MOTION TO RELEASE CASH BOND

Accused ___________, by and through the undersigned counsel and

unto this Honorable Court, most respectfully states:

1. That the accused, ______________, put up a cash bail bond in the

amount of Php ________________, for the provisional liberty of the accused

in the above captioned criminal case;

2. That an order dated ___________________ was issued by the

Honorable Court granting the provisional dismissal of the instant case;

3. That the cash bail bond put up by the bondsman is now considered

moot and academic as the case had already been terminated;

4. That Rule 114 Sec. 22 of the Revised Rules of Criminal Procedure,

provides, to wit:

“Sec. 22. Cancellation of bail. – X x x x x x

The bail shall be deemed automatically

cancelled upon acquittal of the accused, dismissal
of the case, or execution of the judgment of
conviction.
 5. That pursuant to the foregoing provision of the rules of court, it is

humbly requested that an order be issued for the cancellation and release of

the cash bail bond in favor of _____________________.

WHEREFORE, it is most respectfully prayed of this Honorable

Court that an Order be rendered (1) Releasing to bondsman the cash bail
bond put up for the temporary liberties of the accused (who is now the
Movant) in connection with this case in the amount of P ___________; and
(b) Granting such other relief and remedies that are just and equitable under
the premises.
