of Hazardous Chemical R2013 – Duty of principal supplier to classify chemical

CLASS 2013 1. Classify chemical – according to list of classified
Apply to – chem supply for workplace only chemical
2. If chem classify as not listed – classify accdg
Not apply to physical, health & enviro hazard (Ind. Code prac)
3. DG found inconsistency – determine classification
- Radioactive materials (Atomic Energy Licensing Act
based on classified chem list
1984 [ACT 304])
4. Principal supplier shall follow DG order
- Schedule waste (Enviro schdle waste Quality R2005)
5. Fine not exceed RM10K / imprison not exceed 1yr /
- Cosmetics - Control of Drugs & Cosmetic R1984
- RnD chemical – not for sale in market, not exceed both – if principal supplier not follow duty (1,2,4)
6. Fine not < RM1k every day / part of day – if
5kg, lack info on safe use by supplier
- Manufacture item other than fluid/particle - form to continue not follow duty
specific shape/design, use in normal condition (not
release chem tht has physical hazard & risk)
- Pesticide – Pesticides Act 1974 [Act 149] Part III - PACKAGING
- Chemical tht need to export – store in storage area
Packaging requirement of hazardous chemical

Terms Meaning  Use Container packaging –ensure chem not escape

Hazardous Hazard chem under R4 unless safety device is fitted into container
chemical  Strong fastening – able to hold chem & meet

6. Precautionary 6. “Read Safety Data Contain another container
statement Sheet before use” - Label shall be affixed to 1/more surfaces of
container – so label can b read horizontally
 Follow industry code of practice & national & when container is in normal position

Requirement of hazard pictogram Part VII – CONFIDENTIAL BUSINESS

 Black symbol on white background – red border & INFORMATION
sufficient width (clear to see)
Info on hazardous chemical
 Diamond shape – side titled 45˚ to horizontal
 1/15 of surface area – not less than 100 mm 2  Supplier may omit info in Safety Data Sheet
Rules of precedence of hazard pictogram & statement o Name of hazardous chemical
o Composition & ingredients of chemical
on label
 Replace info w generic name of chemicals/
 Use for more than 1 hazard pictogram on a label allowable concentration range of ingredients – if
info is omitted
Physical Hazard
 DG/ Occu Health Dr./ person who use chem – may
 Eg – if there are “exploding bomb”, “flame” & “flame
request in writing from a principal supplier – for
over circle” = only use “exploding bomb” - Except –
disclosure information
case that has more than 1 hazards
 Use both hazard – if Self-reactive chem type B &  Upon request, Principal Supplier shall disclose
organic peroxides B –“exploding bomb” & “flame” information to DG, Occu Health Dr. / person use
 Information only use – for protection of safety &
health of employees
Health hazard  Person who use information other than main
 “Skull & crossbones” , “exclamation mark” = use only purpose – shall commit offence & fine RM10K &
“Skull & crossbones” imprisonment – not exceed 1 yr or both
 If skin irritation – “corrosion”, “exclamation mark” =
use only “corrosion”
 If respiratory & skin sensitization, corrosion, serious
eye damage, eye irritation /combination - “Health Part VIII - REVOCATION
hazard”. “exclamation mark” = use “health hazard”
The Occupational Safety & Health (Classification,
Packaging & Labelling of Hazardous Chemicals)
Regulation 1997 [P.U (A) 143/1997] are revoked
 Use more than 1 hazard statement on a label  REVOKE FROM CPL
 “very toxic to aquatic life w long term effect”, “very
toxic aquatic life” – use “very toxic to aquatic life w
long term effect”
 “causes severe skin burn & eye damage”, “cause serious
eye damage” – use “causes severe skin burn & eye
damage”
