STATE OF NORTH CAROLINA, fe —— ORDER % ) ) ZAMAR SCOTT. 3 On July 11,2019, Justin Marshall Spry placed a 911 call to the Asheville Police ‘Department (“APD”) immediately prior to his death, The above-named defendant is presently in ‘custody and has received felony charges in connection with Mr. Spry’s death, ‘The City has received requests forall 911 recordings relaing to Mr. Spry’s death, and to date, has produced transcripts of 4 out of 5 recordings responsive to that request. The City has, however, withheld disclosure ofa fifth rocording, pursuant to N.C, Gen, Stat. § 132-L4(e), ‘which provides that ifa public law enforcement agency believes that release of such a 911 recording will jeopardize the right of the State to prosecute a defendant or the right of a ‘defendant to receive a fair rial or will undermine un ongoing or future investigation, it may seek ‘an order from a court of competent jurisdiction to prevent disclosure ofthe information, ‘Based! on the City’s representations, and agreement with those representations by the ‘Buncombe County District Atiomey's Office end defense counsel, release of the July 11, 2019 ‘911 call placed by Justin Spry would jeopardize the right of the State to prosecute a defendant, Jeopardize the right of a defendant to receive a fair trial, or would undermine an angoing or future investigation, ‘Therefore, upon the City’s motion, the Court ORDERS that the contents of the 911 recording by SEALED until resolution of all relevant criminal matters. jing Supgfor Court Jude (MARVIN.
