Facts:

Petitioner assails the judgment of the Court of Appeals in reversing the lower court’s decision.
Nikko Hotel Manila and Ruby Lim as petitioners files for a complaint on the lower court against
defendant Reyes for unlawful entry on petitioner’s occasion. However, defendant states his entry is
valid as per invitation from Dr. Filart, a guest attendee at the petitioner’s party and the former’s friend
whom he hasn’t seen a long time ago. Defendant filed for moral damages on exhibiting abuse, rudeness
and embarrassment towards him which is not of necessity to properly dismiss a person. Petitioner Ruby
Lim upon review of background and credentials, we’re of propriety character and of no bearing to do
such indecent act.

Lower court ruled in favor with petitioner. Defendant on appeal however, we’re affirmed by the
higher court more convinced with the defendant’s version of the story.

Issue:

Is Petitioner liable for perpetuating moral damages against defendant?

Held:

No, based on the statement of both parties, the discussion took place at point blank between
defendant and petitioner Ruby Lim. Wherein the alleged act of shouting on the part of the petitioner is
unconvincing since latter is of outstanding status as a top line employee and held no bad record and it
would be unbecoming it commit such compromise on her part.

Wherefore, the decision of the Court of Appeal is reversed and the lower court’s decision is
affirmed.
