RESOLUTION

This resolves the petition for review filed by Complainant-Appellant,


Alma V. Sojor and Josephine V. Sojor, assailing the resolution dated
December 3, 2018 issued by the Office of the Provincial Prosecutor, Davao
del Sur, dismissing the case against the Respondent-Appellee for Cyberlibel
in Violation of Republic Act No. 10175.

Department Circular No. 70, series of 2000, or the 2000 NPS Rule on
Appeal provides for the requirements in filing a petition for review with the
Office of the Secretary of the Department of Justice. A perusal of the
instant petition shows that appellant failed to properly comply with the
following requirements:

1. The Petition is filed with proof of service of a


copy thereof to the adverse party/ies and the
Prosecution Office Concerned (Sec. 5 par. 1).

In addition, Department Circular No. 018, series of 2017, or the Rule


on Electronic Filing of Petitions for Review , which was adopted and made
an integral part of the 2000 NPS Rule on Appeal, further provides for the
following requirement, which the Complainant-Appellant likewise failed to
comply, viz:

1. The Petition is submitted: (i) in s long folder, (ii)


secured with fasteners, and (iii) chronologically
paginated from bottom page upwards (Sec. 3);

2. A verified declaration that a Petition and its


annexes submitted electronically are complete
and faithful electronic reproductions of the
paper-based documents (Sec. 4).

Section 6 of the 2000 NPS Rule on Appeal provides that failure to


comply with the foregoing requirements constitute sufficient ground for the
dismissal of the petition.

WHEREFORE, premises considered, the petition for review is hereby


DISMISSED for failure to comply with the mandatory requirements under
the applicable rules.
