Probable Cause Statement ON 07-07-2019 AT APPROXIMATELY 1722 HOURS, THE PHOENIX POLICE DEPARTMENT RE- CRIVED A CALL PROM THE MOTHER OF THE 9 YEAR OLD FEMALE VICTIM. WHEN THE PHOENIX POLICE ARRIVED THE MOTHER ADVISED THAT THE 9 YEAR OLD FEMALE VICTIM DISCLOSED THAT SHE HAD BEEN ASSAULTED JUST A FEW MINUTES PRIOR BY AN UNXNOWN BLACK MALE IN THE GYM OF THE AE APARTMENTS 17 TM OFFICERS CONDUC- TED A SRARCH OF THE AREA FOR THE SUSPECT WITH NO SUCCESS. THE 9 YEAR OLD FEMALE VICTIM AND HER MOTHER WERE TAKEN TO CHILDHELP FOR A FORENSIC INTERVIEW AND MED- ICAL EXAMINATION WHERE DNA WAS COLLECTED FROM NUMEROUS LOCATIONS ON HER BODY, INCLUDING HER FINGERNAILS. THE VICTIM WAS FORENSICALLY INTERVIEWED AND DISCLOSED A TIMB ON 07-07-19 SHE LEFT HER APARTMENT TO GO TO A FRIENDS APARTMENT THAT WAS ALSO IN HER COMPLEX, ALONG THE WAY, THE VICTIM WAS CONTACTED BY AN UNKNOWN BLACK MALE NEAR THE APARTMENT COMPLEX GYM. THE SUSPECT GRABBED HER AND DRAGGED HER IN- TQ THE GYM, THEN INTO THE GYM'S WOMEN'S RESTROOM. THE SUSPECT LOCKED THE RE- STROOM DOOR; PUSHED THE © YEAR OLD FEMALE VICTIM TO THE GROUND AND LALD ON TOP OF HER AND COVERED HER MOUTH WITH HIS HANDS. THE 9 YEAR OLD FEMALR VICTIM WAS THEN ABLE TO SCRATCH THE SUSPECT ON KIS FACE, CHEST, SHOULDER, NECK AREA WITH HER NAILS AND HE FLED THE SCENE. THE VICTIM REPORTED THE INCIDENT TO HER MOTHER, WHO CALLED POLICE, DURING THE MEDICAL EXAMINATION OF THE 9 YEAR OLD FEMALE VIC- TIM DNA SWABS WERE COLLECTED INCLUDING THE ONES FROM HER NAILS. ON 07-13-19 aT APPROXIMATELY 2200 HOURS, THE PHOENIX POLICE DEPARTNENT RECEIVED NOTIFICATION FROM THE STATE DNA DATABASE WHO RECEIVED A HIT CONFIRMATION REGARDING THE SAMPLE TAKEN FROM THE VICTIM'S RIGHT FINGER NAILS AND THAT SAMPLE MATCHED THE DNA PRO- FILE OF THE SUSPECT WILLIAM BUFORD. A SUBSEQUENT RECORDS CHECK REVEALED THAT WILLIAM BUFORD MATCHED THE PHYSICAL DESCRIPTION OF THE SUSPECT AS PROVIDED BY THE VICTIM DURING HER FORENSIC INTERVIEW AND THAT HE WAS A TRANSIENT WHO HAD BEEN DOCUMENTED FREQUSNTING THE AREA IN WHICH THE ASSAULT TOOK PLACE. ON 07-15-19 AT APPROXIMATELY 0500 HOURS, THE PHOENIX POLICE DEPARTMENT FOUND AND DETAINED WILLIAM BUFORD. WILLIAM BUFORD HAD FACIAL SCRATCHES THAT MATCHED THE INJURIES DESCRIBED AS INFLICTED BY THE VICTIM. WILLIAM BUFORD WAS SUBSEQUENTLY TRANSPORTED TO 620 WEST WASHINGTON STREET. HE WAS WEARING BLUE AND BROWN FILA SHOES AS DESCRIBED BY THE VICTIM. AFTER MIRANDA RIGHTS WERE READ, WILLIAM CON- FIRMED THAT HE FREQUENTS THE MUMBA PARTMENTS WHERE HE HAS A FRIEND NAMED CASON, BUT THAT HE IS HOMELESS, HE STATED THAT HE REGULARLY HANDS OUT WATER BOTTLES AND MONEY TO CHILDREN AND ADULTS IN THR NEIGHBORHOOD. WILLIAM SAID THERE WAS A GIRL THAT HE CAUGHT TAKING MORE THAN ONE BOTTLE OF WATER AND HE TOOK A BOTTLE BACK FROM HER. WILLIAM SAID SHE SWUNG HER HAND AT HIM AND SCRATCHED HIS NECK. WILLIAM DENIED HAVING ANY CONFRONTATION AT THE GYM OR BATHROON WITH ANY GIRL, BUCCAL SWABS WERE TAKEN FROM WILLIAM FOR COMPARTSON AND PICTURES WERE TAKEN OF HIM.
