APPEAL
[PETITION TO LIFT THE ORDER OF BLACKLIST
OF GÜNTER WENNY]

COMES now Petitioner Günter Wenny, 68 years old, a German


national, and a resident of Germany, with Passport Number: C5P98PCLJ
issued by Gemeinde Reichelsheim (Odenwald) on 02.of September 2013
and expiring on 01. of September 2023, by and through the undersigned
counsel, unto this Honorable Office, most respectfully manifests and
avers that:

This has reference to the Blacklist Order Number JHM-17205


issued against GÜNTER WENNY, the petitioner, that resulted to the
denial of his entry to the Philippines, more specifically, at the Mactan
International Airport in Lapu-Lapu City, Cebu, on September 15, 2017.

The petitioner understands that under Memorandum Order No.


ADD-01-005 dated March 29, 2001, he may file his Appeal by way of a
petition requesting for the lifting of the blacklist order before the
Commissioner of Immigration. The petitioner is also aware of
Immigration Administrative Circular No. SB-2014-001 that prescribes the
periods for lifting of entries from the Bureau of Immigration Blacklist,
however, this petition is filed with a prayer to invoke the power of the
Commissioner to waive the period prescribed therein for humanitarian
and economic reasons.

The petitioner has been in the Philippines for several times


already. In fact, his last visit was from September 2016 to Juni 2017.
During his stay in the place that he considers as a “beautiful country”,

the Philippines, the Petitioner has maintained good moral standing and
reputation in all his dealings as a tourist. The petitioner recalls that it
was only after that incident on May 18, 2017 at the Mactan International
Airport upon his departure from Cebu to Germany that his entry was
denied. Such incident may have caused the issuance of the Blacklist
Order against him.

It is unfortunate that petitioner may have been misunderstood by


the immigration officer, especially when he was talking in german
language which may sound offensive especially to those who may not be
so familiar with it, when he explained the urgency of his travel and why
he was not able to obtain the necessary documents.

The petitioner most sincerely and unfeignedly desires to express


his deep contrition on the matter as he could have exercise more tact
and could have make himself more aware of the laws of the Philippines.
But foremost, let it be clear that petitioner has no intention or
whatsoever to disrespect any immigration officer, law enforcers, or the
authorities of the Philippines in general.

The truth of the matter was that petitioner has to leave Cebu for a
medical treatment for the unbearable pain he has been suffering for
days on his spine. At the age of 64, he was diagnosed with cervical spinal
Artrosis. This has tremendously and adversely affected his temper and
mood. His doctors advice him for surgery and scheduled his operation
on on May 22, 2017. Evidently, time is of essence as he still has to
undergo some medical examination prior to the scheduled surgery.

Upon presentation of his travel documents before the


immigration officer, he was informed that he needs an E-CC document
before he can leave the country because he have stayed in the
Philippines for more than six (6) months. It was at this point that the

misunderstanding arose. Petitioner was begging the immigration officer
to allow him to leave. In a loud voice, in german language, he said that,
he has to go; he must go because he has an Operation-Date in a German
Hospital. Of course, the immigration officer cannot let him leave because
of the lacking document. It is at this point that petitioner had a nervous
breakdown considering the consequences of missing the operation
schedule in the hospital.

Nevertheless, this incident has also led to the timely arrival of the
petitioner in Germany where he was given immediate and timely
treatment. The operation on the cervical spine has gone very well and
Mr. Wenny was able to recuperate in time. It has been after four (4)
months without pains.

The petitioner is the fiancé of Mrs. Elma Ludovice. They have been
in a relationship for two (2) years already and has been financing the
study her three (3) daughters. One of the daughters will be graduating
this March 2018, petitioner and the family of Mrs. Ludovice especially
the graduating daughter prays, that he will be allowed to attend her
graduation.

Petitioner is a well-known writer and a worldwide known Diving


Instructor. Put internet articles/books about his Name Günter Wenny
(by Google). Never in the life of the petitioner where come in conflict
with the Law.

PRAYER

WHEREFORE, premises considered, it is respectfully prayed of


this Honorable Commission that Blacklist Order against Günter Wenny
BE LIFTED, and BE ALLOWED TO ENTER in the Philippines.

prayed for.
