Page: 30! 16 aa aaa 09-2019-CR-02905 On 07/15/2018 at approximately 0052 |, Officer Heidi Witzel, initiated a traffic stop in the 4300 bik 9th Ave Circle S on a white Nissan sedan, The vehicle turned into 4325 9th Ave Circle S parking lot and continued through the parking lot, not stopping. With my lights and sirens stil activated, the vehicle continued eastbound on Sth Ave Circle S. Vehicle came to a stop and | approached the vehicle. Driver, later identified as Abraham Nyei, began backing up, almost hitting my squad. Officers gave several commands to Nyei to exit the vehicle and if he fails to comply that his window will be broken. At this time Nyei placed the car in reverse and began driving backwards. Due to Officers close proximity to the moving vehicle and concerns for officer safety, Officers began breaking the driver's side window. Officers assisted Nyei out of the vehicle and gave verbal commands to get ‘on the ground and place his hands behind his back. Officers were able to detain Nyei and placed him in handcuffs, behind the back. Officers kept giving commands to take a seat in the squad car and Nyei continued to escalate, by yelling and pushing against Officers. Nyei quickly stood up and aggressively, shoved himself into Officer Iverson. Both tripped and stumbled on the curb, and with an attempt to not let Nysi fall onto him, Officer Iverson pushed off the area of Nye’s upper back, lower neck area. This caused Nye to fall forward, striking his face on a light pole Vehicle was searched due to an odor of Marijuana emanating from the vehicle. Officer iverson located a small plastic bag of Marijuana. Officer Iverson took custody of the Marijuana and logged it into Evidence. Nyei was transported to Sanford for treatment and later arrested for Preventing Arrest, Fleeing in Motor Vehicle and Possession of Marijuana and transported to Cass County Jail for Booking See Supplements.
