REAL ESTATE MORTGAGE

KNOW ALL MEN BY THESE PRESENTS:

This MORTGAGE, made and executed in the City of Zamboanga,


Philippines, by and between -

AAA, of legal age, Filipino citizen, single and a resident of Lunzuran,


Zamboanga City, hereinafter called the MORTGAGOR,

- and -

SPOUSES BBB and CCC, both of legal age, Filipino citizens, with residence
and postal address at Guiwan, Zamboanga City, hereinafter called the
MORTGAGEE,

- WITNESSETH: THAT -

WHEREAS, the MORTGAGOR is the registered owner of that certain


real property situated at Barangay Lunzuran, Zamboanga City, covered by
Transfer Certificate of Title No. T-250,669, of the Registry of Deeds of
Zamboanga City, and more particularly described as follows:

“A parcel of land (Lot 2601-F-6 of the subdivision plan Psd-09-


043683, being a portion of lot 2531-D, Psd-10-028481, situated in
Barangay of Lunzuran, City of Zamboanga, island of Mindanao;
containing an area of TWO HUNDRED ELEVEN (211) SQUARE
METERS.

WHEREAS, the MORTGAGOR acknowledges to be justified indebted


to the MORTGAGEE in the sum set forth hereunder-below, and is willing to
guarantee the repayment thereof as well as performance of such other
obligations as may arise thereunder;

NOW, THEREFORE, for and consideration of the premises , and more


specifically as security for the principal obligation in the sum of EIGHTY
THOUSAND (P80,000) PESOS, Philippine Currency, the receipt hereof is
hereby acknowledged by the MORTGAGOR from the MORTGAGEES,
payable within ONE (1) month to commence from the execution hereof, the
said MORTGAGOR, does by these presents constitute a first mortgage in
favor of the MORTGAGEES, their heirs and assigns upon

the real property above-mentioned, without any building nor improvement


thereon; PROVIDED that should the MORTGAGOR shall pay or cause to be
paid to the MORTGAGEES, their heirs and assigned the principal obligation
herein secured, when the same shall have become due and demandable,
then this Mortgage, ipso facto, shall become null and void, otherwise, it shall
remain in full force and effect and be enforceable in the manner provided by
law and by this agreement.

That in case of foreclosure, the MORTGAGEES may elect to proceed


either judicially or extrajudicially, and in the latter event, they shall be, as they
are hereby appointed as attorney-in-fact of the MORTGAGOR, with
irrevocable powers, among other things, to take possession of the mortgaged
property, to collect the fruits and rents therefrom, and to sell the mortgaged
property at public auction, in accordance with the procedure prescribed by the
Real Estate Mortgage Law., for the satisfaction of the obligation herein
secured.

IN WITNESS OF, the parties have hereunto set their hands on this 15 st
day of January 2019 at the City of Zamboanga, Philippines.
