DIVERSION CONTRACT PROPOSAL

COMES NOW, PRIVATE COMPLAINANT, through the

undersigned counsel, and unto this Honorable Court, most
respectfully submits, by way of this Diversion Contract Proposal, the
following proposals/propositions in the provisions of the Diversion
Contract to be entered into by the accused and the private
complainant, and avers that:

“FOR THE CICL:

1. Report to the City Social and Development Office (CSSDO) Talomo B

District, Davao City EVERY TUESDAYS of the month from 9:00 A.M. to
11:00 A.M., for the period of eighteen (18) months starting from October 2,
2018 until March 3, 2020 in order to attend case conference, other related
activities and to receive guidance;

2. Report to the Barangay Talomo Proper thru the Barangay Council for the
Protection of Children (BCPC) EVERY TUESDAYS of the month from
1:00 P.M. TO 3:00 P.M., for the period of eighteen (18) months to
render community service and to attend youth activities for self-
development;

3. Make and submit daily diary of activities, plans and whereabouts EVERY
TUESDAYS of the month to City Social and Development Office
(CSSDO) Talomo B District, Davao City;

9. MAKE A WRITTEN AND/OR ORAL APOLOGY TO THE

PRIVATE COMPLAINANT AND THE PRIVATE
COMPLAINANT’S PARENTS;

10. CEASE AND DESIST FROM FURTHER COMMUNICATING TO

THE PRIVATE COMPLAINANT THROUGH ANY SORT OF
COMMUNICATING DEVICES, SUCH AS BUT NOT LIMITED TO
PHONE CALLS, TEXT MESSAGES AND SOCIAL MEDIA,
AMONG OTHERS;

11. Shall do all things stipulated in this contract within eighteen (18) months.
But, if it turns out to be different from what has been agreed, the CICL
shall face the consequences pursuant to the law.

CITY SOCIAL SERVICES AND DEVELOPMENT OFFICE:

1. MONITOR THE CICL AND HIS PARENTS’ COMPLIANCE AND

RESPONSE TO THE DIVERSION CONTRACT BY WAY OF:

1.1. CONDUCTING AT LEAST ONCE A MONTH AND

MORE FREQUENTLY AS NEEDED home visitation for
a period of eighteen (18) months in order to follow-up the
status of the minor and family;

1.2. CONDUCTING AT LEAST ONCE A MONTH AND

MORE FREQUENTLY AS NEEDED SCHOOL
VISITATION FOR A PERIOD OF EIGHTEEN (18)
MONTHS, IF THE CICL IS ENROLLED, IN ORDER
TO FOLLOW-UP THE STATUS OF THE MINOR IN
HIS SCHOOL;

1.3. CONDUCTING INTERVIEWS TO THE NEIGHBORS,

TEACHERS, CLASSMATES AND SIGNIFICANT

 OTHERS ABOUT THE STATUS OF THE CICL’S
BEHAVIORAL PROGRESS;

3. Conduct/provide appropriate TRAININGS, SEMINARS AND

LECTURES, INCLUDING BUT NOT LIMITED TO ENHANCING
PARENT-CHILD RELATIONSHIP, SOCIO-CIVIC ACTIVITIES,
VALUES FORMATION, AND OTHER SKILLS THAT WILL AID
THE CICL TO PROPERLY DEAL WITH SITUATIONS THAT CAN
LEAD TO A REPETITION OF THE OFFENSE COMMITTED;
