(Hereinafter collectively referred to as “The Mortgagor/Borrower” which expression shall


include their heirs, executors, administrators, successors and assignees jointly and

IN FAVOUR OF
SYNDICATE BANK, a Body Corporate constituted under the Banking companies
(Acquisition and Transfer of Undertaking) Act 1970, with its Head Office at Manipal in Udipi
District of Karnataka and its Branch Office inter-alia at Shivajinagar, F. C. Road, Pune-
411005 and hereinafter called THE MORTGAGEE AND represented herein by Branch
Manager Mrs. Sunanda Kishore Gawli (which expression shall include their successor and
assignees)

1. In pursuance of the above representations and agreements and in Consideration of
the Mortgagee having granted or agreed to grant Loan / Credit facilities from time to
time up to Rs. 95,20,000/- (Rupees Ninety five Lakhs twenty thousand only)
to the Mortgagor/Borrower on such terms and conditions as may be stipulated by the
Mortgagee from time to time, the Mortgagor/Borrower as beneficial owner hereby
transfers to the Mortgagee by way of Mortgage, all those immovable properties
detailed in the schedule here below with all buildings , structures , attachments ,
assignments, additions and improvements thereon (hereinafter called ‘the said
premises’), as Primary security for repayment of the amounts so advanced and
agrees to pay –
a] Interest at the agreed rate of 8.75%
and repayable in 354 EMIS as mentioned in the Sanction Letter.

Provided further, without prejudice to the BANK’s other rights and remedies, the
BANK shall be entitled to charge, overdue/penalty at rate of 2 % per annum on the
overdue EMIs or such other reasonable enhanced rate in default or irregularity in
observing the terms and conditions of this agreement by the Mortgagor/Borrower
which in the opinion of the BANK warrants revision of such interest or charging penal
interest for such period as the BANK may deem fit.

b] In the event of any revision in the rate of interest, the borrower shall be deemed
to have received the notice of revision of rate of interest in the MCLR (Marginal Cost
Of Funds Based Lending Rate) is displayed or notified by the Bank at the branch
premises where the advance/s are availed by the Borrower/s or published in the
news paper/s or made known through entry of interest charged in the statement of
account of the Borrower or displayed in the website of the Bank.

c] Provided that, without prejudice to the Bank’s other rights and remedies, the Bank
shall be entitled to charge, penal/enhanced rate of interest at the rate over and
above the agreed rate of interest as per the terms of the sanction of loan or as
notified by the Bank chargeable to such defaulted loan as penal interest for such
period as the bank may deem fit.
THE MORTGAGED PROPERTY SCHEDULE

All that piece and parcel of Property bearing Flat No. 102A (as per Revised Sanction Plan)
on the First Floor admeasuring built up area 52.86 Sq. Mtrs. along with Car Parking area
admeasuring 12.83 Sq. Mtrs. AND Flat No 102A (as per Revised Sanction Plan) on the
Second Floor admeasuring built up area 45.12 Sq. Mtrs. along with enclosed Balcony
admeasuring 6.75 Sq. Mtrs. and along with Car Parking area admeasuring 156.72 Sq. Ft.
and Garden area 153.39 Sq. Ft. and Terrace on the Roof Top admeasuring 181.70 Sq. Ft.
(and along with undivided rights and interest in the Plot and common facilities), in the
“Building”, Constructed on the land bearing Plot No. 18 B admeasuring 180.78 Sq. Mtrs.
out of total Plot admeasuring 361.56 Sq. Mtrs. and constructed area admeasuring 110 Sq.
Mtrs. from out of S. No. 47, H. Nos. 3 to 13, 15 & 16 corresponding C. T. S. No. 3747,
totally admeasuring 3664.93 Sq. Mtrs. of “State Bank of India Employees Akshar Co-
operative Housing Society Ltd.”, Situated at Village Parvati, Taluka Haveli, District
Pune, within the jurisdiction of Sub-Registrar, Haveli, Pune and within the limits of Pune
Municipal Corporation and bounded as under:
