FY 2020 BUDGET PROPOSAL FOR PARCELIZATION OF NINETY

THOUSAND (90,000) HECTARES OF COLLECTIVE CERTIFICATE OF


LAND OWNERSHIP AWARDs (CCLOAs)
UNDER POST LAND DISTRIBUTION (TIER 2)

LEGAL BASES

Pursuant to Section 25 of Republic Act (R.A.) No. 6657, as amended by Section


10 of R.A. No. 9700, the Department of Agrarian Reform (DAR) is mandated
to immediately undertake the parcelization of CCLOAs over lands that are not
collectively farmed or operated in an integrated manner.

MEMORANDUM OF THE CABINET SECRETARY TO THE DAR


SECRETARY DATED APRIL 1, 2019

“During the 36th Cabinet Meeting held on 01 April 2019 at the


Malacanan Palace, the President reiterated the need to fast track the
issuance of individual CLOAs to enable the Agrarian Reform
Beneficiaries to use these titles as collateral for loans. xxx

In the course of the discussion, the President instructed the DAR


to convene as task force and come up with a program within May
2019 to ensure the distribution of individual CLOAs from the
Collective CLOAs and backlog agricultural lands within 2019. The
President also acknowledged that the conduct of survey would
require funds. As such he committed to provide budget for the hiring
of surveyors to ensure the expeditious completion of the survey.
Relatedly, he instructed the Finance Secretary to raise funds to
support the DAR’s program.

CHALLENGES ON THE ISSUED COLLECTIVE CLOAs AND THE
NECESITY FOR ITS SUBDIVISION AND PARCELIZATION

A total of 2.251M collective CLOAs of agricultural lands have been issued


by the Department and based on a study, about 76 percent of these
landholdings were awarded to ARBs who were not actually engaged in
collective farming. This has affected farmer’s individual property rights and
has discouraged farmers from making long term improvements on the land
(Casidsid-Abelinde, 2017).

As of December 2018, DAR has a working balance of 1.669MM due for


validation and 783Mm for subdivision.

Moreover, based on the Land Bank of the Philippines data, one of the
major reasons for the low collection rate of land amortization is that many
titles distributed to ARBs were collective CLOAs, thus individual amortizations
could not be computed.

CREATION OF A PARCELIZATION TEAM AND ITS FUNCTIONS

Based on the recent discourse with the Regional and Provincial Officials,
a total of Ninety Thousand (90,000) hectares for the purpose of parcelization
is attainable for FY 2019. For this purpose, in order to properly coordinate
and ensure the performance of the parcelization process for 2019 and to
strictly monitor it, a Parcelization Team is proposed to be composed of the
following DAR officials and personnel:

ACCOUNTABILITY STRUCTURE

The Parcelization Team shall provide a timeline and guidelines for each
DAR Regional Offices and shall periodically monitor their performance in order
to ensure the accomplishment of the parcelization of the ninety thousand
(90,000) hectares CCLOAs at the end of 2019.

On the other hand, the Regional Director shall periodically monitor the
performance of the Provincial Agrarian Reform Program Officers (PARPOs) and
ensu : re the accomplishment based on the given timelines provide for by the
parcelization process.

While, it shall be the duty of the PARPOs to regularly monitor and


coordinate with their Municipal Agrarian Reform Program Officers (MARPOs)
with regard to the parcelization of the CCLOAs in their respective jurisdictions,
as the case may be.

BUDGETARY REQUIREMENT

For the parcelization of 90,000.00 hectares of Collective CLOAs

Maintenance and Other Operating Expense : Php. 474.930 MM
