PUBLIC NOTICE

NOTICE IS HEREBY GIVEN the City of Haines City is providing public notice as required by the Haines City Code
of Ordinances Chapter 8 – Cemeteries; Section 8-8 Presumption of Abandonment.

On July 2, 2019 the City Commission of the City of Haines City approved Resolution 19-1393 authorizing the City
Clerk to initiate the procedure set forth in Section 8-8 (Presumption of Abandonment; Unused Burial Spaces) in
Chapter 8 (Cemeteries) of the Haines City Code of Ordinances concerning unused burial spaces in the Forest Hill
Cemetery, and to take all administrative actions consistent with such procedure.

Sec. 8-8. Presumption of abandonment. Unused burial spaces. NOTE: Section 497.286, F.S.

(a) There is hereby created a presumption that burial rights in any City cemetery as defined in this Chapter have been
abandoned when an owner of unused burial rights has failed to provide the City with a current residence address for
a period of fifty (50) consecutive years and the City is unable to communicate by certified letter with said owner of
unused burial rights for lack of address.

(b) Upon the occurrence of a presumption of abandonment as set forth in subsection (a), the City will first send a
letter to the last known address if available and if no address is available and/or no response to the City’s letter is
received, the City shall publish public notice in a daily newspaper of general circulation in the City and post the notice
on the City’s website. The notice shall contain the following information.
1. Describe the coordinates to have been abandoned.
2. Set forth the name of the owner(s) or Grantee listed on the deed or if the owner is known by cemetery records
to be deceased, then the names of such claimants as are heirs at law, next of kin, or specific beneficiary under the will
of the owner if known.
3. Detail the facts with respect to the failure of the owner or survivors to keep the city informed of the owner’s
address for a period of fifty (50) consecutive years or more.
4. The notice shall run two (2) times in a consecutive two (2) week period. After one hundred and twenty (120)
days from the final notice and publication, the City shall have the right to sell such burial rights.

The City Commission desired to provide a reasonable and appropriate process to ensure that the lineal descendants
and co-owners of burial rights have access to reasonable notice before the burial rights are deemed abandoned and the
ownership of the spaces reverted to the City of Haines City.

The following individuals have failed to provide the City of Haines City with a current residence address for a
period of fifty (50) consecutive years. To claim cemetery spaces listed below please contact the City Clerk’s Office
at (863) 421-3600 ext. 5114 to schedule an appointment.
