Contingency Plans
If something were to go wrong, I will have a backup plan to sort the issue out.

If a model was not able to make the photoshoot, I will have a backup model on hand, or
change the date of the photoshoot, if possible.
If the camera didn’t work, I will have checked it beforehand but will also have a spare
camera of needed.

Relevant legal and ethical issues


.Legal:

Legal constraints include: copyright 1988, equality act 2010, intellectual property, obscene
publications, trespass, privacy & defamation.

Copyright 1988:

Copyright states that whoever creates a product of any description (book, film, music etc)
owns it. The copyright law is not a criminal law, it is a civil law, meaning that it is up to
whoever owns the copyright to sue the person breaking the copyright law. Unless the person
who owns the copyright wants it, a person will not be sent to prison

Duration: copyright does not last forever. If the product is literary, drama, musical,
artistic or a film the copyright protects the work for 70 years. After that 70 years is up,
the product is then free to be used by anyone as it then not protected by the
copyright law. Sound recordings, broadcasts & cable and typographical copyrights
lasts for 50 years. After that 50 years is up, the product is then free to be used by
anyone as it then not protected by the copyright law.

How it applies:
To make sure that I don’t break this law, I will make sure that all of my photographs
are my own original ideas and taken by me so nothing is copied from anyone else.

Equality Act 2010


The law states that it against the law to discriminate against anybody because of
these factors:
 Age
 Being or becoming a transsexual person
 Being married or in a civil partnership
 Being pregnant
 Having a disability
 Race
 Religion
 Nationality
 Ethnicity
 Sex
 Sexual orientation

This is a criminal law therefore is a person breaks this law, they will be sent to jail.

How it applies: To make sure that I do not break this law, my photographs will not be
discriminatory and none of the text surrounding the image will have discriminative language.
I will make sure not cause any bad stereotypes towards any person because of the image or
text.
Intellectual property:

This law stops people stealing names of products, brands, inventions, looks of products,
written work, made work and trademarks/logos.For copyright and design rights, this is
automatic for a piece of work, however to get a trademark, a registered design or patents
(inventions) a person will have to apply for the protection.

How it applies:
To avoid breaking this law, I will make sure all work used is 100% mine and none of it has
been copied or stolen or someone else. Making sure all work is all mine I will therefore not
be breaking the law.

Obscene Publications act 1959:

This law forbids a printing company to print anything that could be seen as “obscene”.
Obscene work is seen as “the portrayal or description of sexual matters, offensive or
disgusting by accepted standards of morality and decency.”

This is a criminal law, if a person/company is in breach of this law, they will be sent to prison
to serve the time agreed by the courts.

How it applies:
I will make sure that in my photos, nothing shown is obscene, for example, no extreme
violence, nudity or sexual images.

Trespass:

“Trespass to land in most instances is a civil wrong, and as such the police have no
jurisdiction.”

This can be resolved in courts. If a person was to trespass on a homeowner/landowner’s


land, they would be allowed to use reasonable force to get them off but they are not allowed
to set traps or push them off a ladder etc.

How it applies:
To avoid breaking this law, I will not take my photos on private property, however if I do, we
will ask for permission and have that documented.

Privacy:

The privacy law is a law that deals with the use of a person’s personal information and to
make sure that they aren’t intruded upon.

Article 8.1 of the ECHR provides an explicit right to respect for a private life:
It protects your right to respect for your private life, your family life, your home and your
correspondence (letters, telephone calls and emails, for example).

We have asked the actors to sign a “filming, photographic & sound recording release for”.
This entitles us as crew to use footage of them for our coursework and then they can’t not
allow us to use it later on because they have signed this agreement.

How it applies:
To avoid breaking this law, I if taking pictures on location, will not use any street names,
phone numbers, car licence plates or any other personal information in my photoshoot.

Defamation Act 2013:

The defamation act protects a person if they have had their reputation purposely damaged
by either slander (spoken) or libel (written).

Libel is a written, published false statement that is damaging to a person’s reputation.

Slander is making a spoken false statement that is damaging to a person’s reputation.

This is a civil law therefore anyone who believes that they have had their reputation
damaged would have to sue.

How it applies:
I will not have the use of libel or slanderous comments in my photos or in the text
surrounding the image.

Ethical issues:

These are not laws. These are based on judgement and if the public believe that it is morally
acceptable.

 Protecting the under 18’s


 Representation of age, gender, race, religion, disability, sexuality and nationality - we
need to attempt to include all
 Not using off the record information
 Not using anything that could cause offence or harm
 Not presenting an individual/group of people in an immoral way
 Not making a product that will insult a listener/viewer/user
 Not using falsifying information

How it applies:
To make sure that I do not break this law, my photos will not discriminate against any person
on something they cannot change. I will not discriminate during the creation of the magazine
photoshoot and will not cause any bad stereotypes towards any person because of these
factors.
