Legal and Ethical Issues


The Data Protection Act controls how your personal information is used by organisations,
businesses or the government and how it is handles according to the person’s data
protection rights. This keeps your information or work safe and secure. The Data Protection
Act has eight principles:

 First Principle: Personal data shall be processed fairly and lawfully and shall not be
processed unless at least one of the conditions in Schedule 2 is met and in the case of
sensitive personal data, at least one of the conditions set out in Schedule 3 or either of the
two Statutory Instruments below is met.
 Second Principle: Personal data shall be obtained only for one or more specified and lawful
purposes, and shall not be further processed in any manner incompatible with that purpose
or those purposes.
 Third Principle: Personal data shall be adequate, relevant and not excessive in relation to the
purpose or purposes for which they are processed.
 Fourth Principle: Personal data shall be accurate and kept up to date.
 Fifth Principle: Personal data processed for any purpose shall not be kept for longer than is
necessary for that purpose.
 Sixth Principle: Personal data shall be processed in accordance with the rights of data subjects
under this Act.
 Seventh Principle: Appropriate technical and organisational measures shall be taken against
unauthorised processing of personal data and against accidental loss or destruction of, or
damage to, personal data.
 Eighth Principle: Personal data shall not be transferred to a country or territory outside the
European Economic Area, unless that country or territory ensures an adequate level of
protection for the rights and freedoms of data subjects in relation to the processing of
personal data.

Creative Commons licenses require licensees to get permission to do any of the things with a
work that the law reserves exclusively to a licensor and that the license does not expressly
allow. Copyright is a legal right created by the law of a country that grants the creator of an
original work exclusive rights for its use and distribution.

It is important that my video is created inside of these laws, firstly because, if I happened to
break the data protection act, I may be at the risk of being fined up to £500,000. With using
the data protection act, any information or data stored on a computer or an organised paper
filing system about living people is covered so it is important that this act is used when
making my video so that any information or work I have documented is confidential and safe.
Secondly, going through with the creative commons licenses when making my video insures
that others will be able to tweak, build on, or remix my work non-commercially and will give
me credit for it if they decide to do any of this. Thirdly, although any work gets automatic
protection, it isn't certain that people won’t copy any of my work for their own gain. Any
original ideas or creative pieces of work I create, including the non-smoking campaign video,
is a potential asset and should be treated like one because any of the work may result in
having considerable value in the future and could even potentially be used for financial
collateral.

Call Sheet

Monday 29th
9:15am – Set up scene: place the candles on the birthday cake and light them, make the
room look tidy and homely, less like a school
9:30am – Begin recording first scene: several people singing happy birthday in the back
behind the camera, younger, much healthier non-smoker is videoed blowing out candles on
birthday cake

9:35 – Tidy up setting, light the candles again and record second scene: several people will
be singing happy birthday and the older character who smokes will blow out the candles on
the birthday cake

9:40 – Keep the setting as it is but light the candles on the birthday cake twice again to
record another two separate videos of both of the characters blowing out the candles, both
at a closer angle. This will catch their emotions and create a much different effect. The
second close up video which is of the character that smokes involves him coughing when
blowing the candles out. These close up videos will be kept as a backup video that may be
used when editing the non-smoking video.
