DEED OF PARTITION

WITH WIAVER

KNOW ALL MEN BY THESE PRESENTS:

We, THE LIVING HEIRS OF _______________________________________________, namely:

Hereinafter collectively referred to as “HEIRS/CO-OWNERS.”

WITNESSETH THAT:

WHEREAS, ____________________________________________, was the registered owner of a parcel


of land located at ___________________________________________________ with Transfer Certificate of
Title No. _______________________, hereinafter referred to as the “PROPERTY”;

WHEREAS, _______________________________ passed away on


______________________________________ leaving behind the PROPERTY to the above-mentioned
HEIRS/CO-OWNERS;

WHEREAS, houses and structures already exist on the property and are being used for
residential purposes by the above-named HEIRS/CO-OWNERS;

WHEREAS, for the administration and better enjoyment of the PROPERTY, the
HEIRS/CO-OWNERS hereby agree to formalize its partition, use, and maintenance through
this DEED OF PARTITION WITH WAIVER;

NOW, THEREFORE, for and in consideration of the foregoing premises, the HEIRS/ CO-
OWNERS agree on the following:

1. The HEIRS/CO-OWNERS hereby adopt the partition of PROPERTY indicated on the


“Site Development Plan” a copy of which is herein attached as ANNEX A;

2. The distribution of the lots indicated on the Site Development Plan shall be as
follows:

3. All taxes, and fees assessed on the PROPERTY by any national or local government
office, agency or entity shall be paid by the HEIRS/CO-OWNERS as follows:

4. The expenses for any improvement or repair on any of the houses on the PROPERTY
shall be shouldered by the HEIR/CO-OWNER upon which such house is allocated to;
Provided that, expenses on any improvement or repair on the sorroundings,
common or unmarked areas shall be divided equally among the heirs;

5. Notwithstanding the partition or allocation of the PROPERTY as herein provided, the


HEIRS/CO-OWNERS agree NOT TO SELL, LEASE or ENCUMBER the PROPERTY to
any person who is not a party to this agreement;

6. __________________________________________________ hereby expressly, unconditionally, and


voluntarily WAIVES AND RENOUNCES his rights over the PROPERTY and RELEASES
the other HEIRS/CO-OWNERS from any liability or claim, his “Affidavit of Waiver of
Rights of Inheritance” is herein attached as ANNEX B;

7. The terms, conditions and undertakings in this deed or any modifications, revisions
or supplements thereof shall extend to and be binding upon the successors and heirs
of the parties as if they were in every case named and expressed therein;

8. Any amendment or modification to this deed shall not be binding unless expressly
made in writing and signed by the parties hereto.
