ACCUSED, through the undersigned counsel and unto this Honorable
Court, most respectfully states that:
1. In a Decision promulgated by this Honorable Court on February 6,
2019, TEOFISTO R. ALCON was held guilty of the crime of Acts of Lasciviousness punishable under Article 336 of The Revised Penal Code and was sentenced to suffer the penalty of imprisonment of six (6) months as minimum to four (4) years as maximum;
2. The accused, through counsels, hereby manifests his desire to
avail of the benefits granted by the Presidential Decree No. 968, otherwise known as the “Probation Law of 1976, as amended”;
3. That he is not among those disqualified offenders as enumerated
in Sec. 9 of P.D. 968 as amended by R.A. 10707;
4. That he undertakes to comply with such terms and conditions as
this Honorable Court may impose if his application for probation will be granted.
WHEREFORE, in light of the foregoing, it is most respectfully prayed
of this Honorable Court that the execution of sentence of accused TEOFISTO R. ALCON be suspended and that he be placed on probation.
Other reliefs just and equitable are likewise prayed for.
