The California Corporations Commissioner finds that:
19
1. At all relevant times, Apostles, Inc. ("Apostles"), a Nevada corporation authorized to
20
do business in California, conducted business at 1805 N. Carson Street, Suite S, Carson City, Nevada
21
and/or 1339 E. Carson St., Suite 412, Carson, California. Apostles is purportedly a multi-level
22
marketing company that holds the marketing rights in Africa for two products that are claimed to
23
provide health benefits, including a possible cure for AIDS.

2. At all relevant times, Xionyx, LLC (“Xionyx”) conducted business at 460 Carson
25
Plaza Drive, Suite 205, Carson, California. Xionyx purportedly owns the marketing rights in Africa
26
for two products that are claimed to provide health benefits, including a possible cure for AIDS.

 1 3. At all relevant times, I Really Wish I Had That Inc. (“I Really Wish”), a California
2 corporation, conducted business at 1339 E. Carson Street, Suite 412, Carson, California and/or 460 E.
3 Carson Plaza Drive, Suite 219, Carson, California. I Really Wish is purportedly the sole distributor
4 for Xionyx.
5 4. James Rivera (“Rivera”) is an individual who at all relevant times was the president of
6 Apostles, chief operating officer of Xionyx, and chief executive officer of I Really Wish.
7 5. Beginning in or about May 2007, Rivera sold investment contracts and/or promissory
8 notes to investors in the form of “Agreement[s]” and/or “Promissory Note[s]” by means of face-to-
9 face meetings on behalf of Apostles, Xionyx, and I Really Wish.

10 6. The investors purchased securities from Rivera totaling at least $187,600.00.

11 7. These securities were sold in this state in issuer transactions. The Department of
12 Corporations has not issued a permit or other form of qualification authorizing any person to offer or
13 sell these investments in this state.
14 Based upon the foregoing findings, the California Corporations Commissioner is of the
15 opinion that the Apostles, Xionyx, and I Really Wish investment contracts and/or promissory notes
16 are subject to qualification under the California Corporate Securities Law of 1968 and are being sold
17 or have been sold without first being qualified. Pursuant to Section 25532 of the Corporate Securities
18 Law of 1968, Apostles, Inc., Xionyx, LLC, I Really Wish I Had That Inc., and James Rivera are
19 hereby ordered to desist and refrain from the further offer or sale of securities in the State of
20 California, including but not limited to investment contracts and/or promissory notes, unless and until
21 qualification has been made under said law or unless exempt.
