Planning to stay in the Philippines for good, Apolinario Rizal, a


balikbayan from Doha, Qatar, purchased parcel of land with four (4) studio
type apartments from his high school classmate Juan Luna who flew to the
US right after the sale. Unbeknownst to Apolinario, the property he bought
is already occupied by Antonio Ibarra, Juan Luna’s tenant. Apolinario
demanded Antonio to vacate the property but the latter refused to.
Apolinario called Juan and the latter said that Antonio has, in fact, not paid
for five (5) months. He also promised to evict Antonio as soon as he comes
back. However, three (3) months have passed and Juan can no longer be
contacted whilst Antonio refuses to vacate the property.
Apolinario now comes to you for your legal advice. Explain his
remedies and advise on the best course of action. Refer to the attached
documents and advise accordingly (10pts).

messaged you on facebook for your legal advise. He says,

“Hi Attorney! Please help me! My estranged wife and I got separated seven
years ago. I went home last month to attend her burial because she died in a
car accident. I discovered that she and my children were being evicted by
Macaugis from the house and lot, which we bought after our marriage.
Macaugis showed me a deed of sale and a Torrens title issued to his name. I
immediately noticed that the signature in the deed was not mine and told
him that I could not possibly have signed the document because I was out of
the country on the date stated in the deed. Macaugis claimed, however, that
my wife allegedly told him that I signed the document before I left and
worked overseas. Macaugis also stated that he had a certificate of title and
the deed was already notarized, so he had a better right over the property.
Can I file a case for the cancellation of the deed of sale or Macaugis’
certificate of title?”

A6-313 which was being driven by one Pakbol C. Kawlit. Jazmine filed a
criminal complaint against your prospective client Mr. Alimozaman Diamla,
operator of Tam-Tam Taxi Services. Mr. Diamla seeks your legal assistance as
to the Subpoena he received from the prosecutor’s office. According to Mr.
Diamla, he no longer owns the taxi unit as he already sold the same to one
Babae a Mataed. Nor is Pakbol his driver as he no longer operates the said
taxi untit having ceded to Babae all his rights to operate the same as a
common carrier. Mr. Diamla, however, failed to comply to the subpoena.
Luckily, he has a friend who works with the prosecutor’s office and told him
that no Resolution was issued yet by the investigating prosecutor. His friend
advised him to seek legal assistance as soon as possible. Considering Diamla’s
predicaments, write a legal opinion discussing Diamla’s problem and his best
course of action. (10pts.).

Their marriage was solemnized by Mayor Solomon Guttierez. After two (2)
years of rocky marital life which bore them one (1) baby, Daniel and Kathryn
decided to have their marriage annulled and split ways for good. Their
friends executed affidavits who swore that when they contracted the
marriage, Daniel and Kathryn were, in fact, drunk. Kathryn now seeks your
legal opinion as to the propriety of a Petition for Declaration of Nullity of
marriage and what happens to the status of their child should their marriage
be declared void ab initio (10pts.).

Jonaida, being from a well-to-do family has always helped Johaila, an orphan.
Many years later, Jonaida and Johaila’s status in life got reversed and Jonaida
had to borrow from Johaila in order to salvage her business first for the
amount of 120,000php and second for 420,000php. When the said debts
became due, Jonaida kept promising to pay but she never did. Johaila
unsuccessfully tried several times to contact her. Johaila later learned that
Jonaida has been spreading rumors against her and told their common
friends that she is an ingrate for expecting her to pay back despite all the
help she has given her all these years. In a Facebook groupchat, Jonaida
allegedly posted “wala talagang utang na loob. Di man lang nya naalala
kung saan sya nanggaling. Umasenso lang, kala mon a kung sino”. Deeply
hurt, Johaila seeks your legal advice as to how to recover the money owed
to her by Jonaida. Johaila also asks what she can do to stop Jonaida from
maligning her (10pts).

Hadja Fatima Direposun, wife of Hadji Ali Umpa (who is already


bedridden), came to your office to seek legal advice regarding her husband’s
property which has been the subject of a land dispute for years. According
to Hadja Fatiima, the property in question is the same land on which they
have constituted the family home—they have been living there as a family
for more than two decades and her husband has been born and raised there.
The property was allegedly inherited by Hadji Ali from his father who also
inherited the same from his father named Morris Umpa, brother of a certain
Mecawayan Umpa. The problem arose when Hamid Umpa, the grandson of
Mecawayan demanded Hadja Fatima and family to vacate the property and
alleged that they are the real owners. Upon confrontation in the Barangay,
Hamid presented a Deed of Absolute Sale where his grandparents
Mecawayan and Pintiare Macasasa are the vendees as well as a TCT and Tax
Declaration. Hadja Fatima, on the other hand, have no title nor documents
to prove ownership and relies on the fact that her husband has been in
possession of the property since time immemorial while Hamid’s family
relies only on paper but never occupied the property. Discuss to Hadja
Fatima the possible recourse that Hamid may take against them regarding
the property and advise her as to how she can protect her rights (15pts.).

Amae Suba, a PKF member who caused damge to Macalandap’s car allegedly
due to wrong parking. Mr. Macalandap seeks your legal assistance in the
drafting of a criminal complaint against Amae Suba (10pts). Make sure to
attach documents provided by Macalandap. He also seeks your advice as to
the possibility of instituting an administrative case against the Amae Suba,
where to lodge the same, and what are the consequences (5pts).

Rowena Ang, an agent jeweler who sells jewelries on a commission


basis, was entrusted by Amor Bonifacio of Amor Jewelry with 350-thousand
worth of diamond jewelries for a commission of 10%. Amor comes to you for
legal assistance as to any action she can institute against Rowena for not
returning the proceeds of the jewelries nor returning the jewelries
themselves, if unsold. According to Amor, it has been more than three (3)
months since Rowena was entrusted with the jewelries and she can no
longer be contacted except for one time that she actually spoke with Amor
and promised that she is only waiting for her buyer, a first lady in Lanao del
Sur. Amor consults your firm as to how to recover the jewelries or its value
from Rowena the soonest possible time (10pt.)
