If an employee from public sector undertaking (PSU) resigns through proper channel after taking

NO Objection Certificate and joins another PSU, Please answer the following with regard to this
case.

1. Is there any circular/guidelines/rule for transfer of Gratuity from Public sector


Undertaking (PSU) to another PSU?
2. If yes to 1. Please provide the copy of the same.
3. If yes to 1. Is this circular applicable if resignation is done prior to completion of 5 years?
4. Is there any circular/guidelines/rule for transfer of Earned Leave from Public sector
Undertaking (PSU) to another PSU?
5. If yes to 4. Please provide the copy of the same.
6. If yes to 4. Is this circular applicable if resignation is done prior to completion of 5 years.
7. Is there any circular/guidelines/rule for transfer of Sick/Medical Leave from Public sector
Undertaking (PSU) to another PSU?
8. If yes to 7. Please provide the copy of the same.
9. If yes to 7. Is this circular applicable if resignation is done prior to completion of 5 years.
10. Is there any circular/guidelines/rule for Pay Protection if one resigns from PSU and joins
another Public sector Undertaking (PSU)?
11. If yes to 10. Please provide the copy of the same.
12. If yes to 10. Is this circular applicable if option of Pay Protection is NOT given at the
time of interview or joining?
13. Is there any circular/guidelines/rule for Seniority, saying that tenure of periods spent in
the past service will be included for determining eligibility for promotion?
14. If yes to 13. Please provide the copy of the same.
15. If yes to 13. Is this circular applicable if option of ‘Seniority’ is NOT given at the time of
interview or joining?
16. Is there any circular/guidelines/rule for Service of Notice Period, if one resigns from PSU
and joins another Public sector Undertaking (PSU)?

7. Whether the benefits of past services such as Transfer of Gratuity, earned leave etc is
available, in case an employee resigned from public sector undertaking (PSU) through
proper channel after taking NO Objection Certificate and joins another PSU?

1&7: DPE has no such guidelines.


2-3: DPE guidelines dated 25.07.1985 & 25.01.1988 (available on DPE website i.e. www.dpe.gov.in ) may be
referred in case of transfer of leaves.
4. DPE guidelines dated 14.12.2012 (available on DPE website i.e. www.dpe.gov.in ), inter-alia deals with pay
protection issues of CPSE employees.
5&6: Board/Management of CPSEs are empowered to frame their own rules regarding recruitment,
promotion , seniority notice period, resignation etc. in consultation with their administrative Ministry/
Department, if required. DPE has no role in such matters.
8 & 9: DPE guidelines are applicable to all Central Public Sector Enterprises including Cement Corp of India ltd
except Insurance and Banking Sector PSUs.

This is for your information that, an action for Revival of CCI Officers Association is being
performed in Corporate Office, but officers of Nehru Place were NOT informed about the said
action.

Therefore, it is requested please pass directions that such Revival of CCI Officers Association
may have consent and participation of all officers posted at CO and Nehru Place.

In this regard, it is requested that, if any actions as on date has taken place for Revival of CCI
Officers Association may be stopped/discarded and fresh actions may be initiated under your
guidance so that contribution of all officers is recorded for Revival of CCI Officers Association.
