WAIVER OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS;

We, ARTEMIO S. RECTAZO, of legal age, Filipino, married and a resident of


Galas, Dipolog City and SUSAN RECTAZO-CATALUÑA, of legal age, Filipino,
widow, and a resident of Galas, Dipolog City, Philippines, subscribing on oath,
depose and state:
I. That we are one of the heirs of the late CONSORCIO RECTAZO who died
on October 17, 1987 in Galas, Dipolog City, left two (2) parcel of land
covered under FREE PATENT V37816, situated at Malugas, Katipunan,
Zamboanga del Norte, containing an area of SIXTEEN THOUSAND TWO
HUNDRED TWELVE (16,212) SQUARE METERS and covered by Original
Certificate of Title No. P-3870 and Lot 1567 situated in Barrio
Daanglungsod, Katipunan, Zamboanga del Norte containing an area of
THREE THOUSAND EIGHT HUNDRED FORTY NINE (3,849) SQUARE
METERS, covered by Transfer Certificate of Title No. T-41616 of the
Registry of Deeds for the Province of Zamboanga del Norte and more
particularly described as follows:

PARCEL I
ORIGINAL CERTIFICATE OF TITLE NO. P-3870
A PARCEL OF LAND Lot 1584,PLS-40.Bounded on the SW:
along line 1-2 by Lot 1569 of Katipunan, PLS-40, along
line 2-3 by Lot 1568 of Katipunan, PLS-40, along line
3-4 by Lot 1567 of Katipunan PLS-40, along line 4-5 by
Lot 1566 of Katipunan, PLS-40, along line _____ by Lot
1565 of Katipunan, PLS-40, along line 6-7 by Lot 1583
of Katipunan, PLS-40, along line 7-8 by road, along
line 8-10 by Lot 1585 of Katipunan, PLS-40, and along
line 10-1 by Lot 1570 of Katipunan, PLS-40.

PARCEL II
TRANSFER CERTIFICATE OF TITLE NO. T-41616
A PARCEL OF LAND Lot 1567. Bounded on the SE.,
along line 1-2 by Lot 1568, Pls-40; along line 2-3 by
Lot 1580. Pls-40; along line 3-4 by Lot 1566, Pls-40;
and along line 4-1 by Lot 1584, Pls-40.

II. That the above described parcel of land were acquired by Virtue of
Deed of Extra Judicial Settlement of Estate with Waiver of Rights
and Partition Agreement is executed by and between the heirs of
Consorcio Rectazo, before the faith of Notary Public Raul C.
Barbaso on July 5, 2018, under Doc. No. 154, Page No. 51 Book No.
XV, Series of 2018,Dipolog City, Philippines.

III. That as lawful heirs of said decedents, we succeeded into the ownership
over the properties as such We ARTEMIO S. RECTAZO and SUSAN
RECTAZO-CATALUÑA, hereby WAIVE, RENOUNCE, AND RELINQUISH all
our rights, shares and interest over the above-described parcel of land and
for all legal intents and purposes over share on Parcel III is deemed
cancelled for the reason that the title is name over the registered owner
Felix Armedilla was still subsisting and not transferred to Alfonso Rectazo
who was the vendee thereof, due to some circumstances beyond control
both by the vendor and vendee;

IV. We hereby affirm that we have voluntarily executed this instrument out of
our own free will, without force, intimidation or violence from any person
present at the time of execution of this presents, nor anything which
somehow may vitiate our individual consent;

V. We have no more claim or demand the said property;

VI. We are executing this affidavit with full knowledge of the consequences
thereof, and for any legal purpose this affidavit may serve.

Principals further sayeth naught.
