(6) In connection with an investigation of a complaint filed under this subsection, the

Commission or its designated representatives at any reasonable time may request access
to the premises, records, and documents relevant to the complaint and the right to
examine, photograph, and copy evidence, but all such evidence not otherwise presented
at a public hearing shall be of a confidential nature. In conducting its investigation, the
Commission does not have the right to substantially interfere with the operation of the
business which is the subject of the investigation.
Sec. 10-50 Notices
Any posting generally required of employers under federal or state law to give notice of
nondiscriminatory practices shall include gender identity and sexual orientation as an additional
area of prohibited discrimination.

Sec. 10-51 General Exceptions

The City of Henderson is prohibited from substantially burdening a person's freedom of

religion by the provisions ofKRS 446.350. Accordingly, where a person, by action or
inaction, violates the provisions of Chapter 10 of the City's Code of Ordinances due to a
sincerely held religious belief, the individual or entity alleging the violation must prove
by clear and convincing evidence that the City has a compelling governmental interest in
infringing the specific act or refusal to act and has used the least restrictive means to
further that interest to establish the existence of the violation. A burden shall include
indirect burdens such as withholding benefits, assessing penalties, or an exclusion from
programs or access to facilities. The Section shall apply in any legal or administrative
proceeding brought to enforce the provision of Chapter 10, whether or not the City or
other governmental authority is a party to such proceeding.

IT IS FURTHER ORDAINED that this Ordinance (except for Section 10-50) shall take
effect and be in full force when passed, published and recorded according to law. Section 10-50
will take effect and be in full force on September 3, 2019. Any ordinance, resolutions, or
executive orders in conflict with any section of this ordinance are hereby repealed or rescinded.

This ordinance shall become effective upon its legal adoption.

All ordinances or parts of ordinances in conflict herewith are hereby repealed and
superseded to the extent of such conflict.

On first reading of the foregoing ordinance, it was moved by Commissioner
