COMPLAINT-AFFIDAVIT

I, HAZEL M. BAYANO, of legal age, Filipino and a resident of


Hinunangan, Southern Leyte, after having been duly sworn to according to
law hereby depose and state that:

1. On July 29, 2017, at around 4 o’clock in the afternoon, before


leaving the building, COLLEGE OF LAW. I entrusted my
laptop to my classmate PEDRO PENDUKO, with
confidence that he will give it back on July 31, 2017 after
finishing his research on Constitutional Law 1.

2. At around 9 o’clock in the morning on July 30, 2017. I called


PEDRO PENDUKO to remind him to make sure that he will
give back the laptop on July 31, 2017 but he did not answer
his phone.

3. On July 31, 2017, at around 6 o’clock in the evening. I went


to the building and was surprised because my classmate
PEDRO PENDUKO did not come to class.

4. When I was about to call him, his friend in the same class
passed by so I asked her if she had seen PEDRO PENDUKO.
She said she had not seen him that evening but had seen him
last morning on July 30, 2017. He was carrying a bag that is
intended for laptops and he was having a conversation with a
man. His friend overheard him saying “BARATO NALANG
GYUD NING LAPTOP SIR, TEN THOUSAND NALANG,
BISAG SA MALL SIR DILI KA KAPALIT UG LAPTOP
NA TEN THOUSAND”.

5. After conversing with his friend and knowing that he might


possibly sold my laptop. I called him several times but to no
avail he did not answer his phone.

6. He did not also come to class from thereafter. On my part, I


went to his address but his land lady said he’s travelling for
the whole month.
7. The unlawful act by Respondent caused damage on my part
because I had to buy a new laptop in the amount of Php
21,000.00 instead of using the said amount to pay the
remaining balance of my tuition fee.

8. In view of the foregoing, I am executing this affidavit to


support the filing of a formal complaint of qualified theft
against PEDRO PENDUKO.

IN WITNESS WHEREOF, I have hereunto affixed my signature this


3rd day of August, in the city of Maasin, Philippines.
