25 Plaintiff Chengdu Furinkazan Automobile Service Co. Ltd. (“Furinkazan”), by and through its
26 undersigned counsel, as and for its Complaint against Defendant Moti 5, Inc. (“Moti 5”), states and

27 alleges as follows:

NATURE OF LAWSUIT

1. This is a complaint for violation of various State and Federal intellectual property laws arising
2
from Defendant’s sale of products that constitute infringement of Plaintiff’s design patent.
3
4 JURISDICTION AND VENUE
5 2. This is a civil action for infringement of a patent, arising under the laws of the United States
6 relating to patents, including, without limitation, 35 U.S.C. § 101, et seq., 35 U.S.C. § 271 and § 281.
7 Plaintiff seeks preliminary and permanent injunctions and monetary damages for patent infringement.

8 3. This Court has subject matter jurisdiction over this case for patent infringement under 28
U.S.C. §§ 1331 and 1338(a) and pursuant to the patent laws of the United States of America, 35U.S.C.
9
§ 101, et seq.

4. Venue properly lies within the Central District of California pursuant to 28 U.S.C. sections
11
1391(b) and (c); 28 U.S.C. section 1400(a); and 18 U.S.C. section 1965. On information and belief,
12 Defendant conducts substantial business directly and through third parties or agents in this judicial
13 district by selling and offering to sell the infringing products and by conducting other business in this
14 judicial district. Furthermore, Plaintiffs have been harmed by Defendant’s conduct, business
15 transactions and sales in this district.
16 5. This Court has personal jurisdiction over Defendant because, on information and belief,

17 Defendant transacts continuous and systematic business within the State of California and the Central
District of California. In addition, this Court has personal jurisdiction over the Defendant because, on
18
information and belief, this lawsuit arises out of Defendant’s infringing activities, including, without
19
limitation, the making, using, selling and/or offering to sell infringing products in the State of
20
California and the Central District of California. Finally, this Court has personal jurisdiction over
21 Defendant because, on information and belief, Defendant has made, used, sold and/or offered for sale
22 its infringing products and placed such infringing products in the stream of interstate commerce with
23 the expectation that such infringing products would be made, used, sold and/or offered for sale within
24 the State of California and the Central District of California.

25 6. Upon information and belief, certain of the products manufactured by or for Defendant have
been and/or are currently sold and/or offered for sale to consumers including, but not limited to,
26
consumers located within the State of California at, among other places, Amazon.Com’s website
27
located at http://www.amazon.com.

THE PARTIES

7. Plaintiff Chengdu Furinkazan Automobile Service Co. Ltd. is a Chinese company and engaged

in the development, sale, and licensing of after-market automobile parts, among other things.

8. Defendant Moti 5, Inc. is a corporation formed under the laws of the State of New York with a
4 principal place of business located at 11715 Clark St. Arcadia, CA 91006. Upon Information and
5 belief, Defendant is engaged in the sale of automobile parts through Amazon.com, Inc. through its
6 platform on Amazon.com as well as through Defendant’s own website at https://amoffroad.com/.

8 THE ASSERTED PATENTS
9. On October 17, 2017, the United States Patent and Trademark Office, duly and legally issued
9
United States Design Patent No. D800,226 entitled “Automobile Face” (“the ‘226 Patent”).

10. The patent’s name inventor is Cheng Zeng, and Plaintiff Chengdu Furinkazan Automobile
11
Service Co. Ltd. is the assignee and owner of the entire right, title, and interest in and to the ‘226
12 Patent and vested with the right to bring this suit for damages and other relief. A true and correct copy
13 of the ‘226 Patent is attached hereto as Exhibit “A”.

15 FIRST CAUSE OF ACTION
16 (Infringement of D800,226 Patent By Defendant)

17 11. Plaintiff re-alleges and incorporates by reference each of the allegations set forth above.
12. Design Patent No. D800,226 has one single claim directed to the ornamental design for an
18
automobile face as shown below:

13. Defendant has knowledge of infringement of the ‘226 Patent since at least January 17, 2019

when Plaintiff filed an infringement report through Amazon.com informing Defendant of its
2
infringement of Plaintiff’s ‘226 Patent.

14. Defendant Moti 5 copied the design of its’ AM American Modified branded 2007-2018 Jeep
4 Wrangler compatible automobile face from the design of the ‘226 Patent. A side-by-side comparison
5 of the ‘226 Patent design and an exemplary specimen of Defendant’s AM American Modified
6 automobile face are shown below, the photograph of the exemplary Defendant’s automobile face being
7 taken from its Amazon product listing:

21 15. As shown in the pictures, Defendant’s compatible automobile face design of the 2007-2018
22 Jeep Wrangler is substantially the same as the design of the ‘226 Patent. The automobile designs are so
23 similar as to be substantially similar such that an ordinary observer, giving such attention as a

24 purchaser usually gives, would be so deceived by the substantial similarity between the designs so as
to be induced to purchase Defendant’s products believing them to be substantially similar as the
25
automobile face design protected by the ‘226 Patent.

16. Plaintiff has not granted a license or any other authorization to Defendant to make, use, offer
27
for sale, sell, or import automobile face that embody the automobile face design patent in the ‘226
28 Patent and which is proprietary to Plaintiff.

17. Plaintiff alleges upon information and belief that, without authority, Defendant has infringed

and continues to infringe the ‘226 Patent by, inter alia, making, using offering to sell, or selling in the
2
United States, including in the State of California and within this District, products infringing the
3
ornamental design covered by the ‘226 Patent in violation of 35 U.S.C. § 271, including but not limited
4 to Defendant’s AM American Modified branded 2007-2018 Jeep Wrangler automobile face.
5 18. Defendant’s compatible automobile face design infringes the ‘226 Patent because, inter alia, in
6 the eye of an ordinary observer, giving such attention as a purchaser usually gives, the automobile face
7 design and the automobile face design of Defendant’s products, including without limitation the

8 compatible automobile face designs of the 2007-2018 Jeep Wrangler are substantially similar, with the
resemblance being such as to deceive an ordinary observer, inducing him or her to purchase one
9
supposing it to be the other.

19. Defendant’s acts of infringement of the ‘226 Patent were undertaken without authority,
11
permission, or license from Plaintiff. Defendant’s infringing activities described herein violate 35
12 U.S.C. § 271.
13 20. Plaintiff is informed and believes that Defendant intentionally sells, ships, or otherwise delivers
14 the infringing products in the United States, with knowledge that are designed to and do practice the
15 infringing features of the ‘226 Patent.
16 21. Plaintiff is without an adequate remedy at law and has thus been irreparably harmed by the acts

17 of infringement. Plaintiff asserts upon information and belief that the infringement of the asserted
claims of the ‘226 Patent is continuous and ongoing unless and until Defendant is enjoined from
18
further infringement by the Court.

SECOND CAUSE OF ACTION
21 (Willful Infringement of the Asserted Patent)
22 22. Plaintiff re-alleges and incorporates by reference each of the allegations set forth above.
23 23. Defendant’s infringement of the ‘226 Patent have been willful.
24 24. Defendant has had actual knowledge of the ‘226 Patent since at least January 17, 2019.

25 25. Plaintiff’s infringement notice to Defendant and Defendant’s continued marketing and sales
evidence not only Defendant’s pre-suit knowledge of the ‘226 Patent, but that Defendant’s
26
infringement of that patent has been, and continues to be willful and deliberate, warranting treble
27
damages.

PRAYER FOR RELIEF

WHEREFORE, Plaintiff prays for relief and judgment as follows:

1. The determination that Defendant has infringed the ‘226 Patent;
4 2. That Defendant, Defendant’s officers, agents, servants, employees,
employees, and attorneys, and those
5 persons in active concert or participation with them, be preliminarily and permanently enjoined
6 from infringement of the Patent-in-Suit,
Patent Suit, including but not limited to any making, using,
7 offering for sale, selling, or importing
importing of unlicensed infringing products within and without the

8 United States;
3. Compensation for all damages caused by Defendant’s infringement of the Patents

determined at trial;

4. A finding that this case is exceptional and an award for reasonable attorney’s fees pursuant to

35 U.S.C. § 285;
