DEED OF EXTRAJUDICIAL SETTLEMENT OF ESTATE

AND ABSOLUTE SALE


THIS DEED MADE AND EXECUTED BY:

JUDITH TY DALISAY married to _______________, TERESA TY


SANTIAGO married to ________________, EDMUND E. TY married to
____________________ and GUMERSINDO E. ELUSFA married to
Adorada Elusfa, all of legal ages, Filipinos, with residence and postal
address at Block 5, Lot 16, Soldier’s Hills III, Novaliches, Caloocan City,
Cardinal St., Modesta Village, Sto. Niño, San Mateo, Rizal, Block 6 Lot
19 Falconcrest St., NSHA BF Homes, Parañaque City, and Arellano St.,
Zamboanguita, Negros Oriental, respectively, all in the Philippines,
hereinafter referred to as HEIRS; and

PERPETUA E. DELORIA, widow, of legal age, Filipino, with


residence and postal address at Arellano St., Zamboanguita, Negros
Oriental, Philippines, hereinafter referred to as HEIR-VENDOR;

In favor of:

SOPHIE TY MANUEL married to Rodrigo Manuel, Jr., of legal age,


Filipino, with residence and postal address at Kidapawan City,
Philippines, hereinafter referred to as the HEIR-VENDEE;

WITNESSETH:

WHEREAS, MAXIMA ENTAC married to Juan T. Elusfa is the


registered owner of a parcel of land, Lot No. 1811 situated in
Zamboanguita, Negros Oriental, under Tax Declaration No. 2017-20-
0007-00311, which parcel of land is more described and bounded as
follows:

(Under Tax Declaration No. 2017-20-0007-00311)

“A parcel of land (Lot No. 1811, situated in


Zamboanguita, Negros Oriental. Bounded on the N., by
Lot No. 1809; on the E., by Lot No. 1815; on the S., by
Lot No. 1813; and on the W., by Lot No. 1810. Containing
an area of NINE THOUSAND FIVE HUNDRED EIGHTY-NINE
(9,589) SQUARE METERS, more or less.”

WHEREAS, MAXIMA ENTAC married to Juan T. Elusfa died intestate


and without debts on ________________ and _________________,
respectively, at Zamboanguita, Negros Oriental, and at the time of her
death she was survived by her children, namely ANASTACIA E. TY,
PERPETUA E. DELORIA and GUMERSINDO E. ELUSFA as her only forced
and surviving compulsory heirs;

WHEREAS, ANASTACIA E. TY married to Ernesto Kimshia Ty died


intestate and without debts on 13 January 2005 at Kidapawan City and
28 May 1981 at Cotabato City, respectively, and at the time of her
death she was survived by her children, namely JUDITH TY DALISAY,
TERESA TY SANTIAGO, SOPHIE TY MANUEL and EDMUNDO E. TY, as her
only forced and surviving compulsory heirs;

WHEREAS, invoking Section 1, Rule 74, of the Rules of Court, and


the laws on intestate succession, the herein HEIRS, hereby adjudicate
unto themselves the above described parcel of land, free from all liens
and encumbrances whatsoever, subject however, to Section 4, Rule 74,
re: The liabilities imposed therein.

WITNESSETH FURTHER:

WHEREAS, for and in consideration of the sum of EIGHTY


THOUSAND PESOS (PHP80,000.00), in Philippine Currency, receipt
in full of which the HEIR-VENDOR PERPETUA E. DELORIA hereby
acknowledged and confessed to her entire satisfaction from the HEIR-
VENDEE, do, by these presents, hereby SELL, CEDE, TRANSFER and
CONVEY, in free simple and in a manner absolute and irrevocable, unto
and in favor of the aforesaid HEIR-VENDEE, the one-third (1/3) portion
of the above described parcel of land together with all the
improvements found thereon equivalent to THREE THOUSAND ONE
HUNDRED NINETY-SIX (3,196) SQUARE METERS, more or less,
her heirs, successors and assigns, free from mortgages and liabilities
whatsoever;

WHEREAS, the HEIR-VENDOR PERPETUA E. DELORIA warrants


clean registration and lawful possession and ownership over the one-
third (1/3) portion of the above described parcel of land, and that
notices of sale were given to adjoining owners and possible
redemptioners but who refused to buy the same.

IN WITNESS WHEREOF, we have hereunto set our hand this

ACKNOWLEDGMENT

BEFORE ME, a Notary Public for the City of Dumaguete and the
Municipalities of Sibulan, Valencia, Bacong Dauin, Zamboanguita and
Siaton, this __________ in Dumaguete City, Philippines, personally
appeared the HEIRS with their respective identification cards as proof
of identity, all known to me to be the same persons who executed the
foregoing instrument consisting of three (3) pages, including this page
where the acknowledgment is written, signed by them and their
instrumental witnesses on every page hereof and acknowledge to me
that the same is their free and voluntary act and deed.

ACKNOWLEDGMENT RECEIPT

I, PERPETUA E. DELORIA, widow, of legal age, Filipino, with


residence and postal address at Arellano St., Zamboanguita, Negros
Oriental, Philippines, hereby acknowledge receipt of the sum of EIGHTY
THOUSAND PESOS (PhP80,000.00), in Philippine Currency, as full
payment for the sale of the one-third (1/3) portion of a parcel of land
Lot No. 1811 situated in Zamboanguita, Negros Oriental, under Tax
Declaration No. 2017-20-0007-00311, equivalent an area of THREE
THOUSAND ONE HUNDRED NINETY-SIX (3,196) SQUARE
METERS, more or less, together with all the improvements found
thereon, from SOPHIE TY MANUEL married to Rodrigo Manuel, Jr., of
legal age, Filipino, with residence and postal address at Kidapawan
City, Philippines.
