NOTE

1. The Pradhana Archakas / Archakas (erstwhile Archaka Mirasidars),


Sri T T , Tirumala, vide their joint representation dated nil have represented for
payment of salary in time scales of pay plus allowances admissible under rules
from time to time

2. In this connection it is to state that the Endowments Act 30/1987


came into force from 28-5-1987 Under Sec 34 of the above Act, the hereditary
rights of Mirasidars were abolished Under Sec 35 , the existed Mirasidars were
eligible for regular appointments Under Sec 37, the TTD Management is
empowered to take disciplinary action against them duly following CCA Rules
Under Sec 39, they can be transferred Under Sec 144, the shares in Hundi,
Prasadams etc were abolished Aggneved by the above, Sri A S Narayana
Deekshithulu, ExArchakam Mirasidar, Paidipalli Family, Sri T T , Tirumala, filed
W P N o 638/1987 in Hon'ble Supreme Court The Hon'ble Supreme Court vide
interim directions dated 22 6 87, had suspended the operation of the provision in
Sections 34,35,37,39 and 144 of the Endowments Act 30/1987 and ordered for

statusquo Finally, the Hon'ble Supreme Court vide judgment dated 19-3-96 in
W P No 638/87 and other batch of W Ps had confirmed the above provisions The
same was implemented from 22-3-1996 in TTD

3. The following 'then Archakam Mirasidars, Sri T T , Tirumala, were


appointed as Pradhana Archakas in the scale of pay of Rs 4400-8700 plus
allowances admissible under rules and Archakas in the scale of pay of Rs 2375-
5040 plus allowances admissible under rules in 1993 scales in Res No 121, dated
30 4 98/1 5 98 of the Board of Trustees, TTD, communicated in Proceedings Roc
No E7/17042/98, dated 9-6-1998

4. In this connection, it is to state that TTD had filed I A No 876/98-III


AD J, Tirupati, in W P No 638/87, Supreme Court, for the recovery of excess
payments made to the then Mirasidars during the period from 22-6-87 to 21-3-96
In accordance with Judgment dated 19-3-96 in W P No 638/87 and other batch of
Writ Petitions and order dt 9-5-97 in I A No 12 in W P No 638 87 of the Hon'ble
No. 170

Supreme Court, the ADJ, Tirupati, had appointed an Advocate Commissioner to


asses the payments made during the penod from 22-6-87 to 21-3-96 The above
IA is under process and pending finalisation Further, as per the order dated
9-5-97, the IA No 12 in W P'No 638/87 Supreme Court, in case, the amounts paid
by TTD is found in excess, the same has to be determined The Advocate
Commissioner appointed by the ADJ Tirupati, has to assess the payments and
submit a report to the ADJ, Tirupati for final orders Further as per the above
order of Supreme Court, in oase the then Archakam Mirasidars appointed in TTD
do not possess any substantial immovable property, the excess amounts paid
should be recovered in easy instalments from part of the emoluments payable to
them on appointment against the posts of Pradhana Archaka / Archaka in TTD
Therefore, all the above Pradhan Archaka / Archakas were required to furnish an
undertaking to recover the excess amounts if any paid to them after finalisation of
the case, pending in the court of Additional District Judge Tirupati But they did
not furnish the undertaking till this date on the plea that their Advocate advised
them not to do so The following were the amounts paid to the above Ex-Archakam
Mirasidars during the period from 22-6-87 to 21-3-96

5. The above Ex-Archakam Mirasidars have to render necessary


accounts for the above amounts and to refund the excess amounts to TTD
Therefore, the TTD Board of Trustees, TTD, in Res No 1073, dated 28/29-12-98
had resolved to pay consolidated amount to each Archaka at Rs 1 500/- per month
plus Rs 500/- per month towards boarding charges from the date of joining in June
98 to 30-9-98 and at Rs 3,000/- per month plus Rs 500/- towards boarding
charges from 1 10 98 onwards till the finalisation of I A No 876/98 ADJ, Tirupati
filed by TTD, in W P No 638/87 Supreme Court of India or till they furnish an
undertaking for recovery from salary or adequate security for recovery of the
excess payments, whichever is earlier Further, the Board of Trustees TTD in Res
No 86, dated 31 5 99/1 6 99 had fixed the Sambhavana not exceeding Rs 6,000/-
i e (Rs 5,500/- towards Sambhavana plus Rs 500/- towards boarding charges) per
month per head to Sri A P Srinivasa Moorthy Deekshithulu and
Dr A Venkataramana Deekshithulu, Pradhana Archakas, Sri T T Tirumala with
effect from the dates of their joining as Pradhana Archaka in June 1998 till the
finalisation of I A No 876/98 ADJ, Tirupati, filed by TTD, in W P No 638/87
Hon'ble Supreme Court or till they furnish adequate security for recovery of the
excess payments or till they furnish an undertaking for recovery from salary
whichever is earlier, Thus, above amounts are fixed based on their salaries to
which they are eligible in 1993 Revised Scales duly not exceeding the recovery to
1/3rd of monthly salary, under Article 52 of the A P Financial Code Vol I

6. Now, the scale of pay of the post of Pradhana Archaka was revised to
Rs 8400-16525 and the scale of the post of Archaka was revised to Rs 4550-
9600 from 1-7-98 with monetary benefit from 1-4-99 in 1999 scales The total salary
payable to Pradhana Archaka and Archaka is noted below

7. When proposed to enhance payment to Pradhana Archakas and


Archakas from Rs 6,000/- to Rs 7,500/- per month per head to Pradhana Archaka
and from Rs 3,500/- to Rs 4,175/- per month per head to Archaka w e f 1-4-99,

the Law Officer and F A&C A 0 , TTD, Tirupati have opined that unless they fulfill
the conditions contained in our letter dated 11-12-1998 it is not feasible to enhance
Sambhavana and boarding charges

8. Actually Pradhana Archakas and Archakas appointed on regular pay


scales were earlier Mirasidars They have been appointed On regular scales of pay
as per the orders of the Government following the Supreme Court Judgment In the
normal course, they should have got the full emoluments applicable to the scales of
pay in which they have been appointed But it is not being done

9. The Hon'ble Supreme Court while delivering the judgment in the


Mirasi case observed that the Ex-Mirasidars shall render accounts for their
individual expenditure during the period 1987 to 1997 te the date of
commencement of the Endowments Act to the date of judgment The TTD was also
instructed to furnish the details of payments made to them during the period
Though, the TTD, had furnished details of payments made to the Ex-Mirasidars to
the III ADJ Tirupati the Ex Mirasidars failed to furnish details of their individual
expenditure It is necessary to arrive at the excess payments if any made to the
Ex Mirasidars Once the excess payments are arrived at, the same have to be
recovered from them either in lumpsum or from their salaries Since the excess
payments have to be recovered from their salaries after arriving at the excess
payments already made, we have requested the Ex-Mirasidars either to furnish
security or an undertaking for recovery of certain amounts from their salaries-
everymonth They have failed to do so We have therefore, suo-moto fixed the
consolidated amount both for Pradhana Archakas and Archakas (Ex Mirasidars)
depending upon the scales of pay to which they were eligible Now that the scales
of pay are enhanced, the consolidated pay also needs enhancement Presently
they are paid Rs 6,000/- per month to Pradhana Archaka and Rs 3 500/-
per month to Archaka (including boarding charges) as a consolidated amount
According to 1999 scales the total emoluments come to Rs 11 267-10 for
Pradhana Archaka and Rs 6,287-20 for Archaka According to the normal
admissible recoveries from salary, only upto a maximum 1 /3rd can be recovered
under Act 52 of A P Financial Code Vol-I when taking out 1/3rd of the total
emoluments under the Revised Scales, 1999, Pradhana Archaka will be eligible for
Rs 7 511-40 and Archaka for Rs 4,191-45 It is therefore recommended to pay Rs
7,500/- to Pradhana Archaka and Rs 4,175/- to Archaka per month being
approximately 2/3rd of the total emoluments due in 1999 scales Though, the Law
Officer and F A & C A O , TTD Tirupati, have opined not to enhance the
consolidated amount as they have failed to give an undertaking or security, as
required by TTD, in the letter dated 11-12-1998 TTD need not insist on that to
enhance the consolidated amount to 2/3rd of their total emoluments as TTD cannot
recover more than 1/3rd of the total salary It amounts to making payment on the
same principle on which the present payments are made Therefore, whatever is
due by way of enhancement under the 1999 scales, need not be denied to them

10. The Specified Authority in Resolution No 99, dt 10-6-2000 resolved


for enhancement of sambhavana plus Boarding charges in lieu of payment of
salary at Rs 7,500/- to Pradhana Archaka at Rs 4,175/- to Archaka per head per
month w e f 1-4-99 (the date of monetary benefit applicable in 1999 scales)
including boarding charges till the finalisation of I A No 876/98, III ADJ, Tirupati

filed by TTD in W P No 638/87, Supreme Court or till they furnish undertaking for
recovery from their salary or adequate security for recovery of the excess
payments, received by them which ever is earlier subject to th disposal of Review
Petitions and review applications pending disposal in Hon'ble Supreme Court

11. The Government in their G 0 Ms No 855 Revenue (Endts I)


department, dt 8-10-97 have fixed the cadre strength and also extended regular
pay scales to Archakas etc Accordingly erstwhile Archakas were appointed in the
respective posts as detailed below vide Proceedings Roc No E7/17042/98
dt 9-6-98

12. They have joined in the month of June, 1998 As the regulai time
scale given in 1993 PRC scales of pay their pay has to be fixed in the minimum of
the time scale of 1993 PRC w e f the date of their joining upto 31-3- 1999 (till PRC
1999 comes into effect) and 1/3rd of the emoluments have to be recovered from
them every month from out of the emoluments

13. The PRC 1999 scales came into effect subsequently w e f 1-7 1998
but emoluments to be drawn w e f 1-4-99 Their pay has also be fixed in the
minimum of the time scale of PRC 1999

14. Though they have not given any undertaking for the recovery of dues,
we have been recovering the amounts at 1/3rd from the monthly emoluments they
are getting The basis for arriving at the total emoluments is the minimum of the
scale plus allowances such as pay HRA, PCA as on 1-4-99 in the PRC 1999 out
of which 1 /3rd amount is to be recovered and 2/3'd amount is to be paid which is
named as Sambhavana plus boarding charges which may not be correct

15. As they were given the regular time scale of pay and we are
recovering the due amount from out of the emoluments even without their consent
though they are entitled for all the benefits such as annual increments D A or other
allowances if any enhanced and also other benefits extended from time to time,
opening of Service Registers and also retirement on attaining the age of
superannuation etc , on par with regulai employees of TTD and 1/3rd of the
emoluments has to be recovered from the total salary (say total emoluments)
increased consequent on the fixation of pay in revised scales and sanctioning of
increments from time"to time

16. In the light of the above, the subject is placed before the Board of
Trustees to take a decision to implement regular time scale of pay to Pradhana
Archakas and Archakas of erstwhile mirasidars from the date of joining in service
ps^G 17A

i e from June 1998 in the PRC 1993 and PRC 1999 by opening service registers
and to recover 1/3 rJ of the emoluments from the total salary subject to finalisation
of I A No 876/98 III ADJ, Trrupati and subject to the disposal of review petitions
ana review applications pending disposal in Hon'ble Supreme Court
