

recommendations and to be able to identify the optimal policy option.

To compare the various mechanism for funding as to evaluate the

funding partnership from a public or private agencies.

Background of the Problem

There are national, regional and local law policy in accordance with the

background of the problem in this study. First we have, Senate 1128 “An Act

Penalizing and Preventing The Use of Motorcycles Or Scooters In the Commission

Of Crimes Through Use of Bigger Plate Numbers And Identification Marks,

Regulation of Back Riders And For Other Purposes. Second, Ordinance No. 0011-

2007 entitled “An Ordinance Regulating The Wearing of Half Face Helmet With

Uncovered Face And One (1) Back Rider Policy for All Motorcycle Riders,

Prescribing The Use of Unmodified Lights, Horns And Mufflers, And Requiring

The researcher used a qualitative and quantitative data in this policy

paper. The study followed a systematic procedure in order to achieve the

objectives of the work. This study mainly relied on the primary data based on

the questionnaire and interview questions administered by the researcher.

Significance of the Study

This policy paper aims to determine on how to ensure the public safety

through policy intervention deterrent riding in tandem proposing alternative

related crimes of Iligan City.

The study, in one way or another, is beneficial to the following:

Civilians. Being the target population of this policy paper, they are the one

who will be affected in this riding in tandem operandi, which is very much needed

to be look upon of the people who have the authority or power in this city.

Through this policy paper, they will be able to prevent themselves from this

hilarious happening in the City.

Iligan City Highway Patrol Group. They are responsible for inspecting

motor vehicles for they are assigned along the highway. This policy paper will

make them internalize the importance of their role in ensuring the public safety

of Iligan City.

Land Transportation Office. Since they are responsible for all land

transportation, especially implementing transportation laws, rules and

regulations. Through this policy paper, they will get valuable ideas and

knowledge about the importance of having a strict inspection and registration of

motor vehicles, issuance of license and permits enforcement of Land

Transportation rules and regulations and collection of revenues for the

government.

Philippine National Police. This policy paper will make the Police realize the

importance of their role in ensuring the public safety of Iligan City processes

since they are the ones who have this power the most, which, optimistically

public safety is the goal of this policy paper.

Riders. This policy paper will make the riders realize the importance of

their being a law abiding in ensuring their safety and the safety of the people

living in the city.

Scope and Limitations of the Study

The study intends to investigate the motorcycle riders in Iligan City only.

A special attention will be placed on motorcycle riders in regards with the current

issue of motorcycle riding in tandem. The study also dealt with the establishment

Motorcycle riding in tandem masterplan. Further, the study intends to establish

a set of criteria for the prioritization of requests for the alternative solutions in

order to address riding in tandem issues.

Definition of Terms

The following words are defined theoretically and operationally to help the

readers understand the terms used in this policy paper.

Public Safety. Refers to the welfare and protection of the general public. It

is usually expressed as a governmental responsibility.

Policy Intervention. A plan or action adopted or pursued by an individual,

government or party.

Deterrent. A thing that discourage or is intended to discourage someone

from doing something.

Riding in Tandem. It is used as a noun to refer to crimes perpetrated by

more than one person, usually two men on a motorcycle.

Proposal Alternatives. A possibility of choice, especially between two

things, courses of action.

Crimes. An illegal act for which someone can be punished by the

government; especially: a gross violation of law.


Chapter 2

Conceptual Framework

This chapter presents the related studies after thorough and in-depth

research along with material such as internet sources and articles that are linked

to the study. This chapter reviews the work of researchers on problems closely

related to the present study. It provides a theoretical background on the concept

of the Riding in tandem problems that occur in our City.

Daniel Wallis in his article “Venezuela seeks to tame ‘Wild West’

motorcycles chaos,” discussed that hordes of motorcycle riders were increasingly

high-profile problem for the Venezuelan Government. Denounced in the media

as a “plague,” motorcycle provide essential, cheap transport but are often held

responsible for anarchy on the roads and the terrifying number of homicides,

kidnappings and armed robberies that beset the South American country. Some

also see them as the public face of the underworld. In a comment made by

Interior Minister Miguel Torres of Valenzuela, he called them “problem.” Many

behave atrociously, he said, riding on sidewalks, knocking off mirrors as they

weave in and out of traffic, and hurling abuse whenever challenged. Some are

involved in much more serious offenses, including abductions and drive-by

shootings. Further studies showed that motorcycles have become regular

flashpoints, with bikers creating gridlock in order to smash windows and rob

drivers at gunpoint. No wonder, Venezuela suffers one of the world’s highest

murder rates, and violent crime is the No. 1 issue.

Jim Yardley in his article “In City Ban, a Sign of Wealth and Its

Discontents,” discoursed how motorcycle and motorized bicycles becomes

problematic in the prosperity of a city. Motorcycles, the primary mode of

transport for migrant workers clawing their way up in the economic ladder, are

also favored by criminals who have terrorized the City of Guangzhou in recent

years, including a shocking case in late 2005, when a woman had her hand cut

off by a thief on a motorcycle. News accounts concluded that motorcycle thieves

were divided into gangs. As a result, the city will institute a ban on motorcycles

and motorized bicycles, hoping to quell a crime wave that has been building to

more than 100,000 offenses a year. Even though most people approved such ban

to suppress the crime rate, there are some who opposed it, like Ye Cunhuan. He

opened four stores that sell motorized bicycles. These bikes, equipped with small

motors, are popular for deliveries. Now, Ms. Ye has had to close two stores and

is facing ruin. Ms. Ye scoffed at the idea that criminals used motorized bicycles,

given their low rate of speed, and characterized the ban as an act of

discrimination against migrants and others with less money.

Chapter 3

Methodology

Policy Design

The study employed the Linear Model of Policymaking of Meier (1991) as

cited in Elliot and Popay (2000). There are four steps in this model. First, policy

practitioners make predictions/ prescriptions about issues that need to be

addressed through policy. Then, policymakers make a policy choice, the policy

is then implemented and has an outcome.

In identifying the problem by Conducting Public Hearing in matters

relating to the Ordinances, holding Committee Meeting among City Officials and

strict implementation of the Local and National Laws relating in riding in tandem

and Consultative Meeting were employed. This was done by convening all

important stakeholders that are directly involved and affected by the situation.

Policy Evaluation Criteria

The criteria used for evaluating the policy were efficiency, benefits, equity,

feasibility. Efficiency is the absolute reduction of the problem which will relate

to the Technical dimension, and while feasibility and acceptability represent to

the economic dimension, the options may not be always feasible due to funding

and other restrictions, this criterion is important to consider. On the other hand,

in the Economic dimension, evaluating the benefits of each of the alternatives is

important in determining which alternative should be considered for

implementation based on the funding criteria. And on administrative side, a

thorough analysis of the alternatives includes the evaluation of the equity or

advantages in favor to LGU- Iligan, all alternatives under consideration should

be weigh properly. Also, evaluating the feasibility of each of the alternatives is

the final component of this analysis and provides the ability to determine if the

implementation of the alternative is practical.

Alternative 1: Status Quo- The recent crimes perpetrated by motorcycle

riding suspects (MRS) targeting high-profile victims such as priests and elected

government officials and pity crimes had challenged the policies of the PNP. It is

for this reason that the PNP has crafted ‘Campaign Plan: Clean Rider’ for a

vigorous, focused, and effective campaign to totally eliminate crimes committed

by motorcycle riding suspects (MRS). To examine closely, the strengths of this

option are 1a) the campaign’s objective is to ensure the safety and security of

motorcycle riders and to impound stolen motorcycles; 1b) Bearing the PNP’s logo

‘Kalasag (shield),’ the Clean Rider sticker is also color-coded depending on

the region where the motorbike is registered. It also identifies which Police

Regional Office and City or Municipal Police Station has jurisdiction over the

owner; 1c) The sticker also bears as serial number for easy identification.

On the opposite side, it’s weaknesses are: 1a) the powerless in any society,

they would sooner beg for protection than invoke their formal rights; 1b) it speeds

up the inspection process at checkpoints. 1c) Unregistered motorcycle and

drivers without license will not be granted because they cannot claim the sticker

that will make you defend yourself that you are a legal motorcycle rider.

Alternative 2: Craft City Ordinance an Ordinance prohibiting the wearing

or use of bonnet, ski-mask, headdress or any garment that will conceal the

identities of the drivers and/ or their back riders of motorcycles, single

motorcycles for hire and tricycles within its territorial jurisdiction.

The advantage of adopting a new scheme is; 2a) Introduce and update the

said ordinance to create awareness to public regarding riding in tandem related

activities.

The possible weakness of option present of LGU- Iligan administration to

convince the constituents to come up with a sustainable solution for the City

especially that it is greatly affected by the recent conflict that happened in the

City of Marawi. 2 is the acceptance of the new stricter provisions of the

Ordinance. This could be considered a big challenge for the

it can deliver better and ensure safety and security of motorcycle riders; 2c.2) to

impound stolen motorcycles; 2c.3) Bearing the PNP’s logo ‘Kalasag (shield),’ the

In terms of threats, acceptability on the part of the entire public is the only

hindrance, but it can be resolved since provisions of Ordinance prohibiting the

wearing or use of bonnet, ski-mask, headdress or any garment that will conceal

the identities of the drivers and/ or their back riders of motorcycles, single

motorcycles for hire and tricycles within its territorial jurisdiction are anchored

with existing legal basis. The ordinance will incorporate all national and local

laws such as City Ordinance No. 0011-2007 in the City of Legazpi entitled “An

Ordinance regulating the wearing of half face helmet with uncovered face and one

(1) back rider and policy for all motorcycle riders, prescribing the use of unmodified

lights, horns and mufflers and requiring the proper placement of plate numbers for

all motor vehicles plating within the territorial limits of the City of Legazpi for

security purposes, providing penalties thereof, and for other purposes”.

Alternative 3:

Encourage the riders to do their part in abiding the law regarding

the implementation of local ordinances relating to rules and regulations

performed by the city. Encourage the motorcycle riders to abide by motoring laws

on registration, inspection, as well as rules on road safety.

Though this could be an opportunity for LGU-Iligan to increase security

and ensuring public safety, the riders might be prone to major accidents because

of the lack of basic safety having a half face helmet. Injuries are predictable and

preventable, because wearing a full face helmet reduces the risk and severity of

head injury.

The only factor that can encourage the cooperation for these concern are

the violations committed and being accountable on their previous acts to the

national and local government. This option needs a lot of careful planning and

evaluation of actions taken, for it involve a lot of risk. If not carefully

implemented, riding in tandem criminal cases might increase. Again, this option

can be effective only once the ordinance can be adopted.

Alternative 4:

The implementation of the local ordinances relating to motorcycle riders

motoring laws on registration will highly help the City in terms of ensuring the

public safety of Iligan City regarding to motorcycle riding in tandem. On the

positive side, the old registration will serve as a reminder and at the same time

a lesson that safety and security should not be taken for granted but should

always be maintained to preserve peace and order result in the present to future.

Possibly in the years ahead, the new way of registering will be established

and can be sustained if backed up by an effective ordinance coupled with proper

and implementation. Also, the unique plans of ensuring public safety can be

used as part of the history by sharing its past experience.

Stakeholders’ Decision

Based on the result of the stakeholders’ decision (Matrix 4), it is very

clear that on the LGU’s point of view, the most important factor is the

acceptance and support by the majority of the entire populace on the

sustainable operation program of the Local Government Unit.

On the other hand, the selected Barangay Officials and some

constituents are giving much importance on the implementation and it will

be easy once it implemented. But overall, the political dimension got the

highest in ranking and economic dimensions ranked next closely. It shows,

that in the implementation stage, much weight should be given to the

enactment of the law that once it implemented the service would be

reasonable especially that it is their priority during the ranking stage.

Since the Local Government Unit- Iligan’s program have been highly

accepted and supported by the stakeholders representing the public, it has

the obligation to provide better services to the existing laws and

regulations on ensuring public safety in Iligan City. As implementer, the

implementation of the law is necessary for future improvements to

maintain the peace and order in our city.

While public is giving importance in this matter, this would be serve

as a challenge to LGU-Iligan on the issue of the public safety of residents

in Iligan City regarding motorcycle riding in tandem incident. But looking

on the positive side, as long as the provisions of the proposed program will

be explained properly, the constituents will understand. If this conditions

could not be explained properly to the constituents, the outcome in the

latter part would be chaotic.

On the other side, based on the rules and regulations in ensuring

the public safety of Iligan City regarding Motorcycle Riding in Tandem,

implementers should do their full effort to make these things visible to the

eyes of the residents. It is very clear that those persons who has the

authority must and should assigned to the exact place where they must

be assigned.

Technically, LGU- Iligan’s workforce possess enough expertise and

equipment to make this program into a reality. Both the selected the

Punong Barangays and constituents are confident that LGU- Iligan can

provide improved public safety. These criteria ranked 3rd in raking.

Option 1

On the Policy Alternative Decision, based on the qualitative survey conducted,

Option 1, which is Status Quo, was considered ‘Less Feasible’ possibly because of the

very limited safety assurance available. At present, it is very disorganized. Even if an

Ordinance be crafted to exclusively support this Option, the safety of thie city will not

sustain.

In the case of Option 1 (Status Quo), it is less feasible.

Option 2

Having garnered the highest rank in stakeholder’s Policy Alternative

Option, it is evident that in the policy alternative discussion using the SWOT

analysis, Strengths and Opportunities outweigh the Threats and Weaknesses. It

is the answer for sustainable safety because creating a new comprehensive

Ordinance and proper assignment to responsible LGU personnel to undertake

the tasks, would correct the mistakes made previously. This option is very

feasible.

Option 3

Once Option 2 will be in place, this option should also be implemented.

Aside from asking full cooperation of the motorcycle riders and the stakeholder’s,

rules and regulations will be incorporated in the proposed new code/ordinance

to regulate and correct the illegal acts made before. In the implementation of the

new Ordinance, charges and penalties for any violations of the said ordinance

will be included.

Option 4

And the last option, is to strictly not allowed motorcycle riders to ride if

they don’t obey the rules and regulations regarding the proper face mask and

also having the stickers. In other way this might be turned into an advantage in

the future.
Chapter 5
Summary, Conclusions and Policy Recommendations

Summary

The main problem being addressed by this study is ensuring the public

safety in Iligan City relating to Motorcycle Riding in Tandem Crimes. On the

four (4) policy options discussed, the most feasible and acceptable is the

crafting of a new ordinance with necessary legal provisions for long lasting

implementation.

Conclusion
Sustainable plan is dependent on how well it is carefully prepared taking

into consideration the preference of the stakeholders as to most feasible,

efficient and acceptable alternative. In this study, policy alternative 2 which is

the crafting of a new ordinance with the necessary legal provisions. The

crafting and enactment of the said ordinance would significantly reduce the

crimes that existing in the city.

Recommendations

Below is the recommended Plan of Action to be implemented to achieve

goal of a sustainable plan.
