Dealing with aggression:


 To develop and implement workplace policies and procedures to inform workers how to
respond to threats from clients including violence, aggression and self-harm.
 Ensure workers have easy access to procedures dealing with violence and client aggression.
Provide support for contact center workers following interaction with aggressive clients.

Noise is one of the reason of aggression:


 Ensure noise emission levels are as low as possible at all stages of their workplace. Provide
approved personal hearing protection devices. Where necessary, arrange for noise risks
assessment by measuring noise levels and exposure.
 Within the workplace, the company keeps the noise levels below the exposure standard of
85 decibels in an 8-hour day so that critical situations can still be communicated despite
the noise.

Induction and recordkeeping:


 Provides information to a new worker at a rate that allows them to understand it properly.

 The Company does not use any unsafe mechanical equipment that can harm the workers.
The company makes sure that whether the worker is experienced or he/she must pay as
much attention as someone who is new to using it.

Electricity:
 The Company recruits licensed workers or electricians to work on electrical equipment’s.
The electrical equipment’s are kept away from wet areas.

Bullying:
 Seek advice from another person, for example a supervisor or manager, human resources
officer or health and safety representative to help you work out if the behavior you have
been experiencing is workplace bullying, as early as possible.
 Check if the workplace has a bullying policy and reporting procedure you can follow. The
policy should outline how your organization will prevent and respond to workplace
bullying.

Harassment:
 Apply and comply with the employer’s policies and procedures on harassment. Include any
appropriate conduct or comment by a person towards a worker that the person knew or
reasonably ought to have known would cause that worker to be humiliated or intimidated.
 Exclude any reasonable action taken by an employer or supervisor relating to the
management and direction of workers or the place of employment.

First Aid Responsibility:


 The Company makes sure that all the workers must be able to access a first aid kit. The
first-aider will complete the accident book with the relevant details.

Accidents and incident reporting:


 If the person requires treatment phone or get someone else to phone for a first aider. If there
is any obvious cause and it is safe to deal immediately then take appropriate action
 e.g. contact janitor or cleaner to mop up a spillage. Complete college accident/incident
report form.

Hazard control measures:


 The Company substitutes a substance, method or material to reduce the risk of the hazard.
Lock out procedures on faulty equipment’s. The company develops work methods like
written safe operating procedures, staff trained in the correct operating procedure.

Working with computers:


 The Company ensures that the assessment includes all computer uses, including home
workers; consider visiting home offices. The company checks that furniture is comfortable
and suitable: for example, an adjustable chair and a desk with adequate space.
 It provides suitable computer equipment that can be used without straining. Ensures that
there is adequate lighting.

Emergency evacuation plan:


 In case of floods, fires, chemical spills, explosions, civil disturbances, etc. The company’s
emergency plan includes a preferred method for reporting fires and other emergencies, an
evacuation policy and procedure, rescue and medical duties for any workers designated to
perform them.

Office layout:
 The office should be in proper lighting conditions like designing your office so that the
major light source is natural lighting throu0gh windows can improve employee morale and
keep the space well-lit throughout the day.
 To ensure your office layout is in accordance with health and safety regulations make sure
the flow of the office is unobstructed.

Accident and incident reporting:


 If an accident occurs, it is important for workers to have immediate response options, which
may include calling senior staff for assistance, security or the police.
 Under evasive self-defense the workers have to safely remove themselves from the place
of accident.

Accident investigation:
 Accident investigation is the scientific and academic analysis of the facts that occurred
during an accident.
 An investigation is conducted to identify the root cause of an accident in an effort to make
recommendations or take corrective actions to prevent the future occurrence of the same
or a similar event.

Approval for financial and human resources for WHSMS:

1. Financing for the WHS


Xero Company is bound to provide a healthy work environment complying all the rules
and regulations. To maintain and regulate the workplace financial approval is requisite for
the company. For evaluating the hazards Xero has a special financing system which
compensates for the damage of the workplace or the workers and employees.

2. Insurance policies
Xero also provides insurance to all the workers and employees including HR. Special
policies are signed for the safety of workers were the company provides the insurance
services which gives compensate on the injuries or illness of the employees.

goals, and satisfactory geographic point. After we begin a brand new business, it becomes
obligatory to implement health and safety practices for maintaining a secure operating setting for
the workers, staff, customers, volunteers and suppliers. This can be done to confirm that our
business doesn’t produce health and safety issues and runs expeditiously.

Occupational Health and Safety Act 2004:

The Parliament of Victoria enacts as follows:


 The importance of health and safety requires that employees, other persons at work and
members of the public be given the highest level of protection against risks to their health
and safety that is reasonably practicable in the circumstances.
 Persons who control or manage matters that give rise or may give rise to risks to health or
safety are responsible for eliminating or reducing those risks so far as is reasonably
practicable.
 Employers and self-employed persons should be proactive, and take all reasonably
practicable measures, to ensure health and safety at workplaces and in the conduct of
undertakings.
 Employers and employees should exchange information and ideas about risks to health and
safety and measures that can be taken to eliminate or reduce those risks.
 Employees and entitled, and should be encouraged, to be represented in relation to health
and safety issues.

WHS training:
According to the local legislation the Work Health Safety Act, WHS training to the employers is
important to secure safe workplace.
Section 31 (2) (c) of the Occupational Health and Safety Act 1985 states that employers should
consult with HSC and HSR related to work activities.
The training and instructions should be given to the employees about the hazards, fire and
emergency, first-aid training should also be given so that they can ensure their own safety. The
changes made in the rules and regulations should be updated to the employees.

Duties of employers to employees:
1. An employer must, so far as is reasonably practicable, provide and maintain for employees
of the employer a working environment that is safe and without risks to health.
1800 penalty units for a natural person;
9000 penalty units for a body corporate.
2. Without limiting sub-section (1), an employer contravenes that sub-section if the employer
fails to do any of the following—
 Provide or maintain plant or systems of work that are, so far as is reasonably practicable,
safe and without risks to health;
 Make arrangements for ensuring, so far as is reasonably practicable, safety and the absence
of risks to health in connection with the use, handling, storage or transport of plant or
substances;
 Maintain, so far as is reasonably practicable, each workplace under the employer's
management and control in a condition that is safe and without risks to health;
 Provide, as far as is reasonably practicable, adequate facilities for the welfare of employees
at any workplace under the management and control of the employer;
 Provide such information, instruction, training or supervision to employees of the employer
as is necessary to enable those persons to perform their work in a way that is safe and
without risks to health.
3. For the purposes of sub-sections (1) and (2)—
 A reference to an employee includes a reference to an independent contractor engaged by
an employer and any employees of the independent contractor; and
 The duties of an employer under those sub-sections extend to an independent contractor
engaged by the employer, and any employees of the independent contractor, in relation to
matters over which the employer has control or would have control if not for any agreement
purporting to limit or remove that control.
4. An offence against sub-section (1) is an indictable offence.
 However, the offence may be heard and determined summarily (see section 53 of, and
Schedule 4 to, the Magistrates' Court Act 1989).

Approval for financial and human resources for WHSMS:

 Financial Approval from the authority of the organization is mandatory on every


transaction done for the resources. According to Occupational Health and safety Act
authorization for any agreement should be given from the funding source of the company.
 Bestowing the workers of the company insurance for their own safety should also be
authorize by the compliance.
 According to the Workers’ Compensation and Rehabilitation and other Legislation
Amendment Act 2015 which states that if any worker in the organization is injured or death
befalls working in the organization due to any hazards then compensation should be given
to the employee and their family.
 It is the responsibility of the company to approve the recompense to the worker for any
harm. This act was approved by the Parliament on 17 September 2015.

Health and Safety Committee in terms of Engagement:


 Engagement of HSC, HSR, and PCBU’s is important for taking key-decisions for the
workplace according to WHS and OHS laws implemented by the Australian Government.
The law states that the PCBU’s should and HSC should involve in the inspection of the
workplace, identifying and evaluating the hazards and endow the advice and help to the
workers. They should scrutinize if any worker is facing any hindrance in their work.
 This is the responsibility of PCBU to engage in ensuring the healthy and safe workplace.
This WHS model law was executed on 2011 by Safe Work place Australia.

Manual Handling:
Manual Handling Operations Regulations 1992, as modified by the HSC regulations 2002 signifies
that how the worker should avoid and prevent the risk of manual handling.
This Act focuses on the safety of the workers which are caused due to moving and handling.
Information of handling the heavy loads should be specified through sign boards and notices.

Dealing from the manual handlings:


 Firstly, prevention from manual handlings should be practice as much as you can elude.
 Secondly if the manual handling is unavoidable then it should be minimized.
 Thirdly the risk of injury through manual handling should be taken care of individually.

If any organisation is not able to safeguard the manual handlings of any employee, then the
organisation has to pay the compensation up to 50,000 AUD.

Dealing with Aggression:


The Occupational and Safety Act 1984, codes of practice provides the guidelines to deal with
aggression in the workplace. Employers should make policy and follow the procedures to manage

the aggression and violence. Actions should be taken for and against for the conflicts taking place
between the workers.
Justice should be done by the employer to the workers as it is one of the hazards which may cause
physical and psychological harm to the employee and also to the company directly or indirectly as
aggression can turn into violence which will lead to damage to the property and also can injure the
worker which company has to yield the medical expenses.

Bullying:
Under the Workplace Health and Safety Act, 1995 bullying is considered as unlawful. Prejudice
because of cast, creed, and individual race between staff members can lead to offensive conflicts.
Bullying in workplace also comes under hazard which ills the employee psychologically which
consequence into lower viability of the employee.
According to the Australian Human Rights Commission (AHRC) it is the employer, HSR, PCBU’s
responsibility to seek the cooperative environment in the workplace and monitor and review the
workplace, and everyone are treated fairly in the workplace, and if any transpired then immediate
action should be taken against the employee and have to pay the penalty set by the organization
and it should be around 20,000AUD

Harassment:
Harassment clause are comprised in the WHS legislation, including the following acts:
 Section 18C of the Racial Discrimination Act 1975 excludes the offensive behaviour
towards employee due to racial hatred, color, cast and individual race.
 Section 28A of the Sex Discrimination Act 1984 describes the sexual harassment offended
in the workplace.
 Section 25 of the Disability Discrimination Act 1992 prohibits the harassment on the
infirmity of the workers.
The organization should take initiatives against harassment and humiliation to shape a healthy
workplace. As it is an offence the penalties should be received by the organization according the
WHS legislation.

Hazards:
There are hazards on every workplace and to prevent it the Occupational Health and Safety Act
was passed by the Australian Government to ensure a healthy and safe workplace. This act implies
workplace should be free from all the hazards and risks to develop the company effectively.

Accident and incident reporting:


For the enhanced workplace accident and incident reporting is obligatory. Occupational Health
and Safety Act, 1984 states that reporting of accident and incident should be done to the
organization to prevent the causes of accident and ensure the safety of the employees.

Emergency evacuation plan:


Emergency can occur any time whether it is fire emergency, earthquakes, tornadoes or any other
tragedy. It is the concern of the organization to plan an emergency evacuation.
Under the OHS Act it is specified that emergency evacuation plan should be executed to ensure
the safety of the workers and the workplace.

 In accordance with WHS legislation it is the duty of employers to consult with


employees on WHS requirements to resolve the arising issue at workplace. Xero
lacks in consulting with the employees in discussing of WHS requirements.
Recently Xero faced to pay the penalties to the state government because they
avoided the risk of wiring fraying in the workplace due to which one of the
employee was injured. This issue was taken lightly by the organization which lately
they have to face the forfeits.

3. Are outcomes of the participation and consultations accessible to employees? Why or


why not?

 Yes, the outcomes of the participation and consultation are often accessible by the
employee in Xero. The participation of employee at Xero are able to access the
hazards and risk by evaluating, functioning, coordinating and civilizing the
workplace. But as Xero is a vast software company it is hard to involve all the
employee in the consultation and participation so at times outcome of the decision
by the committee are not satisfactory.

 Yes, Xero need the advice from WHS expert because to manage the enormous
company is not so easy. Still the Xero needs to modify the workplace so that the

1. Recommendations for development and implementation to the WHSMS
so as to achieve organizational WHS objectives:
 An employer must, so far as is reasonably practicable—
(a) Monitor the health of employees of the employer; and
(b) Monitor conditions at any workplace under the employer's management and
control
(c) Provide information to employees of the employer (in such other languages as
appropriate) concerning health and safety at the workplace, including the
names of persons to whom an employee may make an enquiry or complaint
about health and safety.
Penalty: 240 penalty units for a natural person;
1200 penalty units for a body corporate.
 An employer must, so far as is reasonably practicable—
(a) Keep information and records relating to the health and safety of employees of
the employer; and
(b) Employ or engage persons who are suitably qualified in relation to
occupational health and safety to provide advice to the employer concerning
the health and safety of employees of the employer.
Penalty: 60 penalty units for a natural person;
300 penalty units for a body corporate.
 Duties of self-employed persons to other persons
(1) A self-employed person must ensure, so far as is reasonably practicable, that persons
are not exposed to risks to their health or safety arising from the conduct of the
undertaking of the self-employed person.
Penalty: 1800 penalty units.
(2) An offence against is an indictable offence.
Note: However, the offence may be heard and determined summarily (see section
53 of, and Schedule 4 to, the Magistrates' Court Act 1989).

2. Make sure recommendations comply with the WHS legislative


framework.
(1)An employer must, if requested by a health and safety representative for a designated
work group of which employees of the employer are members, allow the representative to
attend the following courses—

(a)An initial course of training in occupational health and safety after being elected;
(b)A refresher course at least once in each year, after completing the initial course of
training, that he or she holds office.
(2)A request to attend a course must not be made less than 14 days before the course is to start.
(3)A course must be—
(a)Approved or conducted by the Authority; and
(b)Relevant to the work of the members of the designated work group or the role of health
and safety representatives; and
(c)Chosen by the health and safety representative in consultation with the employer.
(4)The employer must—
(a)Allow each health and safety representative time off work to attend the courses with
such pay as he or she would otherwise be entitled to receive from the employer for working
during that period; and
(b)Pay the costs associated with each health and safety representative's attendance at the
courses.
Note:If the health and safety representative represents a designated work group of the
employees of more than one employer, section 68 provides for the apportionment of those
costs among the employers.
(5)If an employer refuses to allow a health and safety representative to attend a course or they
cannot agree on a particular course, the representative may ask the Authority to determine a
specified course that the representative may attend for the purposes of sub-section (1)(a) or (b).
(6)A determination must be in writing and the Authority must ensure that it is not made less than
14 days before the specified course is to start.
(7)An employer who, without reasonable excuse, refuses to allow a health and safety
representative to attend a course specified in such a determination is guilty of an offence and liable
to a fine not exceeding—
(a)In the case of a natural person, 60 penalty units; or
(b)In the case of a body corporate, 300 penalty units.
(8)(a)A health and safety representative represents a designated work group of the employees of
more than one employer; and
(b)Any of those employers has complied with this section in respect of the representative
each of those employers is to be taken to have complied with this section in respect of the
representative.

injured by getting tremors while operating the machinery. Though it will affected the production
quota one day which will impact on the sell margins of the company but disclosing it will save the
immense destruction of the workplace as well as workers life.

The employee of XERO are updated regularly if any changes are made in the WHS policies
and procedures of the company the information is updated through E-mail, PPTs and by
telling to employees.

Outcomes of the investigation can be resulted into the cause of the accident and incident
and then we can eliminate it. Through investigation we can estimate how much the hazard
is problematic.

C. Outcomes of audits and inspections.

Audits and inspection can help in rescuing the hazards. As hazards can be known early thus
one’s live is saved and is prevented from affecting with injuries and illness.

D. Information about new hazards or risks.

Information of new hazards and risks can be updated by reporting and by inspecting the
workplace. It can also be informed by near miss reporting to HSC and employer.

E. Progress updates on risk control strategies being implemented.

New strategies and process of safeguarding workplace which are implemented can be
updated through emails, PPTS and also by helding the conference to inform the personals.

The maintaining of WHS records is very important in any organization as form records one can
easily revel and the cause of hazards and risk. By record it becomes easy to manage the personnel
in the work. If any hazards or risk are identifying that should be recorded so that in future if any
issue occurs, then it becomes easy for the organization to evaluate and resolve it.

Identify potential consequences to WHS in case that hazards are not identified
or risk controls are inadequate.
If any hazard in the workplace becomes unidentified or the risk controls are inadequate, then it
will affect whole the organization directly or indirectly. Due to this any person can be fatal and
may get server injuries. This will drown the company name if the risk is not controlled accurately.
The unidentified hazards should be taken into consideration by the company or else the company
could suffer from unemployment which will bring down the margins of the company.

Employer should train the staff of the company. They should identify the skill of the employee and
