AFFIDAVIT OF COMPLAINT

I, CLINTON FLORES, 25 years old, single, Filipino and a resident of 1207 Lapu-
Lapu St., Gonzaga Subd, Brgy Villamonte, Bacolod City accuses CLYTHY DELOS
SANTOS y T, legal age, single and a resident of Brgy Canusa, Pulupandan, Negros
Occidental committed as follows, to wit:

1. That sometime in June, Clythy convinced me, induced me and misrepresented

herself that she will help me to work as a seaman, because according to her, her
“boss” is the right hand of certain Mr. Yun which is the owner of a ship.
2. Convinced and blinded by her promises, she asked for a first payment on June
5, 2018, on the same day at about 2:00 in the afternoon, I sent her the amount
of Php 9,000.00 as first payment for the alleged processing fee. The same was
sent thru Palawan Pera Padla Villamonte branch. Screenshots of the
conversation with the Palawan Code is hereto attached as Annex “A”;
3. And as days gone by she did everything to deceive me and make promises that I
can work as a seaman in a shorter time. Copies of our conversation from the
start are hereto attached as Annexes A-1- A-55.
4. That on July 16, 2018, I again sent her an amount of Php 20,000.00 which was
sent thru Cebuana Lhuiller Villamonte Branch. Copy of the screenshot
conversation is hereto attached as Annex “B”;
5. That several transactions happened which a total amount of Php 42,000.00 has
been sent to the accused. Not to mention my expenses when I went to Manila
because she made me believed that I have to go there to personally processed
my visa.
6. But none of that happened, even the alleged company was nothing but are
concocted lies. Until such time that I already sense that she is just making excuses
everytime I asked her about my papers. I have stayed in Manila from August until
April 2019 wasted my time and done nothing. Not knowing what to do, I took
the initiative to searched the name of her “boss” and confirm to him that it was
all lies. Screenshots copy of the conversation with Mr. Demy are hereto attached
as Annexes “C-1, C-2, C-3”
7. I even searched and went to the place where she allegedly working and
confronted her “boss” but she was not working there anymore because she also
done a lot of bad things in her workplace. Right there and then I found out that
all of these were fictitious and she just made it all up inorder to defraud me and
deceived me. And upon searching her left things, all of my documents were there.
8. When I demanded the return of my payment she will tell me to go to a place for
us to meet up because she will be paying me and she will return the money, but
all of it fall into deaf ears;
9. As per records so many times that I demanded the return of payment I made to
her, but she is always making excuses. I went back here in Bacolod with a heavy
heart because I relied so much to her words, that the money I send to her was
paid by my family and now they are all disappointed. I even went to Pulupandan
and begged for her to pay me but again she is just keep on telling me lies.

 10. That inorder to take actions and inorder for the herein accused be held liable for
the crime of estafa the same was recorded in a police blotter report and a
certification to file action was issued by Brgy. Villamonte hence the instant
complaint. Excerpt from Police Blotter Report and Certificate to file action are
hereto attached as Annex “E” and “D”.
That I execute this complaint affidavit to attest the truthfulness of the foregoing
facts based on my personal knowledge and to support the filing of Criminal Case against
CLYTHY DELOS SANTOS for violations of Article 315 par. 2(a) or ESTAFA by
means of deceit of the Revised Penal Code.
