O R D E R:-

In the letter read above, the Special Commissioner of Agriculture, A.P., Guntur has
submitted a proposal for revision of original date of placing on probation in respect of Sri L.
Sreevardhan Reddy, Agricultural Officer (TA), O/o ADA(R) Dhone, Kurnool District, who has
passed the tests belatedly i.e., not during the probation period as the Government are alone
competent for extension and declaration of probation under Rule 16(h).

2. He has also submitted that in G.O.Ms.No.436, G.A. (Ser.D) Department,

Dt.15.10.1996, the Government have requested to send the proposals for extension of
probation and declaration of probation under rule 24© and 16(h) in respect of A.Os., who
have belatedly passed the prescribed tests. The above rules say that “a probationer who
does not pass the prescribed tests or acquire the prescribed special qualifications within the
period of probation or within the extended period of probation under rule 17 and whose
probation is further extended by the Government by an order under Rule -31, till the date of
his passing such tests or acquiring such qualifications, shall be deemed to have commenced
the probation with effect from the date to be fixed by the Government, which would be
anterior to a date to his /her passing such tests or acquiring such special qualifications,
however, that the interval between the two dates shall be equivalent to the prescribed
period of probation, whether on duty or otherwise and seniority of such probationer shall be
determined with reference to the date so fixed’. The Director of Agriculture has, therefore,
requested to issue orders for extension and declaration of probation of the individual.

3. Government have examined the matter and observed that in the instant case, Sri L.
Sreevardhan Reddy, has joined in the Department as Agricultural Officer and reported on
26.10.2006 F.N., and placed on probation with effect from 26.10.2006 F.N., in the category
of Agricultural Officer. But, the individual has not passed the Departmental Tests within the
period of probation. Hence, the date of commencement of probation of the individual has
to be changed as per the penal provision contained in Rule 16(h) of A.P. State &
Subordinate Service Rules, 1996 and the date of commencement of probation is to be re-
fixed taking into consideration the date of passing Departmental Test.
4. Accordingly, under Rule 16(h) of A.P. State & Subordinate Service Rules, 1996,
Government hereby change and re-fix the date of commencement of probation in respect of
L. Sreevardhan Reddy, Agricultural Officer (TA), Office of the Assistant Director of
Agriculture (R), Dhone, Kurnool District as 12.05.2008 instead of 26.10.2006 since, he
failed to pass the required Departmental Tests within the period of probation and passed the
same on 11.05.2010 F.N and accordingly, the probation of the individual is declared with
effect from 11.05.2010 F.N.

5. The Special Commissioner of Agriculture, A.P., Guntur is requested to take further

necessary action in the matter accordingly.
