Certiorari on the court’s EXPANDED JURISDICTION

- Allows the direct filing of petitions for certiorari and prohibition with the court to
question, for grave abuse of discretion, actions or the exercise of a function that violate
the constitution
- Simply requires a prima facie showing of grave abuse of discretion in exercising a
governmental act
TRADITIONAL CERTIORARI
- Questions the constitutionality of the governmental act involved (i.e. question of
constitutionality of a law or rule)
o Rule 45 applies, questions of legality

JUDICIAL AND QUASI-JUDICIAL FUNCTION DISTINGUISHED

JUDICIAL FUNCTION:
1. Involves the determination of what the law is; and
2. What the legal rights of parties are under this law with respect to the matter in controversy

QUASI-JUDICIAL FUNCTION
1. Hears and determines questions of fact to which the legislative policy is to apply;
2. Decide, based on the law’s standards, matters relating to the enforcement of
administrative laws.
 Cease and desist orders are considered as quasi-judicial functions.
