Auto-Enthusiasts’ Club Constitution and By-Laws

Preamble
We, the automotive students of Philippine College of Technology with the help of
Almighty God, believing in the need for a better organized student government and in the
development of the youth through skills training, do hereby promulgate and adopt this
Constitution and By- Laws of the Auto-Enthusiasts Club that shall advance, implement, and
maintain our goals and aspiration embody the ideas of principle of freedom, equality,
justice and democracy and promote the welfare of all future skilled workers and the
academic standard of our Alma Mater.

Article I: General Provision


Sec. 1 This Constitution and By- Laws shall be known as the Constitution and By- Laws of
the Auto-Enthusiasts Club of Philippine College of Technology .
Sec. 2 For purposes of this Constitution and By-Laws, AEC Club refers to the Student
governing club of Philippine College of technology.

Article II: Name and Domicile


Sec. 1 The name of the organization shall be known as Auto-Enthusiasts Club or AEC
Sec. 2 The office of the AEC shall be located inside the premises of the school.

Article III: Declaration of Principles and Objectives


Sec. 1 The Auto-Enthusiasts Club of Philippine College of technology shall promote mutual
understanding thru social, civic, intellectual, recreational and scientific programs
and activities.
Sec. 2 The AEC shall have the following objectives:
a. To produce graduates that are well rounded in philosophy, methodology,
psychology, and community needs.
b. To equip graduates with values formation and curricular program to answer
the needs of time.
c. To train competent teachers for teaching needs of the country.
d. To practice understanding another person’s perspective and responding with
empathy.

Article IV: Membership


Sec. 1 All bona fide College of Education students of Philippine College of Technology are
the members of the studentry to whom the AEC shall accountable at all times.

Article V: Rights of FMC Members


Sec. 1 Every AEC member has the right to enjoy responsible freedom of speech and
expression.
Sec. 2 Every AEC member has the right to avail of all the services offered by the FMC.
Sec. 3 Every AEC member has the right to conduct and participate in all School Activities.
Sec. 4 Every AEC member has the right to information on all the issues and matters
concerning them.
Sec. 5 Every AEC member has the right to vote, be nominated and be elected into the
office.
Sec.6 Every AEC member has the right to be represented in the different meetings and
assemblies of the school on issues affecting the welfare of the studentry.
Sec. 7 Every AEC member has the right to due process.

Article VI: Duties and Obligation of FMC Members


Sec. 1 Every AEC member has the responsibility to observe the Laws of the Republic of
the Philippines, and the rules and regulations of the school at all times.
Sec. 2 Every AEC member shall pay the AEC registration fee as set by the first general
meeting of the AEC.
Sec. 3 Every FMC member shall support and promote the thrusts and objectives of the
FMC and the School.
Sec. 4 Every AEC member shall abide the FMC constitution and by –laws.
Sec. 5 Every AEC member shall participate actively in all school and club activities and
strive for academic excellence.
Sec. 6 Every FMC member shall exercise his/her rights and do his/her responsibilities as an
AEC member.

Article VII: Powers and Duties of the Fututre Mentors and Counselors’ Club
Sec. 1 The AEC shall be the highest governing body of the entire studentry.
Sec. 2 The AEC shall have the following functions and responsibilities:

a. Formulate and recommend programs that will address relevant


issues/concerns of the studentry;
b. Plan and Implement policies and programs designed to protect and to
promote students’ rights and welfare;

c. Monitor and evaluate the student’s activities in the school and in the
community.
d. Create committees necessary to address the needs of the students;
e. Make recommendations to school authorities regarding student matters,
affairs, and activities;
f. Serve as the representative of the studentry in voicing their opinions,
suggestions and grievances;
g. Have such powers and duties as the school authorities and the studentry
may, from time to time, grant or delegate, consistent with stated principles,
objectives and school policies;
j. Spearhead all mandated thrust, programs and activities such as anti -drug
abuse, anti-smoking, Tutorial Services for challenged learners and
Environmental Program;
k. Monitor and supervise the election of the AEC Officers for the Succeeding
school years;
l. Recommend to the Department Head giving incentives to the Education
students;
m. Turn-over financial assets, papers, documents, properties and other
responsibilities to the incoming FMC Officers, and,
n. Submit financial and accomplishment reports to the school authorities on a
monthly basis. Terminal report must be submitted to the school authorities
and the incoming AEC officers during the turn-over of responsibilities.

Article VIII: Composition, Election, Qualifications and Term of Office of the FMC
Sec. 1 The officers of the AEC are the duly elected President, Vice president, Secretary,
Treasurer, Assistant Treasure, Auditor, Public Information Officers, Business
Managers, and Appointed Year Level Representatives.
Sec. 2 The Year Level Representative/s shall be appointed by the President of AEC.
Sec.3 All AEC elections shall be conducted every third-fourth week of June annually.
Sec.4 Candidates for all AEC elective positions shall;
a. Be bona fide students;
b. Be of good academic standing with a general average of 85 and above with
out any failing grade during the 1st to 3rdgrading period of the current
school year;
c. Be of good moral character; and
d. Have not been subjected to any disciplinary sanction.
Sec. 5 No residency shall be required of the candidates for all AEC elective positions.

Sec. 6 The officers of the AEC shall hold office for one academic year.

Article IX: Duties and Functions of FMC Officers


Sec. 1 The President shall be the chief executive officer of the AEC. He/ She shall have the
following duties:
a. Preside over all meeting and/or may designate another officer to preside for
a specific meeting;
b. Enforce this constitution, By laws and other regulations that maybe
promulgated;
c. Sign all official minutes, resolutions, correspondences, and other official
papers of the AEC;
d. Represent the AEC or designate his/her representative for any external or
internal affairs/functions;
e. Head the coordinating Council of Campus Co-curricular Organizations;
f. Implement AEC programs and projects;
g. Create Ad Hoc Committees, as the need arises, the chairperson or which
shall be appointed by the AEC president; and,
h. Perform such functions inherent and incidental to his/her office.
Sec. 2 The Vice President shall have the following duties:
a. Assist the President in all matters where his/her assistance is necessary;
b. Assume the office of the President should the position become a vacant;
c. Supervise members in planning and arranging meetings or programs of
activities;
d. Head the Internal Affairs Committee and conceptualize programs and
projects and plan activities with the Year Level Representatives; and,
e. Perform such other duties assigned by the FMC.
Sec. 3 The Secretary shall have the following duties:
a. Keep accurate records of the minutes and document proceedings of every
meeting;
b. Keep a file of all pertinent documents and papers of the AEC and make them
accessible to the studentry;
c. Call and prepare all notices of AEC meetings;
d. Head the Supreme Student Government; Secretariat; and,
e. Perform such other duties assigned by the AEC.
Sec. 4 The Treasurers shall have the following duties:
a. Keep all financial records of the AEC;

b. Serve as the disbursing officer of all the AEC’s funds;


c. Prepare the annual budget of the AEC;
d. Prepare financial reports every month, after an activity, and at the end of
term;
e. Formulate pertinent financial guidelines for the organization;
f. Head the Finance Committee; and,
g. Perform such other duties assigned by the AEC.
Sec.5 The Auditor shall have the following duties:
a. Certify the legitimacy and correctness of the disbursement of funds;
b. Audit all expenditures of the AEC funds;
c. Assist the Treasurer in formulating guidelines and reports;
d. Keep and update inventory of all the AEC’s Property;
e. Act as the Assistant Head of the Finance Committee, and;
f. Perform such other duties assigned by the AEC.
Sec. 6 The Public Information Officers shall have the following duties:
a. Popularize the thrusts and objectives of the AEC;
b. Build and maintain a credible image of the AEC;
c. Take charge in the promotion of AEC projects and activities;
d. Head the publicity committee, and;
e. Perform such other duties assigned by the AEC.
Sec. 7 The Year Level Chairperson/s shall have the following duties:
a. Act as the year level head coordinator of all AEC programs and Projects in
his/her Year level.
Sec. 8 The Business Managers shall manage all income generating activities of AEC and
function as directed by the President.

Article X: Meetings and Quorums


Sec. 1 The AEC shall conduct regular meeting every first and third week of the month or as
agreed upon by the officers.
Sec. 2 Special meetings of the AEC may be called upon by the President or by majority of
the AEC officers.
Sec. 3 Majority of the officers of the AEC (50% + 1) shall constitute a quorum.
Sec. 4 Each officer of the AEC is entitled to only one vote.
Sec. 5 No proxy shall be allowed when voting.

Article XI: Impeachment, Resignation and Vacancies


Sec. 1 The officers of the AEC may be impeached on the following grounds:
a. Culpable violations of the Constitution and By-laws;

b. Gross misconduct, violence to person in authority, negligence, and disloyalty


to the cause of AEC;
c. Non-attendance in the both regular and special meetings for 3 times without
valid cause; and,
d. Abuse or misuse of power and authority.
Sec. 2 Two-thirds vote of the General Assembly shall be final. However, the officer charged
shall be informed 20 days prior to his/her impeachment case proceedings, of the
charge/charges against the accused the opportunity to be heard with or without a
counsel in his/her defense.
Sec. 3 Resignation of an elected officer shall be in writing and shall take effect 5 days after
the approval of the majority of the AEC officers.
Sec. 4 Any vacancy in any of the positions for the reason of death, resignation,
impeachment, shall be filled, subject to the recommendation of the AEC.
Sec. 5 Any vacancy in the AEC, except the position of the President, shall be filled within
ten school days from the day the position is rendered or considered vacant, by
appointment of the President from among the qualified members of the AEC.
Immediately upon appointment, the appointee shall serve the remaining period.
Sec. 6 The AEC shall certify as the vacancy occurring in the club and the OSS shall certify
the fact of appointment of the vacant position.

Article XII: Amendments

Sec. 1 The Constitution and By- Laws may be amended or modified in full or part once
every
3 years from Club Moderator issuance through a memorandum.
Sec. 2 Proposed amendments shall be transmitted to the Office of the Students Services at
least one month before the holding an election.
Sec. 3 Amendments to this Constitution and By-Laws shall take effect immediately upon
approval of the President of the School.
