CONTRACT OF LEASE

BONGABON PUBLIC MARKET


Bongabon, Nueva Ecija

KNOWN BY ALL MEN BY THESE PRESENTS;

The Municipality of Bongabon, Nueva Ecija, represented by its Municipal Mayor, the
HONORABLE RICARDO I. PADILLA, and hereinafter referred to as the LESSOR,

-and-

GEMMA B. SALVATIERA of legal age, of Bongabon, Nueva Ecija, and herein after
referred to as the LESSEE,

WITNESSETH: That

WHEREAS, the LESSOR has constructed a new public market situated in Barangay
Commercial, Bongabon, Nueva Ecija;

WHEREAS, the LESSEE is willing to lease and the LESSOR hereby agrees to lease and lets
to the LESSEE Stall in #10 Building F Meat of the New Public Market under the following
terms and conditions:

1. TERM OF LEASE CONTRACT: The Lease Contract shall be for a period of TEN
(10) years to commence on April 3, 2019 and shall expire April 3, 2019. This
Contract will be renewed for the same period subject to the terms and conditions as
may be agreed upon by the parties herein, provided that the Lessee has not violated
any provisions of this Contract, The New Market Code and other pertinent Laws
and Regulations or Ordinances. Provided further, that an intention to renew on the part
of the LESSEE must be executed in writing, addressed and served to the LESSOR, at
least (60) days prior to its expiration, otherwise, it is understood that it shall no longer be
renewed.

2. PAYMENT OF POSSESSION FEE AND DEPOSIT CASH BOND- Upon signing of


this contract, the LESSEE shall pay to the LESSOR the amount of Five Thousand Pesos
Only (5,000.00) as POSSESSION FEE. In addition he/she shall deposit to LESSOR the
amount of Five Thousand Pesos Only (5,000.00) as CASH BOND which shall be
refundable at the time of the termination of this contract after deducting the payment for
arrears and /or other damages which LESSEE may have caused to the LESSOR.

3. AMOUNT OF RENTAL: the LESSEE shall pay the LESSOR the monthly rental of Five
Hundred Pesos Only (500.00) per month for the LEASED PREMISES. The said monthly
rental same shall be payable every month without need of demand, within the first ten (10)
days of each month which shall commence upon the signing of this contract. FAILURE to
pay the monthly rental within twenty (20) days, after it has become due shall be sufficient
cause for the revocation of the lease and for the ejectment of the stallholder from his
stall/booth or stalls/booths. It is understood by the parties that this amount of rental is
subject to periodic increase as may be deemed appropriate by the Sangguniang Bayan of
Bongabon, Nueva Ecija;
4. USE AND PURPOSE OF LEASED PREMISES: The LESSEE hereby expressly agrees
and warrants that the leased premises shall be used exclusively for Meat Section only and
said LESSEE shall not utilize or devote the premises for any other use without the prior
written consent of the LESSOR.

5. ASSIGNMENT / SUB-LEASE: The LESSEE shall not assign or transfer his rights hereto
nor sub-lease or sub-let all or any part of the LEASED PREMISES without the written
consent of the LESSOR.

6. CARE OF PREMISES: The LESSEE agrees and undertakes to keep and maintain the
LEASED PREMISES in a clean and sanitary conditions, free from noxious odor and
disturbing noises as required by the LESSOR and as embodied in the New Market Code of
Bongabon, Nueva Ecija and/or other laws, rule and regulations;

7. IMPROVEMENTS: The LESSEE shall not introduce any improvement on the leased
premises without the prior written consent of the LESSOR. Upon the expiration of the lease,
the LESSEE shall surrender and return the premises and the improvements, if any, to the
LESSOR;

8. COMPLIANCE WITH LAWS, RULES AND REGULATIONS: The LESSEE shall at


all times comply with THE NEW MARKET CODE of Bongabon, Nueva Ecija and all other
rules and regulations, laws, ordinances and others promulgated by the duly constituted
authorities, municipal, provincial or national applicable to the premises. Violation of any or
all of the same is sufficient cause for the ejectment of the LESSEE from the leased
premises;

9. TELEPHONE, WATER, ELECTRICITY, AND OTHER SERVICES: Charges for


water consumption, electricity, water pumps and other utility services in the premises as
well as for the REPAIRS IN THE UTILITY SYSTEM shall be for the exclusive account of
the LESSEE;

10. CHANGES IN THE EXISTING INSTALLATION: The LESSEE shall not make
alteration or changes in the electric or plumbing installation or in any other improvements
installed within the leased premises, without prior written consent of LESSOR;

11. INJURY OR DAMAGE: It is expressly agreed that the LESSEE shall be solely responsible
for any and all the acts or omissions of their employees, customers, clients and visitors. The
LESSEE hereby holds the LESSOR free and harmless from any all claims and actions for
loss, damage to property or injury to any of the aforesaid persons while in the premises.

12. SURRENDER OR PREMISES: The LESSEE agrees to return and surrender the LEASED
PREMISES and all the improvement therein except as provided for under par. 6 of this
contract, five (5) days from the expiration or termination of this Contract, without any delay
whatsoever;
13. AND FINALLY, whatever considerations the LESSOR may concede to the LESSEE, as
well as any other condonation the LESSOR may give to the LESSEE, as regards the
obligation of the latter shall not be interpreted as a renunciation on the parts of the LESSOR
of any of its rights under this contract.

IN WITNESS WHEREOF, the parties have hereunto set their hands at the place above written,
on this 3rd day of Aprill , 2019.
