SECTION A: GENERAL SPECIFICATIONS

1. GENERAL

Contractors are invited to submit proposal on Biodiesel Supply, Manning RefuellingRefueling Kiosk and
Field Refueling Services at PT. New Priok Container Terminal One (“NPCT1”).

Contractor’s proposal shall constitute an offer by Contractor. NPCT1 shall be at liberty not to accept or to
accept all or any part of an offer by the Contractor. NPCT1 may also, in its absolute discretion, award the
term contract to more than one Contractor and the allocation among Contractors shall be at the sole
discretion of NPCT1.

Contractors shall bear all costs associated with the preparation and submission of its tender, and
NPCT1, will in no case be responsible or liable for those costs, regardless of the conduct or outcome
of the tendering process. The Contractor must submit complete proposal and price schedule that
meets all requirements specified in this tender and NPCT1 reserve the right to award in full, in parts
or not to award the offer by the Vendor. NPCT1 may also, in its absolute discretion, award the term
contract to more than one Vendor and the allocation among Vendors shall be at the sole discretion
of NPCT1.

The tender prepared by Contractors, as well as all correspondence and documents relating to the
tender shall be written in English language. Any printed literature furnished by the tenderer may be
written in another language provided they are accompanied by an accurate English translation of the
relevant passages in which case, for purposes of interpretation of the tender, the English translation
shall govern.

At the end of tender process, NPCT1 shall notify the success Vendor by issuing an Award Letter, and such
document will be sent by facsimile or other electronic media, and considered as formal once it is sent by
NPCT1. Subsequently, vendor and NPCT1 will enter into binding purchase contract following terms and
condition as in this tender document and standard as in the NPCT1’s contract template as attached to
this tender document, and Vendor shall follow accordingly.

Scope of work on this tender are as follows:
2.1 The Contractor shall supply / provide the diesel fuel for 2x30,000 liters storage tanks at NPCT1,
which shall fully conform to the requirements under this Contract including Technical
Specifications, and in accordance with the timely delivery to keep maintain smooth operational
of NPCT1. (section A.1.a).

2.2 The contractor shall provide and manning mobile skid tanker(s) and associated/supporting
equipment with diesel fuel inside, to meet daily demand for field refueling of NPCT1’s heavy
equipment which shall fully conform to the requirements under this Contract including Technical

Specifications, and in accordance with the timely delivery. It is advised that the contractor is to
provide coupler which match with coupler fillingof filling pipe of the crane in order to able to do
filling from below.

2.3 The contractor shall provide everything necessary for the proper manning refuellingrefueling
kiosk (labourlabor and the PPE), do light maintenance to NPCT1’s RefuellingRefueling Kiosk and
the facilities to the true intent and meaning in the specification. (section A.1.c and A.1.d).

2.4 Contractor is to clean the Storage tanks., 1 (one) tank on every year. Contractor may appoint the
specialist which hold the certificates (personnel skill certifications, competent certification of the
company and from authorized institutions) related this works. The specialist should have Commented [ASW3]: is that any specific

2.5 The Contractor is to purchase parts for NPCT1 as shortlisted in Appendix A. Commented [EAG4R3]: Can be Migas or

2.52.6 Notwithstanding any provisions to the contrary, NPCT1 shall be at liberty to purchase less Formatted: Font: +Headings (Calibri Light)
than the estimated quantities or delete any items during the term of this Contract and the
Contractor shall have no claims whatsoever against NPCT1 for such reduction or deletion.

2.62.7 It shall be the sole responsibility of the Contractor to ascertain the nature of the site and its
circumstance (surrounding nature) and the nature or extent of the Works that are required for
the due and faithful completion of each and every aspect of the Works contained in this Contract.
The Contractor shall obtain his own information on all matters affecting the execution of the
whole of the Works involved in this Contract to the entire satisfaction of NPCT1. NPCT1 shall not
entertain any claims in consequence of any alleged ignorance in any respect. The Contractor shall
be wholly responsible for making all necessary arrangements and coordinating with all relevant
authorities and parties to ensure satisfactory completion of this Contract.

2.72.8 The Contractor shall obtain NPCT1 passes for himself as well as his workmen or any other
persons employed or engaged by him under the Contract prior to entering NPCT1 Premises. The
Contractor shall allow for payment of all fees and charges (if any) imposed by NPCT1 from time
to time for entering the NPCT1 Premises.

The contractor must possess all associated permits issued by the Indonesia authorized institution
including Port Authority in order to be able to execute the Contract.

3. AMENDMENTS AND REVISIONS

Any modification to or variation of this Contract must be agreed to in writing and signed by both
parties and expressly incorporated into the agreement in writing.

4. ADDITIONAL CONSIDERATIONS

The Contractor is encouraged to propose any additional value-added features, and/or any cost-saving
alternatives, in addition to the scope and requirement mentioned in this tender document.

The costs and benefits of these additional features or cost-savings will be evaluated together with the
proposal.

5. FEE AND PAYMENT TERMS

Each quotation shall remain irrevocable and valid for acceptance until finalization of contract (“Lock-
in Period”) and there shall be no change whatsoever to the quotation during the Lock-in Period
without NPCT1’s prior written consent.

Contractor shall not charge any fee greater than amount that specified in the Contract or otherwise
agreed in writing. The price, rates, fees and charges stipulated in the quotation shall exclude value
added taxes and any other taxes but shall include health insurance, social security, BPJS, allowances
(meal, transport, festive, etc), incentive, all other costs required by the law and charges required for
Contractor to perform its obligations. Contractor must comply with Ministry of Manpower and
Transmigration regulation and Ministry of Transportation regulation.

The following Fuel payment shall also be applied:

5.1 Biodiesel Price. The Formula price of the works is (((100&-X% ) MOPS + (X%) HIP Fame)) + Formatted: Font: +Headings (Calibri Light)
premium). MOPS and FAME are calculated based on composition percentage between MOPS
and FAME in each fuel liter. MOPS based on the published rate by PLATTS Asia Pasific and HIP
FAME based on market index price, published rate by Dirjen Energi Terbarukan dan Konservasi
Energi Kementrian Energi dan Sumber Daya Mineral Republik Indonesia (Directorate General of
New Energy, Renewable and Energy Conservation of Ministry of Energy and Mineral Resources
of Republic of Indonesia). Starting Ccomposition of HIP FAME is 20% for this tender,, unless
otherwise can be changed / adjusted, following the change in government regulation in the
incoming years.. The price quoted is :

a. Inclusive of delivery or transportation cost, any investment cost, and other/miscellaneous


costs from Contractor’s depot to the designated storage tanks at Refueling Kiosk Facility of
NPCT1 and to the contractor’s Skid tanker.
b. The prices quoted shall be inclusive of providing the skid tanker(s), to operate, operator,
maintenance, consumable, safety things for the skid tanker(s).
c. The prices quoted also is inclusive of manning the Refueling Kiosks, light maintenance,
consumable, safety devices and equipment.
d. The prices quoted is inclusive of tests :
 Calibration of Dispensers, minimum 1 (one) time a year. If deemed necessary maximum
2 (two) times a year.
 Calibration of Flow meter. 1 (one) time a year. If deemed necessary maximum 2 (two)
times a year..
 Laboratory fuel test, minimum 4 (four) times a year, no maximum quantity, as long as
required by NPCT1, tThe test must be conducted by Contractor with no additional cost..

5.15.2 Spare Parts.TheParts. The Contractor shall submit the spare parts price schedule in
accordance with format set out in Schedule of Rates as in Appendix A. The unit prices are locked
during contract period. In case NOCT1 NPCT1 intend to procure the spare part, NPCT1 will raise

the Purchase Order (PO) to the Contractor.

5.25.3 Cleaning the storage tanks. Contractor shall submit the Cleaning storage tank price schedule
in accordance with format set out in Schedule of Rates as in Appendix A. The unit prices are
locked during contract period as stated in Appendix A. The work shall be progressed after
getting Purchase/Work Order issued by client.

5.35.4 No minimum or commitment value / quantity are to be provided under this tender.

5.4 All prices quoted shall be inclusive of delivery or transportation cost, any investment cost, and
other/miscellaneous costs from Contractor’s depot to the designated storage tanks at
RefuellingRefueling Kiosk Facility of NPCT1 and to the contractor’s Skid tanker.

5.5 The prices quoted shall be inclusive of providing the skid tanker and to operate,
maintenance the skid tanker. The prices quoted also shall be inclusive of manning the
refuellingRefueling Kiosks.

5.6 The prices quoted shall be inclusive of tests :


a. Calibration of Dispensers, minimum 1 (one) time a year.
b. Calibration of Flow meter. 1 (one) time a year.
c. Laboratory fuel test, minimum 4 (four) times a year.

5.75.5 Contractor shall not charge as payment for the works any rates, fees or charges greater in
amount than the Contract Price specified in the Contract unless as otherwise agreed in writing.

5.85.6 The Contract Price and its payment shall be in rupiah currency. No adjustments shall be
allowed for fluctuations in exchange rates or variations in cost of materials, labour or any other
factors affecting such price.

5.7 The invoice is a cumulative of the actual monthly usage basis, based on the print out produced
by dispensers and flowmeter of skid tanker.

5.9

5.105.8 All duties, permits and charges imposed by any government authorities for the Works, if any,
shall be borne by the Contractor and shall be included in the Contract Price. Cost of all informal
charges/ pickings, if any, shall not be borne by NPCT1.

5.115.9 The Contract Price shall be deemed to cover all costs, overheads, profits and include delays,
standby, shifting and idling of equipment due to whatsoever causes for the proper execution
and satisfactory completion of the Works.

5.125.10 The Contract Price shall include all costs and expenses incurred for the delivery and
unloading of all items required for the execution of the Works at location(s) as designated by
NPCT1.

5.135.11 Unless otherwise agreed between the parties, NPCT1 shall pay the Contractor the
invoiced that issued in monthly basis, within 45 (forty five) days from the date of the invoice
received. Contractor provided that such invoice shall not be issued prior to the completion of
the works to NPCT1's satisfaction and acceptance in accordance with clause 6.

5.145.12 Any payment by NPCT1 to the Contractor of the invoiced value shall not relieve the
Contractor from responsibility in relation to the proper execution of this Contract.

5.155.13 The Contractor shall at his own expense when required by NPCT1 perform removed
or replace of any of the Product supplied hereunder found by NPCT1 to be damaged or
defective or inferior or not in accordance withaccordance hiswith Contracthis Contract. In
the event that Contractor fails to remove and replace as aforesaid, NPCT1 may make purchases
of the Products elsewhere and claim from the Contractor the difference in price and other
costs incurred by NPCT1, in addition to the service level enhancement, if any.

5.14 Where NPCT1 is entitled under the Contract or otherwise to recover any sum or damages from
the Contractor or is required to deduct or withhold any sum or account of taxes (including
income tax), contributions or penalties or interest, service level enhancement (section C.3),
such sum may be deducted, withheld, retained or set off from any sum then or subsequently
due from NPCT1 to the Contractor under the Contract without prejudice to any claims or rights
which NPCT1 may have against the Contractor and without constituting any admission by
NPCT1 as to the performance of the Contractor's obligations hereunder nor relieve the
Contractor from its obligations and liabilities under the Contract.

5.15 Some requirements (as determined by NPCT1) must be completed before first invoice
submitted.

6. DOCUMENTS TO BE SUBMITTED FOR EVALUATION

For the purpose of Tender evaluation, Tenderer shall submit two (2) complete sets of duly completed
Tender documents together with all the details adequate for technical, operational and financial
evaluations. Tenderer who submits inadequate information shall be deemed as disqualified for the
Tender. The tender submission shall contain the following minimum information:
1. Cover letter.
2. Table of Content.
3. Executive Summary.
4. Propose detail operation plan, including operation management system.
5. Schedule of the proposed manpower (to appoint one as site leader), include the propose
manpower personal competence (curriculum vitae, certification, and reference letter).
6. Propose fuel specification and the last laboratory test.
7. Propose specification for skid tankers, the document and the supporting equipment.
8. Organization chart.
9. Certification and valid calibration of equipment.
10. Draft of Refueling Forms and Reports.
11. Tenderer information
The Tenderer is to provide the following information pertaining to its organization. Please note
that this list is by no means exhaustive, more information can be included as appropriate:
 Brief description of company profile
 Describe achievements and provide list of clients in similar projects
 Minimum 5 years in the related business.
 Number of employees and approximate percentage of people dedicated to various functions
within the organization.
12. Financial reporting and legal documents
 Minimum 3 years Financial Statements audited by independent public accounting firm.
 The latest 3 months tax payment reporting of withholding taxes and value added tax.
 Details of any current ligitation pending against it not covered in the financial statements
 The vendor's license of domicile (SKD), registration certificate (TDP), establishment deed,
NPWP and PKP (pengukuhan pengusaha kena pajak).
 Business License that issued by Ministry of Energy and Resources of Indonesia
 All other required permits for all scope of works under this tender that issued by
government/related authorities.
 Copy of valid ISO 9001 (Quality) and OHSAS 18001 (Health and Safety) certificate.

1.1.4 Contractor shall supply all equipment, tools and consumables; unless otherwise specified by

b. Diesel means HSD (High Speed Diesel). The Contractor shall ensure that the diesel to be supplied
in this contract shall meet the Indonesia’s fuel specification standards of diesel engines used by
NPCT1 on the yard cranes, prime movers, forklifts and other vehicles and equipment. The diesel
fuel shall also in accordance with the specifications set by the Government of the Republic of
Indonesia which means MIGAS (Regulation of Directorate General of Oil and Gas) :
 SK. Dirjen Migas No. 28.K/10/DJM.T/2016.
 Peraturan Menteri Energi Sumber Daya Mineral No. 12/2015.

c. Contractor hereby agrees to be liable for and shall indemnify NPCT1 for any loss or damage to
its equipment and property that may result from the use of the diesel supplied or delivered by
the Contractor that do not conform to specifications.

d. Contractor shall ensure that the diesel supplied or delivered under this contract shall be free
from inorganic acids, sludge, sediments, fibrous foreign or any solids that can interfere with the
operation of NPCT1 equipment. If and when such instances do occur, Contractor shall take
remedial actions to resolve the interference to the satisfaction of NPCT1.

e. The Contractor shall be entitled to no less than one (1) full diesel analysis test minimum per
quarter (4 times a year), to be performed at no additional costs and upon our request, to
determine the quality and performance of the diesel supplied, as and when any need arises.
Among other specifications, details including the Cetane index/number; Sulphur, water, ash,
sediment contents may be requested for. The fuel should be sent to an accredited testing
center for testing. Contractor is to provide and ready day to day, tools for spot test the water
contain.

f. Contractor is to manning the Refueling kiosk and to operate his skid tanker to fully serve the
refueling works for NPCT1’s cranes, equipment and vehicles. Contractor shall also supply all
reasonable information with regards to the Diesel Fuel and the performance as NPCT1 may
request.

g. Any information provided by NPCT1 which may be used as the basis for estimating the Contract
Sum, shall only be an estimate which is provided only to facilitate the contractor’s own
evaluation of and preparations for the contract and its implications, bearing in mind various
factors including the contractor’s own considerations. Such estimate is not intended and shall
not be construed as any forecast, representation or warranty by NPCT1 as to the value of the
Contract nor to represent or indicate the amount of losses and damage (if any) suffered by the
contractor in respect of the contract.

h. Contractor shall facilitate the filling up of Diesel Storage and record details of transaction.

i. Contractor is responsible to ensure the availability of fuel for usage at NCPT1 and maintain the
safety stock in storage tank and in skid tanker.

1.2.2 Acceptance and Warranty:

a. NPCT1 personnel or operators will verify the usage volume and signed the record of every single
refilling activity to the equipment after completed or finish.
a.b. Record details of all refuellingRefueling transaction, on which should agree and or reconcile
with NPCT1’s records and those shall be charge based on actual usage basis. The Contractor
must submits all supporting documents, records to NPCT1. NPCT1 will verify the usage volume
and signed the receipt when the Contractor fill the fuel.
b.c. Contractor shall submit fuel testing and analysis report to meet NPCT1 requirement minimum
every 3 (three) months from independent surveyor company. Acceptance of FAME ingredient
+ 2,5%. .Also submit result of calibration on the equipment and dispensers in minimum yearly
basis. Furthermore, contractor is always to provide device or tool to test or examine water

prejudice to its other rights accept or reject all or any of the fuel supplied.

f. Contractor shall be responsible to repair or perhaps replace any broken part or equipment as
a result of the bad quality fuel they delivered.
g. Contractor shall be responsible to repair or perhaps replace any broken NPCT1’s properties as
a result of negligence from the services of Contractor at NPCT1 premises.
e.

1.2.3 Field RefuellingRefueling

Contractor shall provide minimum 1 (one) mobile skid tanker with requiredequipped with
refuellingRefueling accessories for refuellingRefueling port equipment that are unable to come
to the kiosk, or as required by NPCT1.
 Contractor shall provide unit of quantity and capacity of their mobile skid tankers properly. Formatted: Indent: Left: 0.88"
If the skid tankers require to be out of NPCT1’s Port vicinity, it shall be acknowledgement
by NPCT1.
 The skid tankers must have equipment in order to able it to refill the equipment at level
about 4 65 (foursixfive) meters from the yard surface..
 The skid tanker must be equipped with flow meter with good condition. The flow meter is
able to produce printed dispensed quantity. The flow meter must be calibrated at least 1
(one) time per year.
 NPCT1 has right to ask Contractor another 1 (one)to provide another more skid tanker
considering the increasing on service load of fuel refuellingRefueling. No additional costs
are incurred regarding this additional.
 The cost of maintenance and, repair consumables of the mobile skid tank inclusive of
accessories, consumables and associated devices and equipment shall be borne by the
contractor.

especially after each maintenance, servicing, or repair jobs carried out.

Contractor shall provide unit of quantity and capacity of their mobile skid tankers properly. If
the skid tankers require to be out of NPCT1’s Port vicinity, it shall be acknowledgement by
NPCT1.

Acceptance and warranty Field RefuellingRefueling refer to section B.1.2.1 sub (ii)

1.2.4 Manning/LabourLabor

 Contractor is to provide the more effective manpower for this scope of work, which subject
to NPCT1 review from time to time.
 Contractor shall provide qualified personnel to operate, maintenance and light repair
maintenance services all facilities and activities at refuellingRefueling kiosk and the yard
refueling by skid tanker. Minimum experience required for operators should have at least
1 year1-year experience and 3 years for site leader level in the similar field. Contractor’
personnelThe site leader should be able to communicate in basic English. NPCT1 could
reject the proposed personnel and the number of personnel shall be provided to meet
NPCT1’s operational requirement properly and efficiently. No additional costs for
adjustment the number.

Contractor shall ensure their personnel work in daily basis at working hour stated on this
contract as NPCT1’s operational requirement. The number of personnel should be
maintained. The absence of the personnel must be replaced within 2 (two) calendar days.
The personnel who have competency and able to identify and troubleshoot any non-
conformance and/or to escalate it to ensure the Operational Readiness at all time is
advised.. The Contractor shall, at its own expense, should train its men for training from
time to time.
 Provide all the respective equipment and materials involved with the light maintenance and
light repair at their cost.
 Return all old parts replaced to NPCT1. Contractor shall collect and return components to
NPCT1 at their cost.
 Provide daily inspection of Diesel Refueling Kiosk to ensure that it is in good operational
condition and to highlight immediately should there be any non-conformance.
 Contractor shall provide their personnel with suitable insurance with minimum as regulated
by Ministry of Manpower of The Republic of Indonesia.

 The crews should have training related with this works from official institution in Indonesia.
 The Contractor shall allow in his tender for all bonus payment or other incentive payment
schemes which he deems necessary to complete the Works in time.

Contractor shall provide their personnel with suitable insurance with minimum as regulated
by Ministry of Manpower of The Republic of Indonesia.

(i) Inspection and Acceptance:

 The Works shall be subject to the monitoring, controlling, inspection and/or testing by
NPCT1 in accordance with the method determined by NPCT1. NPCT1 shall notify the
Contractor in writing of its inputs, comments, satisfaction and acceptance of the Works.
 NPCT1 may reject the Works or part thereof supplied by the Contractor which does not
strictly conform to these terms and conditions and any other mutually agreed terms with
no additional charge to NPCT1. Within 7 days of being notified of the rejection of such
Works or part thereof, the Contractor shall be required to take necessary action to rectify
the rejected Works or part thereof.

Technician works covers the maintenance and light repair work. The works referred to
details below.

(i)Contractor shall provide following scope of work:

1. Provide valid calibrated gauge instrument such as flow meter at least once a year. Formatted: Indent: Left: 1.38", No bullets or

2. Provide the backup equipment and instruments wherever location it is and shall be Formatted: Indent: Left: 1.38", No bullets or
ready immediately for replacing in case troubleshoot within 30 hours numbering

3. Contractor shall submit a complete maintenance or test report to NPCT1 for the
above-mentioned tasks and tests. These reports shall specifically record completed
results and test data.

4. Hence, the contractor must be well versed with technical know-how on the
maintenance and repair procedures for the refuellingRefueling supply tanks and
equipment and have the respective facilities to carry out the tasks and tests stipulated
in this Contract.

5. Provide all the respective equipment and materials involved with the light
maintenance and light , repair and testing of the refuellingRefueling supply network at
their cost.

6. Supply all required parts needed for the repair services refer to the rate at Appendix
A.

is in good operational condition and to highlight immediately should there be any non-
conformance.

(ii) Inspection and Acceptance:

 The Works shall be subject to the monitoring, controlling inspection and/or testing
by NPCT1 in accordance with the method determined by NPCT1. NPCT1 shall notify the
Contractor in writing of its inputs, comments, satisfaction and acceptance of the Works.
 NPCT1 may reject the Works or part thereof supplied by the Contractor which does
not strictly conform to these terms and conditions and any other mutually agreed terms
with no additional charge to NPCT1. Within 7 days of being notified of the rejection of
such Works or part thereof, the Contractor shall be required to take necessary action
to rectify the rejected Works or part thereof.

1.3 NPCT1’s Scope of Supply

NPCT1 shall allocate the following areas and facilities at the Diesel refuellingRefueling Kiosk, on a non-
exclusive basis.
 Designated RefuellingRefueling Kiosk area
 Diesel Storage 2 x 30,000 liters
 Filling Area with 2 (two) units Dispensers of diesel fuel.
 One Office Room and one Store room
 Toilet with biodegradable system (shared).
 Prayer Room (shared)
 Electrical Power Supply.

1.4 Notwithstanding any provisions to the contrary, NPCT1 shall be at liberty to purchase less than the
estimated quantities or delete any items during the term of this Contract and the Contractor shall
have no claims whatsoever against NPCT1 for such reduction or deletion.

1.5 It shall be the sole responsibility of the Contractor to ascertain the nature of the site and its
circumstance (surrounding nature) and the nature or extent of the Works that are required for the
due and faithful completion of each and every aspect of the Works contained in this Contract. The
Contractor shall obtain his own information on all matters affecting the execution of the whole of the
Works involved in this Contract to the entire satisfaction of NPCT1. NPCT1 shall not entertain any
claims in consequence of any alleged ignorance in any respect. The Contractor shall be wholly
responsible for making all necessary arrangements and coordinating with all relevant authorities and

parties to ensure satisfactory completion of this Contract.

1.6 The Contractor shall obtain NPCT1 passes for himself as well as his workmen or any other persons
employed or engaged by him under the Contract prior to entering NPCT1 Premises. The Contractor
shall allow for payment of all fees and charges (if any) imposed by NPCT1 from time to time for
entering the NPCT1 Premises.

2. Working Hour

2.1. Contractor is working in single long shift (08.00 to 17.00) from Monday to Sunday, including must
working in public holidays including new years., especially on religious holidays such as Idul Fitri, , if
required by NPCT1If required by NPCT1 to work as normal,, including Idul Fitri and including new
year.the contractor’s team must coming to work with no extra costs. The personnel must be ready
immediately at after working hours in case any emergency refuellingRefueling required at the kiosk
or at the field (yard).

2.1.2.2. The personnel must be ready immediately at after working hours in


case any emergency Refueling required at the kiosk or at the field (yard).

2.2.2.3. Contractor has to ensure that sufficient manpower are deployed


during the specified working hours to complete all works on machines allocated. Taking into
consideration their productivity and skill sets.

2.3.2.4. The Tenderer shall propose their personnel roster to cover the
working hours as stated and submit it together with their proposal.

2.4.2.5. NPCT1 shall provide the Contractor, from time to time, relevant
information to assist the Contractor in establishing its manpower requirements.

2.6. The Contractor is required to complete any urgent jobs, as and when requested by NPCT1 during
or after the specified working hours.
2.5.
2.7. If the Contractor considers that it may become necessary to work overtime in order to complete
the work by the date for completion, he shall request for permission from the NPCT1.

2.6.2.8. Records and Reports

3. 5S (Seiri/Clearing-Up, Seiton/Arranging, Seiso/Cleaning, Seiketsu/Standardizing, Shitsuke/Discipline)

3.1 Establish and Maintain that the Diesel RefuellingRefueling kiosk and the areas allocated to them
(which includes the Designated RefuellingRefueling area, Diesel Storage & Filling Area, resting areas,
toilets, and Fuel Station Building) are organized and having well 5S every time and every day, because
this year’s NPCT1 target is to implement 5S. The contractor must ensure that the areas allocated to
them and the field refuellingRefueling area are maintained clean, neat and tidy at all times and those
areas are maintained in clean good working condition according to 5S. The areas shall be swept clean
at the end of every shift. Oil, grease and water spilled on the floor must be cleaned / washed
immediately.

3.2 Depending on the condition of Diesel RefuellingRefueling Kiosk and field refuellingRefueling area,
contractor has to clean them regularly or immediately when dirty This this housekeeping is under the
Contractor work scope and the cost incurred shall be borne by the Contractor.
Any spillage and leakage must be cleaned up by the contractor immediately. Sand and/or sawdust
must available at Kiosk, provided by Contractor. The affected area must be cordoned off and the
NPCT1 Control Centre/Fire Engine or officer in-charge should be notified immediately for assistance.

3.3 On completion of the works, all waste materials shall be removed by the Contractor.

4. Delivery Requirements

The Contractor must ensure the following before delivery of the fuel to NPCT1:

(i) Check the delivery order for the following:


 Address and Destination of recipient are correct.
 Tanker vehicle no. is correct
 Product description, quantity and unit of measure (liter) are correct.

(ii) Plastic seals of Contractor’s Tanker


 All tankers are to be properly sealed against vandalism and theft.
 Plastic seals must be ensured to be intact and not broken or tampered with.
 Serial no. stamped on the plastic seals tally with the delivery order.

(iii) Ensure tanker is completely discharged
 On completion of the discharging operations, the driver has to ensure that the tank is empty
before allowing the tankers to leave NPCT1.

The Contractor shall allow in his tender for all bonus payment or other incentive payment schemes
which he deems necessary to complete the Works in time.

If the Contractor considers that it may become necessary to work overtime in order to complete the
work by the date for completion, he shall request for permission from the NPCT1. No claim in this
respect shall be considered if the work done on term of major maintenance and repair work.

Overtime to be allowed on term of routine inspection, maintenance, and repair work only. Hourly rate
to be provided on Appendix A. Overtime need to acknowledgement and approval of Superinteinding
Officer.

5. Specifications for Supply of Fuel to Tanks on Board the Yard Cranes and Other Equipment

5.1. Contractor’s Responsibility

5.1.1. The Contractor is to supply and maintain the availability of fuel in skid tanker not to disturb the
operational of NPCT1’s equipment.

5.1.2. Contractor shall ensure :


(i) that each tanker is manned by a competent driver and assistant;
(ii) that the drivers are to possess a valid driving license and to have at least 3 years driving
experience on a tanker of similar size and usage;
(iii) Mobile Skid tanker shall be equiped with flow meter and able to produce printed out fuel
dispensed.

5.1.3. Contractor shall ensure that both the driver and assistant undergo extensive training or having
experiences on the operation of all equipment deployed on the skid tankers. They shall also

meet the skill requirements of training at the fuel supplier and/or by NPCT1, before being
allowed to participate in the refuellingRefueling operations. Contractor agrees to bear all
reasonable costs for the training of the drivers and assistants.
5.1.3.

5.1.4. Contractor shall provide a competent operations site leader, who will be stationed at NPCT1
premisesoffice of Kiosk to manage the Operations at NPCT1 and remained contactable after
office hour. The operations site leader shall be responsible for the following:
(i) to check that only competent drivers and assistants are deployed to handle the
Operations;
(ii) to carry out regular evaluation, planning and training to ensure that the operations are
carried out safely and efficiently as per the procedures set out by NPCT1;
(iii) to attend and to manage all incidents, complaints and emergencies. To submit such
incident reports and to take corrective actions to prevent similar incidents from occurring.

5.1.5. Contractor shall ensure that the operations site leader/ attendants/ drivers have attended the
Oil/Petrochemical Industry Safety course for supervisors/ attendants/ drivers conducted by the
Ministry of Manpower or any such accredited organizations as approved by NPCT1.

Contractor shall be responsible and shall at their own cost and expense, design, build and
equip the tankers to meet the requirements of the refuellingRefueling operations to the
satisfaction ofsatisfaction of NPCT1; provided that such approval shall not exonerate the
Contractor of its obligations to provide tankers which are suitable and fit for the purpose.
Among other things, the tanker shall be equipped with a flow meter which can produce/print
the dispensed .quantity. To be advised that the tanker is also to be fitted with a hose length to
refill up to 2 (two) cranes at blocks. Contractor is advised to have coupling The host nozzle must
fit with the equipment nozzles coupling.
5.1.6.

5.2. Operating Procedures

5.2.1. Order and Delivery of Fuel

(i) The Contractor shall ensure that refuellingRefueling operations meet the stipulated
operating hours from 08.00 to 17.00 daily.
(ii) Contractor shall ensure that all the tankers are pre-loaded for 2nd day operations. This
includes Sundays and Public Holidays.
(iii) The tankers shall load at the designated installation for fuel supply and shall then proceed
immediately to the NPCT1 terminal in question.
(iv) Contractor shall ensure the following before delivery of the fuel to NPCT1.
 The plastic seals must be intact; no broken or tampered seals.
 The serial no. that is stamped on the plastic seal must tally with the delivery order.
 The address and destination of the recipient must be correct.
 The tanker vehicle numbers must be correct.
 The product description, quantity and unit of measure (liter) must be correct.
(v) The Contractor must make good coordination with NPCT1’s operation department to getting
refuellingRefueling order for the yard equipment.
(vi) The Contractor’s site leader shallleader shall directshall direct the tankers to the
respective areas and instruct their refuellingRefueling crew to check all the fuel tanks of

the NPCT1 heavy equipment and to top up the fuel.


(vii) If the Yard Cranes’ fuel tank level indicators are found to be faulty, the Contractor
shall report the finding immediately to NPCT1’s refuellingRefueling supervisor for
corrective action.

(vii)

5.2.2. Tankers and associated equipment performance

(i) Each tanker shall be equipped with a pump having sufficient power and also a working flow
rate of about 125-150 liters per minute with auto shut-off nozzle feature.
(ii) All the dispensing fuel flow meters should beshould be calibrated minimum once a
year to an acceptable industrial standard (i.e. margin of error below 0.5%). NPCT1 has the
right to request the contractor to re-calibrate their meters as required with no additional
cost.
(iii) The skid tanker (s) are stationed inside NPCT1’s yard, and must getting approval of NPCT1
personnel before leaving the area for certain objective. NPCT1 staff shall check to ensure
that the tanker compartments are empty before allowing the tanker to leave the NPCT1
premises.
(ii)

5.2.3. Yard Cranes or other Equipment RefuellingRefueling

(i) The driver shall proceed to the blocks assigned where the crane is.
(ii) The driver shall disembark and communicate with the crane operator to inform him
that they will proceed with the refuellingRefueling. The tanker driver shall keep a lookout
for incoming cranes at the front of the tanker and the assistant shall lookout for incoming
cranes at the rear of the tanker.
(iii) The assistant shall use the safety “lock-out” key that shall be provided by NPCT1 to
immobilize the crane. The contractor is to provide at least 3 4 (threefour) cones with
reflective tapes then to be positioned around the skid tanker during activity going on.
They are also to provide at least 1 (one) fire extinguisher 5 kgs.
(iv) The assistant shall then proceed to fill the crane’s compartment using a nozzle that
is to be connected to the tanker’s pump and the nozzle shall be automatically removed
once the tank is near to full capacity.
(v) After filling the crane’s compartment, the assistant shall then remove the nozzle
and park it back to the tanker. He shall then remove the “lock-out” key.
(vi) Before driving off, the driver shall inform the crane operator that the refuellingRefueling
operation is completed. He shall also record the quantity of fuel in the issue pass (filling
record sheet).
(vii) The driver shall also inform the Control Centre of the respective NPCT1 terminal that
refuellingRefueling or the operator of the crane’s fuel tank has been completed and he
shall then proceed to the next crane.
(viii) When all requested cranes have been completed, the driver shall then inform the
Control Centre of the respective NPCT1 terminal of those cranes which have not or
cannot be refueled. The Control Centre of the respective NPCT1 terminal will then advise
on the further course of action to be taken for those cranes.
(ix) At the end of the refuellingRefueling cycle, the driver shall return the issue pass to his
leader. The contractor’s supervisor shall check the complete set of data and inform

NPCT1 for verification.


(x) The Contactor shall ensure that all the fuel supplied is fully discharged into all the cranes
without any remaining quantity. However, NPCT1 also reserves the right to take up the
option to have the remaining fuel to be kept on board the tanker after being properly
sealed for overnight parking within NPCT1 premises.
(xi) NPCT1 staff shall check to ensure that the tanker compartments are empty before
allowing the tanker to leave the NPCT1 premises.
(xii)(x) The operating procedures may be reviewed and agreed upon by both Parties from
time to time, and as and when necessary.
(xiii)(xi) All drivers/attendants are required to comply strictly with safety guidelines stated in
Standard & Emergency Operating Procedure for Yard Cranes (“SOP”). They must also
strictly observe all traffic rules and safety regulations within the premises of NPCT1.

6. Service Level Enhancement

7.1 Contractor shall maintain minimum 1513% fuel level (or 97,000 800 liters) in storage tank. Shortage in Formatted: Indent: Left: 0.25"
fuel than safety level with period of more than 48 (forty-eight) hours or before if already disturb the
operational, NPCT1 will charge Contractor with 1% from shortage liters determined upon
refuellingRefueling times by prevailing fuel rate. The charge value will be increased 1% for every 6
hours with total maximum value of 5%. NPCT1 has the rights to perform inspection anytime at its sole
discretion and Contractor shall comply accordingly.

7.2 In case the skid tanker or flow meter or the accessories get damaged, the Contractor must replace it
not more than 48 hours. Fail to provide the replacement, NPCT1 will charge Contractor IDR 2,000,000
(two million rupiahs) per days with maximum value IDR 12,000,000 (twelve million rupiahs).

7.27.3 Contractor is to monitor and to keep maintain the safety stock in the skid tanker. Failure to
provide the fuel within the time period and making impact to the operational of the equipment due to
empty tank, NPCT1 will charge 100% from the respective fuel orders.

7.37.4 If contractor fails to supply or deliver the diesel for an aggregate of 25 (twenty-five) days or
more (if not being necessary for such numbers of days to be successive days in nature), NPCT1 shall
be entitled but not obliged at any time thereafter to forthwith terminate this contract immediately
by giving written notice to the Contractor.

7.4 If there should be a service shortfall which is attributable to shortage of manpower and/or because of
incompetence manpower, charge of IDR 3,000,000 per case will be imposed.

7.5 In event of delay to replace absence personnel within 2 (two) calendar days, NPCT1 will claim
Contractor minimal 15% x (UMR Jakarta) for each personnel then increasing 2% per day and maximum
2530%.

7.6 Within 7 (seven) days, if contractor fails to follow up effects of the rejection of the works and fuel
supplied by the contractor, any damage or trouble on the NPCT1’s property caused by the refilling
activities, NPCT1 will do the rectifying repairing, replacement, then costs are claimed to the
Contractor.

7.6 The accepted of cumulative late coming of each personnel for every month is 560 minutes. In the
event of late coming bigger than accepted, NPCT1 will claim Contractor 20% x (UMR Jakarta) for each
personnel per month, unless otherwise any reasonable notice for the late is given and agreed by
NPCT1.

7.7 All claims, costs, damages or expenses which NPCT1 may have paid or sustained for which the
contractor is liable under this contract and all claims for service level enhancement made by NPCT1
against the contractor under this contract and all money due or owing by the contractor to NPCT1
under this contract or any other contract that NPCT1 may have with the contractor, and/or may be
claimed from the performance bond, and the balance, if any, shall be a debt due by the Contractor
to NPCT1 and may be recovered by NPCT1 by action at law.

7. Safety

Contractor Responsibility

7.1. Contractor shall be responsible for safety at work of his servants and agents and shall maintain a
safe system of work at all times and in addition shall also ensure that all his servants and agents
comply with whatever safety rules and regulations that may be laid down by NPCT1 at any time
or from time to time.

7.2. Contractor is entitled to make Risk Assessment, approved by NPCT1 HSSE.

7.3. Leakage or spillage of Diesel


The oil spillage/leakage must be cleaned up by the Contractor immediately. The affected area
must be cordoned off and the NPCT1 Terminal Control Centre/fire engine or Officer in-charge
should be notified immediately for assistance. The contractor’s staff shall make all reasonable
attempts to contain the spillage as specified under the SOP.

7.4. All drivers/attendants are required to observe all traffic rules and safety regulations within the
premises of NPCT1 inclusive but not limited to:
a. The refuellingRefueling personnel are not allowed to stand along the Yard cranes’ gantry paths.
b. Skid tankers standing point must be mark with minimum 4 (four) reflective cones during parking
or at positioned for refilling
c. Skid tanker must be equipped with rotary lamp in the outer cabin.

7.5. All drivers/attendants are required to comply strictly with safety guidelines stated in Standard &
Emergency Operating Procedure (“SOP”) for Port Equipment (Yard Cranes, Empty Stacker, etc.).

7.6. Safety and Communication Equipment

a. The contractor must ensure that all essential safety equipment e.g. traffic cones are in good
working condition.
b. Any defective equipment must be reported immediately. A replacement set shall be made
available.

c. The Contractor has to ensure that the traffic safety cones are placed at the chassis lane/service
lane to stop and alert the traffic movement when the driver has positioned the tanker at the
thoroughfare/end block for refuellingRefueling.

7.7. Collection Andand Transportation Ofof Fuel

(i) The contractor shall be advised to carry out training of fuel tanker drivers operators to ensure
that they are conversant with all required safety and operational procedures associated with
collection and transport of fuel at depots.
(ii) The contractor must ensure thatensure tankerthat tanker driverstanker drivers possess
at all times the necessary accreditations as may be required by the operator of the
fuel depots.
(iii) The contractor must keep NPCT1 updated on the fuel collection procedures as stipulated by
the operator of the fuel depots, this shall include any rules and regulations pertaining to fuel
collection. The procedures must comprehensively describe the tankers’ movements from the
time they enter the depot gates to the point when they exit.
(iv)(iii) The contractor must ensure at all times that the tankers are of a condition fit to
collect fuel from the depots and transport to NPCT1..
(v)(iv) The contractor is to ensure overall compliance with depot operator’s rules and regulations.
(vi)(v) The contractor shall expediently provide to NPCT1 any information relating to their fuel
tankers’ movements, whether within or outside depots, as and when required.
(vii)(vi) The contractor must ensure that the fuel tankers do not deviate in any manner from
the planned routes in transporting fuel to NPCT1, and that there are no unauthorized
stoppages en-route.
(viii)(vii) The contractor must comply with all applicable codes/ standards/ regulations
associated with fuel collection and transport.
