EXECUTIVE ORDER NO. __ Series of 2019

RECONSTITUTING THE COMPOSITION OF THE EMPLOYEE


GRIEVANCE MACHINERY IN THE LOCAL GOVERNMENT
UNIT OF BAAO, CAMARINES SUR
WHEREAS, Section 83 of the Local Government Code of 1991 mandates that the
local chief executive shall establish a procedure to inquire into, act upon, resolve or settle
complaints and grievances presented by local government employees;

WHEREAS, CSC Resolution No. 0101 13 dated January 10, 2001, outlined the
Revised Policies on the Settlement of Grievance in the Public Sector to carry out the
provisions of the
Omnibus Rules Implementing Book V of EO No. 292, otherwise known as the Administrative
Code of 1987;

WHEREAS, the 2017 Rules on Administrative Cases in the Civil Service (2017
RACCS) outlines the prevailing framework concerning disciplinary and non-disciplinary
proceedings in administrative cases in the service;

WHEREAS, the Local Government Unit of Baao, aims to establish a productive


working environment between the local government officials and employees;

NOW, THEREFORE, I, JEFFREY S. BESINIO, Municipal Mayor of Baao, Camarines


Sur, by virtue of the powers vested in me by law, do hereby reconstitute the composition of
the Grievance Committee for the Local Government Unit of Baao, Camarines Sur.

Section 1. The LGU Baao Grievance Machinery. The Grievance Machinery shall be
composed of the Council (GMC), Grievance and Administrative Investigation Committee
(GAIC), and Committee on Decorum and Investigation (CODI). The Council and Committees
shall serve for a period of _____years.

Section 2. The Grievance Machinery Council (GMC). The Council shall be


composed as follows:

Section 3. Duties and Responsibilities. The Council shall have the following duties
and responsibilities:

 Craft policies, rules, and procedures on the conduct of grievance mechanism in the
Municipality for implementation by the GAIC and CODI;
 Monitor the implementation of the crafted policies and procedures and provide periodic
recommendations and updates for the Local Chief Executive;

 Develop proactive measures or activities to facilitate the conduct of grievance procedure


in the municipality;

 Conduct continuing information drive on Grievance Machinery among its officials and
employees.

Section 4. Composition of the Grievance and Administrative Investigation


Committee (GAIC). Composition of the Grievance Committee shall be as follows:

Section 5. Duties and Responsibilities of the Grievance and Administrative


Investigation Committee (GAIC). The Committee shall have the following duties and
responsibilities:

 Establish its internal procedures and strategies;

 Conduct dialogue and/or counselling between and among the parties involved.

 Conduct an investigation and hearing within _____ working days from receipt of the
grievance and render a decision within _____ working days after the investigation.
Provided, however, that where the object of the grievance is the Committee itself, the
aggrieved party may submit the grievance to the Office of the Municipal Mayor.

 Issue Certification of Final Action on the Grievance (CFAG) which shall contain, among
other things, the following information: history and final action taken by the Municipality
on the grievance. In no case shall the Committee issue a CFAG and elevate the
grievance to the Civil Service Camarines Sur Field Office until after it shall have
exhausted all possible means of conciliation and mediation between and among the
parties concerned.

Section 6. Composition of the Committee on Decorum and Investigation (CODI).


The Committee shall be composed as follows:

(Composition: At least 1 rep each from the management, BAMURAFA, 1 st level


employee, and 2nd level employee-CSC RACCS 2017)
Section 7. Duties and Responsibilities of the Committee on Decorum and
Investigation (CODI). The Committee shall have the following duties and responsibilities:

 Create internal rules and procedures in the conduct of its investigation;

 Conduct investigation on sexual harassment- related cases in the workplace;

 Conduct dialogue and/or counselling between and among the parties involved.

 Conduct an investigation and hearing within ___ working days from receipt of the
grievance and render a decision within _____ working days after the investigation.
Provided, however, that where the object of the grievance is the Committee itself, the
aggrieved party may submit the grievance to the Office of the Municipal Mayor.

 Issue Certification of Final Action which shall contain, among other things, the following
information: history and final action taken by the Committee and the Municipality. In no

Section 8. Secretariat; Duties. The ____________________ shall act as the


secretariat for the Council, GAIC, and CODI. As such, it shall perform the following duties ans
responsibilities:

 Provide technical assistance in the documentation of proceedings of Council and


Committee meetings and hearings;

 Provide technical assistance in the preparation of Committee reports;

 Submit a quarterly report of its accomplishments and status of unresolved grievances to


the Civil Service Commission Field Office concerned.

Section 10. Effectivity. This Executive Order shall take effect immediately.
