FLINT, MI--- Bobby Jamar Younger, alleged leader of the City of Flint's Merrill Street
Hood Gang, convicted January 23, 2006 of 2 counts of Assault with Intent to Murder, 1 count of
Robbery Armed, and 1 count each of Felony Firearm and Felon in Possession, and sentenced to
32 to 50 years in March, 2006 will instead come home tomorrow. His sentence on those crimes
is now over and served in full 20 years early, on a deal for time served, on the Order of Genesee
County Circuit Judge Yuille, issued as a result of his attorneys discovering that his trial was
based on the perjured testimony of rival gang members that (his attorney says) the Genesee
County Prosecutor's Office had arguably known about for over 10 years.
In the years up to 2006 the Pierson Hood Gang terrorized the city of Flint with murder,
terrorism, armed robbery, dog fighting, arson, fraud, and weapons offenses, amongst others. In
2007 some 30 members of the Pierson Hood Gang were charged through the state-local-federal
-More-Flint Safe Streets Task Force; some were tied to 7 different gang-related homicides over the past
few years, including the 2004 double homicide at the Super 8 Motel that killed Kenneth M,
Edwards, 19, of Clio at the scene, and Marcus Ballard, 25, of Flint, and the shooting of two men
outside of Club Xelusive in the fall of 2005,
On Labor Day, 2004, alleged Merrill Hood gang member Bobby Younger allegedly shot
and severely wounded Pierson Hood Gang member Gamer Wood and also shot at this mother
Regina Wood, Separately but nearby, co-member Feronda Smith allegedly shot Pierson Hood
Gang member Monta Leeper. Wood and Leeper testified against Younger along with Wood's
mother Regina Wood, In their trial testimony Wood and Leeper denied the existence of any
organization known as Pierson Hood, denied ever being members of any such non-existent gang,
denied being rivals with the Merrill Hood Gang, and denied having any confrontation or
arguments with Younger before the shootings.
Documents located years later by Younger’s appellate attorney, David L. Moffitt of
Bingham Farms, MI, showed that Wood had swom under oath in 2007-2008 to police and
Assistant Prosecutor Karen Hanson when seeking a cooperation agreement that he had an angry
confiontation with Younger only 2 hours before he was allegedly shot by Younger, that he was a
Pierson Hood Gang member and that Younger was a member of the rival Merrill Hood Gang.
‘The Younger case jury was never informed that Wood had been involved in two separate
homicides before he testified in Younger’s trial, the shooting of two men outside of Club
Xclusive in fall, 2005, and a Flint area home arson intended to drive the residents out where they
could be shot. Two persons including a child were killed in the process, For both of these
homicides the Genesee County Prosecutor's Office revoked in 2012 its cooperation agreement
with Wood, reinstated charges against him and added new homicide charges for the double
homicides, Also concealed from the Younger case jury was Wood’s prior involvement in a
shooting at the Concord Coney Island.
‘Younger’s attomey Moffitt said he wrote to the Prosecutor’s Office January 9, 2019
informing them of the discovery and requesting internal review by the Prosecutor’s Office but no
action resulted, On April 15, 2019 Moffitt argued a Motion for New Trial to Judge Yuille, who
originally heard Younger’s trial, that the perjury entitled Younger to a new trial. Comparing
Wood's, Leeper’s and Regina Wood’s testimony at trial with the state and federal documents in
which they contradicted themselves, Mofiitt insisted that the Genesee County Prosecutor's
Office had known for at least 10 years of the perjury but had said nothing.
“We started investigating 4 years ago. It took until now to research
and corroborate all the conflicting testimony and prove that Mr.
Younger’s trial had been thoroughly perjured and that the
prosecution know it,” said Moffit,
After Moffitt began litigation to expose the perjury the Genesee County Prosecutor's
decided to offer “time served” to Younger by a May 6, 2018 e-mail that noted the Prosecution
-More-Office’s Com Integrity Unit had looked into the matter and agreed the misleading
testimony and the time Younger had served merited immediate redress. Judge Yuille, Genesee
County Circuit Court, signed the Order releasing Younger May 10, 2019. Moffitt said:
“L credit the Genesee County Prosecutor’s Office with taking the
perjury we have uncovered after over a decade seriously and
coming to the right decision—to release Mr. Younger immediately
from prison after serving 12 years as wrongfully convicted.”
Genesee County Assistant Prosecutor Karen Hanson who tried the case against Younger
discovered to have been perjured also was subject of a similar episode involving the same gangs.
In 2015 the Michigan Supreme Court set aside the conviction of alleged Merrill Hood Gang
member Feronda Smith because Genesee County Assistant Prosecutor Karen Hanson used the
perjured testimony of an informant to obtain the conviction, Franklin was twice retried to hung
juries and the charges later dropped
This was not Moffitt’s first prosecutor/perjured trial testimony case, In 2008, the Michigan
‘Supreme Court concluded that Wayne County Narcotics Unit Chief Assistant Prosecutor Karen
Plants and Wayne County Circuit Judge Mary Waterstone actively concealed the perjury of
multiple witnesses from the defense in the drug prosecution of Alexander Aceval, Moffitt
discovered the perjury and spent years trying to bring the situation to the attention of the
authorities and courts, After over 5 years of his efforts the Michigan Atiomey General’s Office
convicted the police officers and prosceutor, who was also disbarred. Dismissal of the Judge’s
charges on a technicality was pending on appeal and never refiled, but the Judge was forced to
retire.
“Unlike the Wayne County Prosecutor’s Office, which never
would admit that its Chiof Drug Prosecutor Karen Plants and
Cireuit Judge Mary Waterstone conspired to allow an entire trial to
be perjured against Alexander Aceval, reputed to be the state’s
largest drug dealer in 2005, the Genesee County Prosecutor's
Office finally took ownership of this flawed trial and did the right
thing,” said Moffit,
